Court clears the path for Koreans abroad to vote

The Constitutional Court ruled yesterday that the Korean election law banning citizens residing abroad from voting is anti-constitutional and said it should be revised to make nearly 2.8 million Koreans living outside the country eligible to vote.

헌법재판소는 어제 해외거주 한국국민에게 투표권을 주지 않은 현행 선거법은 위헌이라며 2백80만 명에 이르는 재외국민에게 투표권을 부여하도록 선거법을 개정하라고 결정했다.

Politicians on all sides hailed the decision and called for immediate action so that overseas Koreans can participate in this year's presidential election. The Grand National Party is particularly excited about the ruling because Koreans living abroad are generally viewed as conservatives.

각계 정치인들이 이 결정을 환영했으며 올해 대통령 선거에 해외거주 한국국민들이 참여할 수 있도록 즉각적인 조치를 취하라고 요구했다. 특히 한나라당이 해외거주 한국국민들이 일반적으로 보수성향을 보여왔기 때문에 이 결정에 들떠 있다.

But it is unlikely that the ruling can affect this year's election. The National Election Commission said it would have to wait until the National Assembly revises the law before coming up with an absentee-voting system for citizens abroad.

그러나 이 결정이 올해 대통령선거에 영향을 줄 수 있을 것 같지는 않다. 중앙선거관리위원회는 국회가 먼저 선거법을 개정해야 재외국민을 위한 부재자투표 제도를 만들 수 있다고 말했다.

The court cautioned that rushing into a new absentee system could create legal confusion before the December presidential election and next year's general elections. It set a deadline of Dec. 31, 2008 for the revision.

헌재는 올해 12월 대통령선거와 내년 총선 이전에 성급하게 새 부재자투표 제도를 만들면 혼란을 초래할 것이라고 주의를 주면서 2008년 12월31일을 법개정 최종시한으로 정했다.

The decision was a response to a complaint filed by a group of 10 South Korean citizens living in foreign countries, including Canada, the United States and Japan. They demanded that millions of overseas Koreans be permitted to cast votes in presidential, general and provincial government elections.
헌재는 캐나다, 미국, 일본 등 외국에 거주하는 한국국민 10명이 제기한 헌법소원을 받아들여 이 결정을 내렸다. 그들은 수백만 명의 해외거주 한국국민들이 대통령·국회의원·지방 선거에서 투표할 수 있도록 허용돼야 한다고 요구했다.

Under the current system, when South Koreans achieve permanent residency abroad, their Korean resident registration is automatically revoked, thus banning them from voting in South Korean elections. The court saw that as unconstitutional.

현행 제도에서는 한국국민이 해외에서 영주권을 획득하면 자동으로 한국의 주민등록이 말소됐고 이에 따라 한국 선거에서 투표할 수 있는 권한이 사라졌다. 헌재는 이를 위헌으로 결정한 것이다.

"A resident registration system does not define the sovereign status of South Korean people. Hence, it cannot be a standard to qualify a person to vote," the court said. The verdict is a complete turn-around from the court's 1999 decision supporting the election law.

헌재는 “주민등록 제도가 한국국민으로서의 주권적 지위를 결정하지는 못한다. 그러므로, 주민등록이 투표권을 부여하는 자격기준이 될 수 없다.”고 말했다. 헌재의 이번 결정은 선거법을 합헌으로 판결했던 1999년 결정을 뒤집은 것이다.

"This election law was against the principle that all Koreans can vote after they pass a certain age," said Kim Jong-dae, the presiding judge, in affirming yesterday's ruling. "No law can be justified for limiting suffrage rights." Overseas Koreans welcomed the ruling. Kim Young-kun, the chairman of the Korean American Association of Washington, said, "All Koreans, wherever they live, should have voting rights."
김종대 주심 재판관은 “현행 선거법은 모든 한국국민은 일정한 나이가 되면 투표권을 가진다는 원칙에 위배된다. 참정권을 제한하는 법은 정당화될 수 없다.”고 말했다. 해외거주 한국인들은 이 결정을 환영했다. 워싱턴 한인회 김영근 회장은 “모든 한국국민들은 어느 곳에서 살든지 투표권을 가져야 한다”고 말했다.
