New prosecutor general’s challenges (KOR)
President Moon Jae-in on Monday named Yoon Seok-youl, current head of the Seoul Central District Prosecutors’ Office, the new prosecutor general. Moon’s decision reflects his deep trust in Yoon in a crusade to reform the prosecution. To achieve the goal of cleaning up the top law enforcement agency, the president picked him as the chief of the Seoul Central District Prosecutors’ Office two years ago — an exceptional promotion of a senior prosecutor from the Daejeon District Prosecutors’ Office.Yoon’s nomination sends a clear message to continue a reform of the prosecution and investigations of what the president calls “past evils.” If Yoon passes a confirmation hearing in the National Assembly, he becomes the first prosecutor general to take the job without serving as the head of a high prosecutors’ office since 1988.
First, Yoon must pursue prosecution reforms for the people’s sake. He must not be held hostage to the prosecution’s past image as a servant to the powers that be. He needs to lay down some of the prosecution’s massive power and must not blindly hand over the prosecution’s power to the police to the extent of fully guaranteeing them the right to close cases on their own. He must not act in sync with the Blue House even when he is forced to — and must speak for the prosecution when the need arises.
Second, public fatigue is quickly growing as a result of the liberal administration’s relentless crackdown on past evils mostly involving former government officials. He must focus on crimes that directly affect citizens from now to help the government put our economy back on track.
Third, he should help change the tradition of the prosecution in which senior prosecutors automatically retire when their junior peers are promoted to the level of prosecutor general. If the practice continues, as many as 30 senior prosecutors have to retire. Instead, he should transfer them to other key positions in the prosecution.
Fourth, he must prevent unnecessary encroachment of public interest as a result of the ongoing friction between the prosecution and the judiciary under former Chief Justice Yang Seung-tae over the alleged abuse of power by the Supreme Court’s administration office.
Last, Yoon must exercise his power in a balanced way. If he is swayed by the president’s aides, relatives and heavyweight politicians, it only leads to more evils. He said he does not obey whomever is in power. We hope he proves it through actions.
JoongAng Ilbo, June 18, Page 30윤석열 신임 검찰총장 후보자 앞에 놓인 과제들 문재인 대통령이 어제 차기 검찰총장 후보자로 윤석열 서울중앙지검장을 지명했다. 대체로 예견했던 결과다. 대통령의 신임이 워낙 두터워서다. 검찰을 개혁 대상 0순위로 지목한 문 대통령이 취임 직후 검찰 총장보다 먼저 대전고검 검사이던 그를 서울중앙지검장에 기용하는 '파격 인사'를 단행한 게 2년 전이다. '윤석열 검찰총장' 지명의 함의는 명확하다. 현 정부 출범 이후 지금까지 해 왔던 '적폐 수사'와 '검찰 개혁'을 중단없이 계속 추진한다는 선언이다. 윤 후보자 인선의 세가지 이유로 적폐청산 수사의 성공적 지휘, 남은 비리와 부정부패의 척결, 검찰개혁의 완수를 꼽은 고민정 청와대 대변인의 설명이 뒷받침한다. 윤 후보자가 정식으로 임명되면 1988년 총장 임기제가 도입 이후 고검장을 거치지 않은 첫 검찰총장이 된다. 그러나 기쁨은 잠시뿐이고 고뇌의 시간이 이어질 공산이 크다. 최근에 검찰이 맞닥뜨리고 있는 여러 과제들은 일도양단의 해결이 쉽지 않다. 청와대와 국민의 시선도 결코 우호적이지 않다. 윤 후보자는 특히 몇 가지 과제들을 유념해야 할 필요가 있다. 첫째, 검찰 개혁 추진 국면에서 국민의 권익을 유일한 기준으로 삼아 최선의 방안을 마련해야 한다. 정권이 바뀔 때마다 양날의 칼을 휘두르다가 '정권의 시녀'라는 낙인이 찍힌 검찰의 무소불위 권한을 분산하고 힘을 빼는 것은 시대적 과제다. 검찰이 내려놓을 것은 과감하게 내려놓아야 한다. 그렇다고 검찰에서 뺏은 수사권을 경찰에 나눠주고 수사종결권까지 보장하는 것만이 능사는 아니다. 요즘 경찰의 각종 부실 수사를 보면 불안하기 짝이 없지 않은가. 무작정 청와대와 코드 맞추기를 하기 보다는 내부의 의견을 귀담아 듣고 할말은 해야 마땅하다. 둘째, 수년간 계속돼온 '적폐수사'에 대한 피로감이 적지 않다. 지금까지의 적폐수사가 전 정부 인사들의 비리에 집중했다면 이제부터는 '민생 적폐'에 집중하는 게 필요하다. 가뜩이나 팍팍해진 민생과 경제에 도움이 되는 방향의 수사를 해야 한다. 정치권 눈치 보기 수사는 이제 지양해야 옳다. 셋째, 사시 기수가 낮은 총장이 임명되면 윗 기수들이 줄줄이 '용퇴'하던 서열·기수문화 관행도 고쳐야 한다. 윤 후보자는 문무일 총장보다 5기수가 아래다. 이전 관행대로라면 검사장급 이상 30여명이 옷을 벗어야 한다. 총장 후보 경합자들은 불가피하더라도 나머지 검사장급 이상 간부들 중 상당수는 다양한 보직에 분산배치해 더 봉직할 수 있는 기회를 열어주는 게 바람직하다. 넷째, 양승태 대법원장 시절의 사법행정권 남용에 대한 사법부 수사 등으로 인해 검찰과 법원간 갈등과 반목이 위험 수위에 도달해 있다. 두 기관의 충돌로 새우등 터지는 것은 애꿎은 국민들이다. 수사와 재판과정에서 국민 권익이 침해되는 일이 발생하지 않도록 당장 유연한 대책 마련에 나서야 한다. 마지막으로 유념해야 할 것은 비록 대통령의 발탁으로 검찰 수장에 오르더라도 법 집행의 저울이 기울어져서는 안된다는 점이다. 청와대, 대통령 친인척 및 측근, 여야 유력 인사를 막론하고 검찰권이 공정하게 행사되지 않는다면 또 다른 적폐를 낳을 수 있다. 윤 후보자가 "저는 사람에 충성하지 않는다"고 스스로 밝힌대로 정권과 권력자의 검찰이 아닌 국민의 검찰로 거듭나기 위해 각고의 노력을 다해 달라. 그래야 검찰이 산다.
