Bonds defense: He didn’t know they were steroids

SAN FRANCISCO - Barry Bonds admits using steroids during his baseball career, his lawyer told a jury Tuesday. The catch is that Bonds’ personal trainer misled him into believing he was taking flax seed oil and arthritis cream.

“I know that doesn’t make a great story,’’ Allen Ruby said during his opening statement at the home run leader’s perjury trial. “But that’s what happened.’’

Assistant U.S. Attorney Matt Parrella called such claims “ridiculous and unbelievable’’ and portrayed Bonds as a liar during his first chance to present the government’s position.

And so the crux of the criminal case against Bonds was laid before an eight-woman and four-man jury as the testimony phase of the trial got under way. Bonds has pleaded not guilty to four charges of lying to a grand jury in 2003 when he denied knowingly taking steroids and one count of obstruction.

Parrella started the day by saying Bonds lied to the grand jury even though the government promised not to prosecute him for drug use if he testified truthfully.

“All he had to do was tell the truth,” Parrella said. “That’s all, but he couldn’t do it.’’

Parrella tried to show a deep connection between Bonds and the Bay Area Laboratory Co-Operative, known as BALCO, the Burlingame company at the center of an international sports doping ring that the grand jury was investigating. Five men, including BALCO’s founder Victor Conte and Bonds’ personal trainer Greg Anderson, pleaded guilty to steroids distribution after a 2003 government raid on BALCO.

Dressed in a dark suit with a light blue shirt, Bonds sat slouched in his chair, his long legs crossed at the ankles and poking out the other side of the defense table, as he watched Parrella tell jurors that a childhood friend of Bonds will discuss watching him inject steroids.

Parrella promised other witnesses will talk about conversations they had with Bonds regarding his steroid use, while others will discuss their deep suspicions.

Ruby, Bonds’ lead attorney, countered by trying to discredit some of the government witnesses scheduled to testify during a trial that is expected to last between two and four weeks.

He said at least two prosecution witnesses have axes to grind because of bitter fallouts with the man who hit 762 career home runs, a Major League Baseball record. He also holds the mark for home runs in a single season, with 73 in 2001.

But there is one crucial government witness who won’t testify at all - Anderson, who prosecutors allege supplied Bonds with steroids and detailed instructions on how to use them. Anderson was taken to jail Tuesday after he told U.S. District Judge Susan Illston he was refusing to testify against Bonds, who he grew up with in San Mateo County.

여유있는 본즈, 초조한 미국 정부…본즈 재판 마침내 시작

7년을 준비한 재판이 마침내 시작된다.

2003년 연방대배심 청문회에서 한 증언이 문제가 돼 기소된 메이저리그 홈런왕 배리 본즈 재판이 22일부터 시작되는 것이다.

본즈는 2003년 유명 운동 선수들에게 금지 약물인 스테로이드를 공급해 물의를 일으킨 발코 연구소 관련 연방대배심에 참가해 "알면서 금지약물을 사용한 적이 없다"고 말해 위증혐의로 기소됐다.

미국 정부는 본즈의 발언 이후 약 4년 동안의 조사를 거쳐 2007년 기소를 결정했고 당초 2009년 열리려던 재판은 한 차례 연기 끝에 이번에 드디어 막을 올리게 됐다.

미국은 물론 전세계 스포츠 팬들의 관심을 모으는 이번 재판에서는 미국 정부와 검찰이 본즈보다 더 큰 부담을 안고 있다.

이미 본즈는 여러 정황 증거로 인해 여론의 뭇매를 맞았고 홈런 등에서 그가 세운 기록은 스테로이드 힘을 빈 것으로 여겨지고 있다. 게다가 본즈는 유죄판결을 받아도 1개월 이상 징역형을 선고받지 않을 것으로 여겨지고 있으며 발코 스캔들 관련자들의 전례를 볼 때에도 실형을 살 가능성도 낮다.

반면 미국 검찰은 이 수사를 위해 무려 7년이라는 시간과 함께 많은 정부 예산을 썼다. 거기에 연방대배심을 두 번이나 열었다.

그렇게 공을 들이고 사회적 관심을 모은 재판에서 패할 경우 미국 정부는 국민의 세금을 헛되게 쓴 꼴이 되고 만다. 이미 일부에서는 과연 운동 선수 한 명의 거짓말을 증명하기 위해 그렇게 많은 시간과 돈, 인력을 낭비할 필요가 있느냐는 불만을 제기하기도 헸다.

또 이번 재판 결과는 본즈와 같은 혐의로 기소된 전 메이저리그 투수 로저 클레멘스나 다른 금지약물 관련 운동 선수들의 재판에도 영향을 미칠 것으로 보여 검찰로선 더욱 신경이 곤두설 수밖에 없다. 그야말로 벼랑 끝에 선 건 본즈가 아니라 미국 정부다.

그럼에도 불구하고 정부가 승리를 장담할 수는 없다. 결정적 증인이 될 수 있는 본즈 개인 트레이너 그레그 앤더슨은 여전히 증언을 거부하고 있다.

미국 검찰은 그의 아내와 장모에 대한 세금 조사를 실시하며 그를 압박했지만 앤더슨은 미동도 하지 않고 있다. 증언을 거부할 경우 앤더슨은 재판 기간 동안만 수감 생활을 하게 되며 재판은 한 달 안에 끝날 것으로 예상된다.

검찰은 그밖에 본즈의 옛 친구이자 동업자였던 스티브 호스킨스, 본즈의 옛 애인 킴벌리 벨 등을 증인으로 확보하고 있지만 이들 모두 본즈와 개인적인 원한을 갖고 있다.

본즈 용품을 판매한 호스킨스는 가짜 사인으로 용품을 팔았다가 본즈과 법정 다툼을 벌였고 벨은 본즈에게 버림받은 뒤 스테로이드 관련 사실 등을 폭로해 증인으로서 치명적인 흠을 갖고 있다.

과연 검찰이 어떻게 본즈의 유죄를 입증할 수 있을지 관심을 모은다.
