School chiefs oppose rules by ministry for discipline

The Ministry of Education, Science and Technology is sending out guidelines to schools nationwide on how to discipline students, offering alternatives to corporal punishment, such as suspending them or ordering them to do push-ups.

But four education offices run by liberal superintendents - Seoul, Gyeonggi, Gangwon and North Jeolla - said yesterday they won’t let their schools adopt the new guidelines.

The Education Ministry adopted the new guidelines on March 18, offering schools alternatives to corporal punishment. The ministry is sending out the guidelines before April, when most schools nationwide begin to review their school regulations.

The ministry said yesterday it will consider countermeasures if liberal superintendents interfere with schools adopting the new regulations.

“Opposing an enforcement ordinance cannot be seen as the rightful authority of an education superintendent,” an Education Ministry official said.

The ministry’s plan has drawn criticism from liberal education chiefs across the country, who argue that all forms of punishment should be abolished. They have suggested holding visits with parents, having students who misbehave volunteer and providing counseling as alternatives.

Others, however, have expressed concern over the teachers’ weakening authority to maintain discipline in the classroom.

In October 2010, the Seoul and Gyeonggi education offices abolished all kinds of corporal punishment. In November, the Gangwon education office followed suit.

‘간접체벌’ 시행령에 4개 교육청 거부

‘학생인권조례 취지 지켜야’ vs ‘상위법 무시’

일선 학교에 간접 체벌을 허용하는 초중등교육법 시행령이 최근 발효되면서 교육과학기술부와 일부 진보 교육감들 사이에 긴장감이 커지고 있다.

교과부는 전국 초ㆍ중ㆍ고교가 간접 체벌의 시행 여부를 정하게 해줄 예정이지만, 경기 등 4개 지역 교육감은 `모든 체벌을 금하는 학생인권 조례의 원칙과 어긋난다`며 이에 반발하고 있다.

특히 교과부는 교육감들이 간접 체벌 학칙의 도입을 막으면 이에 맞서 대응 방안을 검토하겠다는 입장이어서 학칙 개정이 많은 4월 이후 혼란과 진통이 심해질 것이라는 우려가 교육계에서 제기되고 있다.

교과부는 개정 시행령이 지난 18일 발효됨에 따라 `각 학교가 간접 체벌과 관련된 학칙 개정을 검토할 수 있게 지도해달라`는 공문을 이달 말까지 시도 교육청에 보낼 예정이라고 23일 밝혔다.

이 시행령의 31조 8항은 도구와 손 등을 통한 직접 체벌을 금했지만, `학칙으로 정하는 바에 따른 훈육ㆍ훈계`라는 구절을 통해 간접 체벌 권한을 각 학교에 보장했다.

그러나 경기와 서울, 강원, 전북 등 4개 지역 교육청은 `간접 체벌도 반(反)인권적`이라며 교과부의 방침을 사실상 거부키로 했다.

특히 이미 학생인권 조례를 제정한 경기도교육청은 학교가 간접체벌을 할 수 있게 학칙을 고치면 `조례 위반`으로 보고 행정ㆍ인사 제재를 할 방침이다.

경기도교육청의 조병래 대변인은 "비록 조례가 시행령보다 하위 법령이지만, `신체의 자유` 등 기본권을 보호하는 문제에는 예외가 인정된다는 것이 법학계의 상식"이라고 강조했다.

학생인권 조례를 추진 중인 서울ㆍ강원ㆍ전북 교육청은 교육감의 학칙 인가권을 통해 간접 체벌 도입을 억제할 예정이다.

진보 교육감이 이끄는 전남ㆍ광주 교육청은 이와 관련해 `여론 수렴과 추가 논의가 필요하다`며 결정을 유보한 상태다.

한편, 교과부는 지역 교육청이 간접 체벌 학칙을 저지하면 별도의 법적 구제방안을 검토할 예정이다.

교과부 관계자는 "학내 구성원이 간접 체벌의 필요성에 합의하면 자율성 원칙에 따라 해당 결정을 인정해야 한다. 시행령에 맞서는 것을 교육감의 정당한 권한으로 볼 수 없다"고 강조했다.

교과부는 앞서 2008년 11월 `학교의 자율권을 강화한다`며 교육감의 학칙 인가권을 폐지하는 초중등교육법 개정안을 국회에 냈으나, 이 안은 현재까지 계류 상태다.

간접 체벌은 `체벌을 전면 금지하면 학생 지도가 어려워진다`는 지적에 따라 나온 대안으로, 교과부는 이번달 내로 해당 조치의 범위와 주의 사항 등을 설명한 지침서를 일선 학교에 배포할 예정이다.

대다수 진보 교육감들은 직ㆍ간접 체벌과 폭언, 위협이 모두 `학생에 대한 폭력`이라며 반대하고, 학부모 면담과 봉사, 성찰교실 등을 체벌의 대안으로 제시한다.
