A kick in the teeth for hip-hop singer

A Seoul court on Monday sentenced popular hip-hop singer MC Mong to six months in jail on charges of deliberately delaying military enlistment on false grounds but suspended the sentence for one year.

However, the Seoul Central District Court cleared the 32-year-old singer and TV entertainer, whose real name is Shin Dong-hyun, of a charge that he intentionally pulled out his healthy teeth to get an exemption from military duty.

Shin was indicted last October for extracting three healthy teeth between 2004 and 2006 to allegedly avoid military service. He was also charged with postponing enlistment on various grounds such as preparations for civil service exams and overseas trips for performances.

Shin first tested fit for military service in 1998 but was declared ineligible in a second qualification checkup in 2007, which found him with defective tooth functions.

A court statement said, “It is difficult to acknowledge that [MC Mong] intentionally pulled out his teeth to avoid military service,” and the extraction of teeth was “apparently made on his dentist’s recommendation .”

The court said, however, that Shin “disrupted the administrative work of military affairs by deliberately delaying enlistment several times.” It decided to suspend the sentence rather than send Shin directly to jail because he recognized his wrongdoings.

It wasn’t immediately clear whether Shin would appeal. After the ruling, Shin told reporters that he was “sorry” and will express his stance later.

Shin will be forced to carry out military service unless he wins a potential appeal by 2014.

병역기피 혐의로 기소된 가수 MC몽(32·본명 신동현)에게 징역 6월에 집행유예 1년, 사회봉사 120시간이 선고됐다. 생니를 뽑아 병역을 면제받은 혐의(병역법 위반)에 대해선 무죄가 선고돼 이 판결이 확정될 경우 MC몽은 군대를 가지 않아도 된다.

　서울중앙지법 형사5단독 임성철 판사는 11일 7급 공무원 시험 응시 준비를 이유로 109일 입영을 연기하는 등 불법으로 군 입대를 연기한 혐의에 대해 유죄를 선고했다. 그는 “피고인이 공무원이 될 의사가 없었고 본인의 입영이 수차례 연기된 사실도 알고 있었다”고 말했다.

　임 판사는 이어 “피고인은 임플란트 시술을 받지 않은 것이 치과에 대한 공포와 경제적 어려움, 바쁜 일정 때문이라고 주장하지만 병역을 면제받기 위한 것이 아니었나 하는 의심이 든다”고 말했다. 그러나 임 판사는 “피고인이 35번 치아를 뽑기 전에도 이미 치아 상태가 병역 면제에 해당됐다는 치과 의사의 증언 등으로 볼 때 이를 단정하기 어렵다”고 했다.

　앞서 MC몽은 앞니 한 개와 상·하·좌·우 어금니 등을 포함해 모두 11개의 치아가 없는 것으로 재판 과정에서 확인됐다. 이 중 혐의 대상이 된 것은 2006년 12월 뽑은 왼쪽 아래 작은 어금니(35번 치아) 한 개뿐이다. 나머지 치아는 2004년 이전에 뽑아 공소시효(5년)가 지났다.

이날 MC몽은 검은 옷을 입고 법정에 출석했다. 그는 선고가 진행된 40여 분 내내 두 손을 꼭 맞잡고 있었다. 판결 선고 후 눈물을 계속 흘리던 MC몽은 “죄송하다. 기자회견을 통해 입장을 밝히겠다”는 말과 함께 황급히 법원을 빠져나갔다.
