Law and order is collapsing (KOR)

The union of Hyundai Heavy Industries (HHI), which is affiliated with the militant Korean Confederation of Trade Unions (KCTU), went on a general strike on Monday after skipping the routine and statutory procedures on collective action.

The members clashed with employees at the headquarters of the company, and one employee could lose his eyesight due to a severe injury. The union has been illegally occupying a community center in Ulsan to prevent a shareholder’s meeting on Friday on HHI’s plan to merge with its biggest shipbuilding rival, Daewoo Shipbuilding & Marine Engineering (DSME).

They outright ignored a court injunction ordering the union to not interfere in the shareholder’s meeting. The law is being violated, but police are staying on the sidelines. The raid also interrupted the classes of a foreign school located in the community building.

The HHI union used force against the police last week. They clashed with police guarding the Seoul headquarters and over 30 officers were hurt. Two of them had their teeth broken. The police arrested 12 union members, but released 10. A court turned down detention warrants for the other two. Police officers were assaulted in broad daylight, but so far no one has been punished.

The union has resorted to violent collective action to protest the management’s plan to take over DSME. It argues the move darkens the company’s future and will cause job insecurity. Employees have the right to protest management decisions. But the way they protest must not go beyond legal bounds. The management says that no one from the two companies will lose their jobs after the merger. Yet the union refuses to believe management.

Illegal union activities have increased significantly under the liberal Moon Jae-in administration. Unions assaulted executives and repeatedly raided worksites. They even broke the walls of the National Assembly and pushed themselves into the Supreme Court courtroom. Police responded passively for fear of being punished. Unions have become fearless, but the government and ruling party are nowhere in sight.

'노조 무법천지' 어디까지 방치할 건가
현대중공업 노조(민주노총 산하)가 어제 파업에 돌입했다. 쟁의 발생 신고 등의 법적 절차는 밟지 않았다. 그제는 회사 본관 정문에서 직원들과 충돌했다. 그 과정에서 직원 한 명이 눈 주변을 크게 다쳤다. 회사 측에 따르면 실명에 이를 수도 있다고 한다. 노조는 이날 울산의 한마음회관이라는 건물을 불법으로 점거하기 시작했다. 31일에 열리는 주주총회를 막기 위해서다. 주주총회를 방해하지 못 하게 하는 결정을 법원이 내렸는데도 이들은 아랑곳하지 않았다. 법이 무시됐고, 법질서를 수호해야 할 경찰은 방관했다. 한마음회관 3층에는 외국인 학교가 있다. 학생들이 언제 다시 등교할 수 있을지 알 수 없다.
현대중공업 노조는 지난 22일에는 경찰에 폭력을 행사했다. 이 회사 서울 사무소 앞을 지키고 있던 경찰관을 때리거나 뒷목을 잡고 끌고 다녔다. 경찰관 30여 명이 다쳤다. 두 명은 이가 부러졌다. 경찰은 현장에서 12명을 체포했는데, 11명을 풀어주고 한 명에 대해서만 구속영장을 신청했다. 판사는 증거 인멸과 도주의 우려가 없다는 이유로 검찰의 영장 청구를 기각했다. 경찰관이 백주에 무차별 폭행을 당했는데도 결국 단 한 명도 구금되지 않았다. 우리가 과연 법치주의 국가에 살고 있는지 의심스럽다.
이 회사 노조가 집단행동을 벌이는 것은 경영진의 대우조선해양 인수와 현대중공업 법인 분리 결정 때문이다. 회사의 장래를 어둡게 하고 고용 불안 사태를 일으킬 것이라고 주장한다. 노조도 회사와 자신들의 이익을 위해 의견을 제시할 수 있다. 하지만 그것은 어디까지나 법 테두리 안에서 이뤄져야 한다. 회사 측은 인수ㆍ합병 과정에서 고용을 줄이는 일은 하지 않겠다고 약속했다. 고용을 축소하려는 움직임이 있지도 않다. 그런데도 파업에 나서는 것은 경영적 판단까지도 노조가 좌우하겠다는 것과 다르지 않다.
현 정부 출범 이후 노조의 불법 행위는 부쩍 늘었다. 회사 임원을 때리고, 사업장을 무단으로 점거하는 일이 비일비재하다. 국회 담장을 부수고, 대법원 법정에 진입해 구호를 외치기도 했다. 그래도 어지간해서는 잡혀가지 않는다. 경찰은 과잉진압이라고 고발되거나 징계를 당하느니 차라리 두들겨 맞는 게 낫다는 식의 태도를 보인다. 검찰ㆍ법원마저 범법 행위에 관대하니 노조는 더욱 기세등등이다. 이 무법천지의 악순환을 끊어야 할 책임을 진 정부와 여당은 도대체 어디로 숨었는가. 법을 어긴 쪽이 큰소리치고 맞은 사람이 숨죽이는 비정상을 언제까지 국민이 지켜봐야 하는가.
