Text of the Bar Association's Resolution

We lawyers of the nation, participating at the 12th Lawyers Conference for the Rule of Law, hosted by the Korea Bar Association, have discussed the "Rule of Law and Reform." We have reached the conclusion that the government's reform programs have markedly regressed away from the real rule of law that demands lawfulness and justification.

We, granted the mission to protect basic human rights and achieve social justice, undertake this conference to explore the meaning of the rule of law, and to call on the government to carry out its reforms under the mantle of law. And we resolve as follows:

1. We express concern that the government's reform programs, with their stated goals and causes, have a tendency to overlook lawfulness and justification in the legal procedures implementing reforms. We reaffirm that it is the essence of democracy that reforms should take place based on relevant laws and on the principle of the rule of law.

2. We urge the government to pursue reform based on the rule of law, not on rule of power.

3. We will do our utmost to bar unconstitutional legislation that is a product of the government's hurried effort to promote the interest of certain groups and which in the process overlooks the legal system and incurs great confusion and social cost.

4. We will work toward a rule of law that upholds economic justice achieved through ensuring basic social rights, fair distribution of income and economic democracy.

5. We will do our utmost to make sure that reforms take place under the rule of law, and in unified concert and order with the society at large.
