The DP is not helping itself (KOR)

The ruling Democratic Party (DP) publicly criticized the lower court ruling on South Gyeongsang Gov. Kim Kyoung-soo Tuesday, claiming that the verdict immediately placing him behind bars violated the principles of the country’s criminal laws. It held a press conference with law professors arguing that the evidence to convict Kim had been lacking and they questioned the reliability of the testimony from Druking, the blogger Kim Dong-won and ringleader of an online rigging scheme in elections.

They insisted that the conviction of a sitting governor on circumstantial grounds and presumptions was against the charges and detention of former Supreme Court Chief Justice Yang Sung-tae. The DP went all-out to save the governor once dubbed as the strongest candidate to succeed President Moon Jae-in. DP head Lee Hae-chan urged the court to allow for Kim’s release on bail. Secretary-general Yoon Ho-joon called for public support to pressure the court. This kind of behavior cannot be accepted from the ruling party leadership.

The party is outright disregarding the judiciary’s decision. It is resorting to political mudslinging even as Kim had failed to retort evidence suggesting his collusion with Druking. Since there was no CCTV footage of Kim watching over the computer program automatically organizing posts in favor of Moon, prosecutors had to rely on the testimonies and text messages to prove their point.

The party’s interference undermines the law. The court can draw criticism for its rulings. But complaints must be resolved within the legal boundary. Our Constitution upholds the separation of three powers and law principles. The DP has been questioning the presiding judge since the appeals court bench was formed. If Kim does walk out, the court would come under fire for bowing to the ruling power. If it is so sure, the DP must instead concentrate on building up the defense for Kim to overturn the verdict in the appeals court.

The DP has been abusing its power to influence public opinion and the court. As soon as Kim was arrested, it joined with other civilian groups to hold a massive rally in Gwanghwamun, downtown Seoul, lambasting at individual judges. It has manifested itself as being entirely engrossed with its power with little respect to the public and national dignity. What will ordinary people think watching ruling party members hurling malicious attacks on the judiciary and its ruling? The DP must be aware that it is degrading itself.

김경수 판결을 저잣거리의 흥정 대상으로 삼을건가
더불어민주당 ‘사법농단 세력 및 적폐청산 대책위원회’가 어제 “김경수 경남도지사를 1심에서 법정구속한 것은 형사소송법의 대원칙을 망각한 판결”이라고 주장했다. 법과대학 교수 등 외부 전문가가 발제를 맡아 진행한 기자간담회였다. 참석자들은 김 지사의 유죄를 입증할 직접 증거가 부족하고, 드루킹 일당 진술의 신빙성이 낮다고 그 근거를 댔다. 재판부가 드루킹과 관련자들의 허위나 과장 진술을 과소 평가하고 김지사에게 “무죄 증명을 해보라”고 한 것은 증거재판주의와 검사 입증 책임의 원칙에 어긋난다는 설명도 곁들였다.
"정황 증거와 추론에 근거해 선거로 뽑힌 현직 지사에게 실형을 선고하고 법정 구속한 것은 양승태 전 대법원장을 따르는 적폐세력의 보복"이라는 게 이들의 일관된 논리다. 이날 행사와는 별도로 민주당은 “법원이 김 지사의 보석 신청을 받아줘야 한다”(이해찬 대표) “국민이 사법부를 압박해야 한다”(윤호중 사무총장)는 발언을 하며 ‘김경수 구하기’에 총력전을 펼쳤다. 민주당 지도부의 이같은 언행은 그 내용은 물론 형식에 있어서도 문제가 적지 않다.
먼저 사법부 판결에 대한 불복종이다. “김 지사 재판부가 궁예의 관심법(觀心法) 같은 심증판결을 내렸다”는 주장은 부박(浮薄)한 정치적 선동을 넘어서지 못하고 있다. 김 지사가 드루킹 김동원씨와 공모관계를 의심케 하는 각종 증거들에 대해 명확한 반론을 제시하지 못했기 때문이다. 김 지사가 댓글 조작 시스템인 킹크랩 시연회에 참석했던 장면이 찍힌 CCTV를 확보할 수 없는 상황에서 특검이 제시한 관련자들의 진술과 동선,이후 주고 받은 문자 메시지 등을 통해 어느 쪽이 더 신뢰할 수 있는가를 판단하는 건 전적으로 재판부의 몫이다.
둘째, 법과 제도의 안정성을 저해하는 행위가 될 수 있다. 법원의 판결도 비판의 대상이 될 수는 있다. 그러나 판결에 대한 불만은 법의 테두리에서 호소하고 풀어야 한다. 삼권 분립과 법치주의가 왜 민주주의의 기본 원칙으로 존재하겠는가. 민주당은 항소심 재판부가 배당되자 마자 주심 판사의 이력을 문제삼고,김 지사를 보석으로 풀어줘야 한다고 압박하고 있다. 만약 그가 보석으로 석방되면 사법부는 또 어떤 비판을 받을까. 민주당은 지금부터라도 조밀한 증거와 법논리로 항소심 재판에 대비하는 것이 순리다.
셋째, 군중의 세를 이용한 위력 과시의 부분이다. 김 지사가 법정구속된 지난달 30일 이후 집권당과 친여 성향의 시민단체들은 광화문 집회를 통해 사법부는 물론 판사 개개인들을 향해 비판을 넘어선 조롱과 멸시의 폭언을 쏟아부었다. 국정을 책임진 집권당으로서 정권만 걱정할 뿐 나라와 국민의 안위는 안중에도 없다는 비판을 받기에 충분했다. 일반 시민들이 판결에 불만을 품고 거리를 점거하면 민주당은 과연 뭐라고 말할 지 궁금할 뿐이다. 사법부의 판단과 결정을 법정이 아닌 저잣거리의 흥정 대상으로 전락시키고 싶은 게 민주당의 속내인가. 묻고 싶어하는 국민들이 늘고 있다.
