A government nowhere to be seen (KOR)

May in Ulsan was a month of discord. It left wounds here and there. They are traces left by a union physically stopping a shareholders’ meeting on the division of Hyundai Heavy Industries on May 31.

As 5,000 union members tried to occupy the meeting hall, they clashed with company staff and 5,000 police. Yet the government was nowhere to be found. I could not understand the government’s actions, as it issued a statement after the union’s effort to stop the meeting failed and the division of the company was finished.

The Ministry of Trade, Industry and Energy, which oversees the shipbuilding industry, did not have a presence there. A ministry official said it was inappropriate for the ministry to express an opinion on an issue related to the management process of a private company. The Ministry of Employment and Labor was helpless. A source from the ministry’s Ulsan branch office said he visited the management and labor union of Hyundai Heavy Industries twice in May and advised the union to remove unlawful elements, as it lacked the procedure for labor disputes and going on strike could be illegal.

Under the union act, labor disputes are only allowed for the purpose of improving labor conditions or wages. The strike was technically illegal, as it intervened with management rights. Even when an illegal strike was expected, the ministry did nothing.

Deputy Prime Minister for the Economy and Finance Minister Hong Nam-ki said that a series of unlawful situations were undesirable, as the union made moves to oppose the shareholders’ meeting.

Labor Minister Lee Jae-gap’s attitude was the epitome of a laid-back government. On the day of the shareholders’ meeting, he attended a meeting with 15 heads of local employment and labor offices. In that meeting, he stressed that any acts of violence by the union were unjustifiable. He said the union needed to make demands within the boundaries of the law, and the ministry would work with related agencies on unlawful acts. While it was a warning against the Hyundai union’s illegal strike, it came two hours after the union was confronted by the police. The union occupied the meeting hall and clashed in the afternoon of May 26. That’s why Lee’s remark about strict action against the union was criticized: it was 96 hours late.

The approval of the division of Hyundai Heavy Industries is the first step toward the merger of Hyundai Heavy Industries and Daewoo Shipbuilding & Marine Engineering. There are obstacles ahead, yet as the first step has been made, the Korean people vividly saw the government’s relaxed reaction to the union’s violence.

노조-경찰 1만명 충돌한 '현대중 사태'…정부는 어디 있었나 오원석 기자
갈등으로 점철된 울산의 5월이 지났지만 상처는 곳곳에 남았다. 지난달 31일 현대중공업의 물적분할 안건이 오른 주주총회를 노동조합이 물리적 저지에 나서면서 남은 흔적이다.
주총장을 점거한 노조 조합원 5000여명에 회사 측 주총 진행 요원과 경찰 병력 5000여명이 충돌했지만 현장 어느 곳에서도 정부는 없었다. 정부는 노조의 주총 저지가 무위로 돌아가고 분할 안건이 통과된 직후에서야 기다렸다는 듯 입장을 내는 등 이해 못 할 대처로 일관했다.
조선산업을 책임지는 산업부는 존재감이 없었다. 산업통상자원부의 한 관계자가 “민간기업의 경영 의사결정과 관련한 부분이라 산업부에서 의견을 내는 것은 적절하지 않다고 생각된다”고 말했을 뿐이다. 고용부도 무력했다. 고용부 울산고용노동지청 관계자는 “5월 중순~하순 두 차례 현대중공업 노사를 각각 방문해 노조 측에 쟁의행위를 위한 절차가 갖춰져 있지 않아 파업을 강행할 경우 불법 소지가 있으니 불법요소를 없애고 진행할 것을 지도했다”고 말했다.
노조법상 쟁의행위는 임금·처우 개선 등 ‘근로조건 향상’ 목적으로만 허용된다. 이번 노조의 파업은 경영권 개입으로 사실상 불법이다. 불법 파업이 예고된 상황에서도 고용부는 지켜보기만 했다.
홍남기 부총리 겸 기획재정부 장관은 주총이 끝난 지난달 31일 오후 인천국제공항 입국장 면세점 개장식에서 기자들과 만나 “최근 며칠 노조가 주총을 반대하는 움직임이 있었는데 불법 상황이 이어지는 것은 바람직하지 않다”고 말했다.
이재갑 고용부 장관의 태도는 ‘뒷짐 정부’의 화룡점정이었다. 이 장관은 주총 당일 오후 15개 지방고용노동관서장이 참석한 회의에서 “노동조합의 폭력과 점거 등 행위는 어떤 이유로도 정당화될 수 없다”며 “법의 테두리 안에서 주장해야 하며 불법행위에 대해 관계기관 등과 협조해 조치할 것”이라고 말했다. 현대중공업 노조의 불법 쟁의행위에 대한 엄포였으나 이 장관의 발언은 노조-경찰의 대치가 끝나고 2시간이나 지나서야 나왔다. 노조가 주총장을 점거해 충돌을 일으킨 시점은 지난 27일 오후. 96시간이나 지나서야 나온 이 장관의 ‘엄정조치’에 비판이 쏟아지는 이유다.
현대중공업의 물적분할 안건 통과는 현대중공업-대우조선해양 기업결합의 첫 단추다. 앞으로 노조의 분할 안건 통과 원천무효 주장과 해외 기업결합 심사까지 가시밭길이 예고돼 있다. 하지만 그 첫 단추를 끼우는 과정에서 우리 국민이 목격한 건 제 손으로 입을 막은 답답한 정부의 모습뿐이었다.
