Revised law puts rules on former civil servants

Judges and prosecutors who retire from public service to become lawyers in the private sector will be unable to work on cases in the region where they retired from public service for one year after their retirement.

The cabinet, in a meeting presided over by Prime Minister Kim Hwang-sik, approved a revision bill enabling the regulation yesterday. The bill, passed by the National Assembly on April 29, will be enacted within 15 days.

Under the bill, lawyers who previously worked as judges, prosecutors and legal officials in the military will be banned from taking cases involving the court, prosecutors’ office and military court where they worked for one year after their retirement.

The regulation will also be applied to lawyers who worked for such public organizations as the Financial Services Commission, Fair Trade Commission and police stations.

The revision was drafted to address the criticism that the government has allowed legal practices to be compromised by allowing former judges or prosecutors to take advantage of their influence over former colleagues and gain favor in the cases they assume as lawyers.

Such practices were so rampant that many local law firms have competed to hire high-ranking judges or prosecutors.

In Korea, people who pass the national bar exam and go through a two-year training program can become a judge or prosecutor, though the process is quite rigorous. After they retire, many judges and prosecutors become lawyers in the private sector.

A government official, speaking on condition of anonymity, said that the reason the revision was passed was to “increase trust within the public sector and guarantee fairness and objectivity in public legal affairs.”

대법원과 법무부는 개정변호사법의 시행 전까지 판검사들이 낸 사표를 수리하지 않을 방침이라고 11일 밝혔다. 이날 김황식 국무총리 주재로 열린 국무회의에서 판검사 등이 변호사 개업을 할 경우 퇴직 전 1년간 근무했던 지역의 사건을 1년 동안 맡을 수 없도록 한 변호사법 개정 공포안이 통과된 데 따른 것이다. 대법원 관계자는 “법원에 대한 국민 신뢰 제고를 위해 최근 접수된 사표를 법 시행 이전에 수리할 수 없다는 게 이용훈 대법원장의 뜻”이라고 전했다. 법무부 관계자도 “개정안의 국회 통과 단계 때부터 사표 수리 여부를 놓고 내부 토론을 벌였다”며 “입법 취지를 고려할 때 법 시행 후 사표를 수리하는 게 바람직하다는 쪽으로 의견이 모아졌다”고 말했다. 이 법은 이명박 대통령이 공포하는 즉시 시행된다.
