Apple, Google in violation of law

The country’s telecommunications regulator announced yesterday that Apple and Google’s location tracking capabilities violate Korean laws, fining Apple Korea and ordering that both companies rectify the issues.

The Korea Communications Commission (KCC) has been investigating since April, after two computer engineers argued that the latest version of Apple’s mobile operating system, iOS 4.0, keeps track of users’ locations as far back as June 2010, which was when the operating system was launched. That caused controversy worldwide.

While the Korean government was hardly alone in launching an investigation into location tracking issues, it is the first in the world to actually declare that Apple and Google violated laws and order punitive measures.

The KCC said in a statement after a general meeting of committee members yesterday: “We decided to impose a 3 million won [$2,852] fine on Apple Korea for its collection of users’ locations without their consent. We ordered Apple Korea and Google Korea to correct their illegalities in storing users’ location data on their handsets without encryption.”

Laws violated

According to Location Information Law Article 15, when businesses seek to collect, utilize and offer people’s location data, they should get their consent. Furthermore, Location Information Law Article 16 dictates that businesses take protective technological measures to prevent the data from being exposed, falsified or damaged.

The KCC found that even when Apple iPhone users set location services “off,” the device still mapped the phone’s whereabouts. It also found that iPhones stored people’s location data in its cache, which is neither encrypted nor behind a firewall.

Google’s Android operating system wasn’t found to map the whereabouts of users without their consent, the KCC said, but it did save the data in its cache, thus only getting the rectification order.

The violation of Article 16 of the Location Information Law also empowers the government to shut down the business, KCC officials told reporters, but considering the inconvenience it would have caused Korean smartphone users, the government opted to simply order they rectify the issues.

The number of smartphone users in Korea surpassed 15 million as of last month, most of whom use either iPhones or Android phones.

A flood of complaints?

“We haven’t been tracking anyone,” Apple CEO Steve Jobs said earlier this year. “The files they found on these phones were basically files we have built through anonymous, crowd-sourced information that we collect from the tens of millions of iPhones out there.”

Google also explained that “all location sharing on Android is an opt-in by the user.” When a user activates an Android phone, a screen appears saying Google will collect anonymous location data.

Besides how Apple and Google will take the punishment, the key question is how the decision will affect ongoing lawsuits against Apple, as well as the future of location-based service (LBS) businesses.

In July, the Korean lawyer Kim Hyung-suk, an iPhone user, was granted 1 million won in the first court-ordered compensation from Apple Korea for “emotional distress” he suffered due to the company’s location tracking. As of Monday, more than 27,000 iPhone users in Korea had paid Kim’s law firm to join a class-action suit against Apple Korea.

In April, a group of Korean iPhone users filed a class-action lawsuit against Apple and Apple Korea over their collection of users’ location data, saying it violated the country’s Act on the Protection, Use, Etc., of Location Information and demanding a total of 23.2 million won in compensation. The ruling is pending.

LBS is considered a rising business, and not just in Korea. Research firm Gartner said the market for location-based services - currently worth $2.9 billion - will to rise to $8.3 billion in 2014.

한국 방송통신위원회가 3일 스마트폰 이용자의 위치정보 수집ㆍ저장으로 사생활침해 논란을 일으킨 애플과 구글에 대해 세계에서 처음으로 제재를 내린 데 대해 미국을 포함한 세계 통신업계와 언론들이 주목하고 있다.

이들이 한국 정부의 조치에 주목하는 것은 무엇보다 이번 조치가 이미 위치정보의 프라이버시 침해와 관련해 애플 등에 대해 조사를 벌이고 있는 미국과 프랑스 등 다른 국가들의 결정과 각종 소송 등에 영향을 미칠 수 있다는 판단에 따른 것으로 보인다.

지난 4월 영국의 연구원들에 의해 촉발된 애플과 구글 등의 위치정보 수집ㆍ저장에 따른 사생활침해 논란은 이번 한국 정부의 조치로 인해 전세계적으로 또한차례 파장을 낳을 것으로 전망되고 있다.

◇ 해외언론 주목…"韓정부 결정 향후 소송 등에 전례될 수도"

영국 일간 가디언 인터넷판은 이날 "애플의 입장에서는 과태료 300만원(미화 2천855달러 상당)은 '미 정부보다 많은 현금을 보유하고 있어' 문제가 되지는 않지만 향후 전례로 남을 수 있다는 것이 매우 우려되는 점"이라고 분석했다.

