The Labor Standard Law Applies to Illegal Aliens

Illegal aliens in Korea are entitled to the protection and benefits the Labor Standard Law offers. The Ministry of Labor (MOL) announced on October 14 that it changed an existing authoritative interpretation based on the Supreme Court's recent judgment that illegal aliens who have jobs in Korea are entitled to workers' rights covered in the Labor Standard Law.
Employers who hire illegal aliens will be subject to the full extent of the law as domestic cases involving Korean citizens. As of the end of August, the number of illegal aliens is estimated to be 92,686 and surveys indicate that many of them suffer abuse at the hand of employers. The Labor Standard Law is now approved to equally apply to all companies which hire more than five workers.
