Reforms for whom? (KOR)

In a question session at the National Assembly on Tuesday, Justice Minister Cho Kuk said that human rights for suspects have not been properly protected while prosecutors enjoyed complete independence in their investigations. He said he had reported to President Moon Jae-in in the previous day about ways to stop the prosecution from infringing on human rights. The infringements were supposed to include the public release of allegations against suspects and overnight interrogations. Shortly after Cho’s briefing, Moon urged Prosecutor General Yoon Seok-youl, a hard-liner, to come up with concrete measures to restore public trust in the law enforcement agency. Rep. Lee In-young, floor leader for the ruling Democratic Party, joined the chorus by demanding the top prosecutor answer directly.

In the face of such pressure from the president, the justice minister and the floor leader, the Supreme Prosecutors’ Office on Tuesday presented its answer. Firstly, it plans to disband the powerful special investigation department — except in three major prosecutors’ offices, including the Seoul Central District Prosecutors’ Office — and improve their practices, including public summoning of suspects and public release of charges involving suspects.

The general public wonders about the real motives behind all this. There are rumors that Justice Minister Cho’s wife will be summoned for questioning without public notification. As human rights protection is an unalienable Constitutional right, her privacy should be protected. But why are new rules applied to Cho’s wife first?

Cho cites democratic procedures and human rights protection for suspects as top priorities for prosecution reforms. But we are suspicious. Korea’s prosecution reform has been centered on protecting the independence of prosecutors and banning their investigations for political purposes. As a result, a prosecutor general now enjoys a fixed term and prosecutors cannot be dispatched to the Blue House. In Tuesday’s question session in the legislature, Prime Minister Lee Nak-yon said that a prosecutor general is authorized to serve for two years regardless of administrations.

We wonder what the reform is really aimed at? Cho said that prosecutors are guaranteed independence. But the changed rules can affect the investigation of his wife and other relatives. That’s why an increasing number of people are wondering if the government wants to force Prosecutor General Yoon to step down. The government must stop prosecution reforms if they are dubious.

조국 가족을 위한 검찰개혁인가
조국 법무부 장관은 어제 대정부 질문에서 “검찰 수사의 독립성은 완벽히 보장돼 있지만, 인권 옹호 문제는 아직 미진하다고 국민은 판단한다”고 말했다. 대통령 업무보고 내용에 대한 질문에 답하면서 “피의사실 공표 문제, 밤샘수사, 별건 수사 등의 인권침해 소지를 없애기 위해 어떻게 해야 할 것인가에 대해 (대통령께) 보고드렸다”고 설명했다. 업무보고에는 검찰의 80% 이상을 차지하는 형사ㆍ공판부에 대한 처우 개선도 포함됐다고 한다. 이후 문 대통령은 “검찰총장에게 지시한다. 국민으로부터 신뢰받는 권력기관이 될 수 있는 방안을 조속히 마련해 제시해주길 바란다”는 공개 발언을 했다. 어제는 이인영 더불어민주당 원내대표가 “윤석열 검찰총장이 직접 대답해야 한다”고 말했다.
대통령, 법무장관, 여당 원내대표의 한목소리 압박때문인지 대검찰청은 어제 오후 임명권자(대통령)와 상관(법무장관)의 ‘지시’를 고스란히 반영한 개혁안을 내놨다. 특수부를 폐지(서울중앙지검 등 3개 검찰청 제외)하고 피의자 공개 소환과 피의사실 공표 등 검찰권 행사 실태를 점검하고 개선하겠다는 게 골자다.
갑작스러운 대통령의 지시와 대검찰청 발표에 국민은 어리둥절하다. 도대체 무엇을 위한 검찰개혁 타령인지 의심이 들지 않을 수 없다. 그도 그럴 것이 당장 이번 주 조 장관 부인의 검찰 소환 방식이 공개에서 비공개 형식으로 바뀌었다는 소식이 전해졌다. 피의자 인권 보호는 당연히 지켜져야 할 헌법적 가치이며 공인인 법무장관의 부인이라 하더라도 초상권이 보호되고 피의사실이 알려져서는 안 된다. 그러나 국민 생각은 왜 그런 기본적인 권리가 유독 조 장관 가족에게만 보장되느냐는 지점에서 멈추게 된다. 2년여 전 국정농단 사건 수사에서 최순실의 딸 정유라가 수차례 검찰에 불려 나오며 언론의 카메라 플래시 앞에 무방비 상태로 서 있었던 장면을 기억하기 때문이다. 그토록 중요하고 다급한 피의자 인권에 왜 그때는 함구했는지 묻고 싶은 것이다. 개혁에 진정성이 느껴지지 않으니 특정인과 특정 세력을 위한 것이라는 의심이 생기는 것이다.
검찰개혁의 핵심을 민주적 통제와 피의자 인권 보호에 두는 조 장관 논리에도 고개가 갸웃거려진다. 검찰 개혁의 역사는 ‘중립성과 독립성 보장’ ‘정치보복 수사 금지’ 등 정치권력과 검찰의 유착을 막아내는 과정이었기 때문이다. 검찰총장의 임기제(1988년), 검사의 청와대 파견 금지(1997년), 검사동일체 원칙 삭제(2004년) 등의 입법은 검사가 ‘살아있는 권력’ 앞에 굴복하지 않기를 바라는 개혁이었다. 이낙연 국무총리도 어제 검찰총장의 임기제에 대해 “정권으로부터 독립적으로 소신껏 일하라는 취지로 알고 있다”고 답변했다.
지금의 검찰 개혁은 진정 누구를 위한 것인가. 조 장관은 검찰 수사의 독립성이 보장돼 있다고 했지만, 당장 그의 부인 소환에서부터 영향을 미친 점은 부인하기 어렵게 됐다. 자신과 가족을 수사 중인 검찰총장이 ‘토해내듯’ 검찰개혁안을 발표하게 만들어 놓고도 수사와 무관하다고 할 수 있는가. 이러니 여권이 ‘후환’을 미리 없애기 위해 윤 총장을 몰아내려 한다는 음모론까지 나오는 것이다. 여권은 국민의 의심병만 키우는 진정성 없는 검찰개혁 놀음을 당장 중지해야 한다.