미국 IT전문매체인 씨넷은 "애플이 최근 한 변호사가 제기한 위치추적 관련 위자료 청구 소송에서 패소해 100만원의 위자료를 지급한 적이 있는데다 최근 아이폰 이용자 2만7천800명의 집단소송도 추진되고 있어 한국에서 갈수록 어려운 상황에 직면하고 있다"고 전했다.

IT전문매체인 지디넷도 이른바 '로케이션게이트(Locationgate)'로 알려진 위치추적 논란이 애플의 해명에도 불구하고 고객들의 분노와 미국을 포함한 전세계 정부의 조사, 미 상원 청문회 등을 야기했으며 이번 한국 정부의 조치로 더 심각한 상황으로 전개되고 있다고 전했다.

지디넷은 과태료 액수는 애플에 큰 의미가 없지만 이 같은 상황전개는 항상 다소 위험한 결과를 초래한다고 지적했다.

◇ 지난 4월 위치정보 수집문제 촉발…애플 등 해명에도 진화 안돼

이번 방통위 결정이 있기 전에도 애플과 구글, 페이스북 등 정보기술(IT)업체들의 위치추적에 따른 사생활침해 문제는 한국과 미국 뿐아니라 전세계에서 지속적으로 제기돼 왔다.

특히 이 문제는 지난 4월 영국의 전 프로그래머 2명이 미 실리콘밸리에서 열린 한 컨퍼런스에서 애플이 고객들의 동의를 받지 않은 채 위치정보를 수집하고 있다는 의혹을 공개하면서 글로벌 이슈로 점화됐다.

당시 애플은 의혹 제기 이후 한동안 침묵으로 일관했으나 논란이 가열되자 4월27일 문답형식으로 된 장문의 공식 해명자료를 내 "아이폰 위치추적을 해온 적이 없으며 앞으로 그럴 계획도 없다"고 주장했다.

애플은 "아이폰이 개인의 위치정보를 수집하는 것이 아니라 빠른 서비스를 위해 주변 와이파이망과 기지국의 정보를 수집하는 것일 뿐"이라며 "1년전 위치정보까지 저장되고 위치정보서비스를 꺼도(off) 지속적으로 정보를 수집하는 것은 버그(소프트웨어 결함) 때문"이라고 해명했다.

◇ 소송사태와 청문회, 유럽국가들 조사 등 논란 확산

그러나 이 같은 애플의 해명에도 미국을 포함한 전세계로 논란이 계속 확산되고 있다.

미국 플로리다와 뉴욕의 아이폰, 아이패드 사용자들은 의혹 제기 직후 애플을 상대로 위치정보수집을 금지해 달라는 소송을 냈으며, 미시간주 여성들은 구글을 상대로 유사한 내용의 집단소송을 제기한 상태다.

업계는 이들 소송의 진행 상황에 따라 미국 뿐 아니라 전세계 곳곳에서 애플 등에 대한 집단소송이 잇따를 수도 있을 것으로 전망했다.

미국 연방통신위원회(FCC)와 연방거래위원회(FTC)가 이 문제에 대해 조사 중이며 미국 이외에도 한국과 독일, 프랑스, 이탈리아, 대만 등이 애플에 진상규명을 요구했다.

이와 함께 독일과 이탈리아 정부는 진상규명 요구를 넘어 위치정보 저장이 자국의 사생활 보호 관련 법률에 저축되는지 등에 대해 직접 조사를 벌이고 있으며 프랑스도 이날 위치정보 이용자의 동의없이 이뤄지는 아이폰의 수집ㆍ저장기능에 대해 조사 중이라고 확인했다.

미국 의회도 애플과 구글 등 스마트폰 운영체계(OS) 개발업체 경영진을 잇따라 소환해 청문회를 하는 동시에 정치권 내부에서 온라인 프라이버시를 비롯해 모바일 기기에서 비롯되는 각종 문제를 규율하는 법령 제정의 필요성이 공론화되는 등 압박의 수위를 높이고 있다.

실제로 지난 5월 상원 상무위원회 위원장인 민주당 소속 제이 록펠러 의원은 기업이 소비자가 정보수집을 거부할 경우 이를 존중하도록 하는 '온라인 추적 금지(Do not track)법'을 발의했으며 존 케리(민주당) 의원과 존 매케인(공화당) 의원도 기업들이 개인 정보를 수집할 때 소비자의 동의를 받도록 하는 온라인 사생활법안을 제출한 상태다.
