Missionaries fret about new passport restriction

Missionary activity by local church groups in the Middle East, which has been a headache for the government in the past, may face tight new regulations.

The Ministry of Foreign Affairs and Trade recently came up with a legal basis to limit the issuance of passports for those responsible for “damaging national prestige” overseas, according to ministry officials.

The draft regulation does not specify any religious group or activity, but the Christian community believes it is the target. They think Korea will declare being deported from a country for illegal missionary activity a disgrace.

“Last Thursday, we finished the process of informing the public of a decision to add an enforcement ordinance to the Passport Act,” said a ministry official.

Alarmed by the murder of Korean translator Kim Sun-il by an Islamic terrorist group in Iraq in 2004, the ministry has tried to come up with measures to limit Christian missionary activities in dangerous places, in particular the Middle East, where such activities are strongly regulated under local Islamic law. Twenty-three Koreans from a local church were kidnapped in Afghanistan in 2007, and two of them, including a pastor, were killed by the kidnappers.

The official said the ordinance will prevent someone judged to have damaged national prestige from having a passport issued for one to three years. The ordinance will be applied to cases reported by Korean embassies overseas.

Whether that person or group has damaged national prestige will be decided on a case-by-case basis by the ministry, the official said.

The ministry’s regulation reform committee will review the revision of the Passport Act, the official said. A review at the Prime Minister’s Office will be undertaken before the cabinet votes on it, he said.

Christian groups suspect the revision targets them.

“Nongovernment organizations or religious groups that are doing humanitarian work overseas on the basis of universal humanitarian values can be sometimes deported from the countries they were based in or be punished depending on the local authorities’ stance,” said the Korea World Missions Association, a major Protestant missionary group in Korea, in a statement. “[Under this regulation] they are not differentiated from general criminals.”

The ministry denied the change targets Christian missionaries.

The official said a regulation about issuance of passports to people who damage national prestige has existed since 1981, but it hasn’t been applied to a single case.

'중동 선교활동' 여권법 개정 논란

외교부 시행령 개정에 기독교계 반발

중동 이슬람 지역의 선교활동에 영향을 끼치는 여권법 개정작업을 둘러싸고 논란이 일고 있다.

외교통상부는 지난 10일 국외에서 위법행위를 저질러 한국의 국위를 손상시킨 경우 여권 발급을 1년 이상 제한하는 내용의 여권법 시행령(23조2항) 신설에 대한 입법예고를 마무리하고 규제개혁 심사절차에 착수했다.

이는 특정 단체나 활동을 적시하고 있지 않지만 최근 중동 이슬람국가에서 현지법 위반행위가 늘어나고 있는 일부 기독교단체의 선교활동에 직접적 영향을 줄 것으로 예상된다.

외교부 당국자는 15일 "이번 시행령 개정은 작년 1월부터 시행해온 외교부의 여권발급 제한 지침을 투명하게 법제화해 국민들에게 알려주는 차원"이라며 "특정종교나 활동을 겨냥한 것이 아니다"라고 말했다.

이 당국자는 이어 "국위손상 행위와 관련한 규제 사항을 담은 여권법 조항이 1981부터 있었지만 실제로 선교행위로 인해 추방을 당해 여권발급이 제한되는 사례는 한번도 없었다"고 덧붙였다.

이에 대해 기독교계 선교활동 단체인 사단법인 한국세계선교협의회(KWMA)는 "일반범죄자와 인류애적 활동을 구분하지 못해 선의의 피해자가 나올 가능성이 있다"고 비판하고 이번 시행령 개정이 해외선교 활동에 제약을 가하는 것이라며 반발하고 있다.

KWMA는 지난 11일 외교부에 보낸 공식서한에서 "법의 정신이라는 면에서 제기하고 싶은 것은 인류애에 의한 해외원조 구호활동이나 종교활동을 하다가 현지법을 적용해 추방조치를 당했을 때 그것을 범죄로 보는지, 인권문제로 보는지에 대한 문제"라고 밝혔다.

이어 "문제는 인류공영의 보편적인 가치관에 의해 일을 하는 NGO(비정부기구)나 종교활동을 하는 사람들도 그 나라의 입장에 의해 강제출국 처분을 받기도 하고 심지어 실형까지 받는 경우가 있다는 것"이라며 "이 경우 일반 범죄사범과 구별되지 않는다는데 문제가 있으며 만의 하나 선의의 피해를 당할 소지가 있다"고 지적했다.

이에 따라 앞으로 국무총리실 규제개혁위원회의 등의 심사과정에서 시행령 개정을 둘러싸고 외교부와 기독교계간에 논란이 가열될 것으로 예상된다.

한편 외교부가 외국에서 현지법 위반으로 자진 또는 강제 출국한 국민에게 해당국에서의 여권 사용을 선별적으로 제한하기 위해 추진해온 여권법 개정(17조2항 신설) 작업은 백지화됐다.
