Our roiled judiciary (KOR)

French political scientist Alexis de Tocqueville published the book “Democracy in America” in 1840 after a tour of the United States to see what a great republic it was. He wrote, “The peace, the prosperity, and the very existence of the Union are vested in the hands of the seven judges (of the Supreme Court of the United States.)” A sovereign judiciary remains the last resort to defend U.S. democracy. The terms of justices on the top bench are for life and their sovereignty is ensured by the Constitution to uphold judiciary neutrality and fairness.

Supreme Court Chief Justice John Roberts immediately issued a statement to rebuke President Donald Trump for a contemptuous remark about a judge who ruled against am executive order which prohibited people in a caravan from Central America applying for political asylum. Trump called the judge “an Obama judge.” Roberts wrote, “We do not have Obama judges, or Trump judges, Bush judges, or Clinton judges … What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them. That independent judiciary is something we should all be thankful for.”

Last year, Roberts, a conservative appointed by Republican President George W. Bush, backed Trump’s immigration travel ban on Muslims. Still, he did not tolerate Trump’s attack on the independent judiciary. The dignity of the U.S. Supreme Court evokes envy from Koreans, who are increasingly skeptical of their judges’ political independence.

Justices who served under former Supreme Court Chief Justice Yang Sung-tae have been summoned to the prosecutor’s office one by one. They are accused of interfering with trials to curry favor with the presidential office of disgraced President Park Geun-hye.

The scandal has deepened a divide in the judiciary. A group of judges that emerged as the new mainstream under liberal Chief Justice Kim Myung-soo has been demanding expulsion of sitting judges implicated in the power abuse scandal. A senior judge has called on conservative judges to form an opposition front to impeach the liberal group of judges for encouraging an uprising in the judiciary.

Chief Justice Kim Myoung-su is failing to show leadership. Public trust in the judiciary has fallen to the extent that people involved in litigation are investigating the ideological tendency of the judges assigned to their cases. It is a pity that we can only envy the Americans for their independent bench.

미국 대법원 vs 한국 대법원
프랑스 정치학자 알렉시스 드 토크빌은 미국을 여행하고 1840년에 출간한 『미국의 민주주의』에서 미국의 평화와 번영, 그리고 존재 그 자체가 7명으로 구성된 연방대법원의 손에 달려 있다고 썼다. 독립된 사법부의 역할이 미국 민주주의의 보루임을 강조한 것이다. 미국 연방대법원은 대통령이나 의회의 결정을 무효화할 수 있는 막강한 힘을 쥐고 있다. 연방대법관 임기는 종신이며, 의회도 대법관 급여를 삭감할 수 없다. 정치가 사법부의 공정성을 흔들지 못 하게 하기 위한 장치다.
연방대법원의 위상은 최근 뉴스에서도 확인된다. 도널드 트럼프 대통령이 중남미 이민자의 망명 신청을 금지하는 행정명령의 효력을 일시중지시킨 판사를 '오바마 판사'라고 비난했다. 전임 오바마 대통령이 임명한 판사가 내린 판결임을 들먹인 것이다. 그러자 존 로버츠 연방대법원장이 21일 이례적으로 성명을 내고 대통령을 공개적으로 비판했다. "우리에겐 '오바마 판사'나 '트럼프 판사' '부시 판사' '클린턴 판사'는 없다. 자신 앞에 선 모든 이에게 공평하도록 최선을 다하는 헌신적인 판사라는 비범한 집단만 존재할 뿐이다. 이런 독립적인 사법부는 우리 모두 감사해야 할 대상"이라는 내용이었다. 로버츠 대법원장은 공화당인 조지 W 부시 대통령이 임명한 보수 인사다. 지난해 무슬림 입국을 막는 반(反)이민 행정명령에 대한 대법원 판결에선 트럼프 편을 들었다. 그래도 판사와 사법부를 공격하는 대통령을 좌시하지 않았다. '법 앞에 평등(Equal Justice Under Law)'이라는 문구를 건물 정면에 새겨넣은 연방대법원의 권위와 독립성을 새삼 실감한다.
한국 상황은 답답하기만 하다. 양승태 전 대법원장이 이끌던 대법원은 '사법 농단' 의혹에 휩싸여 핵심 인사들이 줄줄이 검찰 수사를 받거나 앞두고 있다. 지금 사법부는 사법행정권 남용을 의심받는 판사의 탄핵을 둘러싸고 둘로 쪼개졌다. '사법부 신(新)주류' 소리를 듣는 특정세력이 주도하는 전국법관대표회의는 판사 탄핵을 촉구했고, 어제 현직 부장판사는 "법관대표회의야말로 우리 헌정사에 가장 나쁜 사법 파동"이라며 법관대표회의를 탄핵하자고 주장했다. 혼돈의 사법부 앞에서 김명수 대법원장은 별다른 리더십도 보여주지 못하고 있다. 이제는 재판 당사자들이 판사의 성향을 미리 따질 정도로 재판과 사법부의 신뢰가 땅에 떨어졌다. 토크빌이 이런 한국의 기막힌 현실을 둘러보고 『한국의 민주주의』를 쓴다면 한국을 반면교사(反面敎師)로 거론하며 정치 바람을 타지 않는 독립적인 사법부의 중요성을 다시 강조할 것 같다.
