Double standard seen in treatment of rape case

A temporary worker at the Anti-Corruption and Civil Rights Commission attends a company dinner and later accompanies one of the commission’s officials, her boss, to a motel. The woman is drunk, the boss allegedly rapes her, and then he checks out of the motel.

Sometime later, a motel worker discovers the unconscious woman in the room and allegedly rapes her too.

The following day, the woman reports the rapes to the Songpa Police. The Seoul Eastern District court approves a warrant requested by prosecutors to arrest the motel worker.

But it rejects a similar request to arrest the Civil Rights Commission official.

That double standard has angered the prosecutors, the victim, and set off a firestorm of protest on Internet bulletin boards.

According to prosecutors in charge of the case, the rapes took place on May 3 at a motel in Gangdong District. The Civil Rights Commission official is 55 years old and surnamed Park, they said, and the motel worker has been identified by the surname Kwon. Prosecutors said their sexual acts with the contract worker, who is 44-years old, constitutes rape because she was drunk and unconscious and couldn’t resist.

After the woman reported the rapes to the police, they obtained DNA from the two men. After examining CCTV footage of the motel, police narrowed down suspects to Park and Kwon.

Kwon, 31, confessed to raping the woman during questioning by police, prosecutors said. His was the first arrest warrant requested, and it was issued on Sunday.

According to officials at the Seoul Eastern District Court, Judge Yoon Jong-guk, who reviewed requests for the warrants, rejected that for the Civil Rights Commission official because the chances were slim that he would flee or destroy evidence.

The judge even rejected prosecutors’ worries that the official could threaten the victim, who worked for him. The judge said that wasn’t an issue because the official was dismissed earlier this month after the alleged rape was reported to Anti-Corruption and Civil Rights Commission Chairman Kim Young-ran, who was the first female Supreme Court justice.

In a meeting yesterday, Kim ordered the anti-corruption agency to tighten discipline among its senior-ranking officials and immediately started ethics education for them. She also said her number one priority was to protect the victim and help her get back to work.

같은 날, 같은 장소에서 한 여성을 차례로 성폭행한 두 남성의 구속 여부에 대해 법원이 엇갈린 판단을 내려 논란이 되고 있다.

 서울동부지법 윤종구 판사는 11일 술에 취한 동료 여직원을 성폭행한 혐의(강간치상)로 국민권익위원회 4급 간부 박모(55)씨에 대해 청구된 구속영장을 기각했다. 같은 법원은 지난 8일 역시 해당 여성을 성폭행한 혐의(준강간)로 모텔 종업원 권모(31)씨에 대해 청구된 구속영장을 발부했었다.

 경찰과 검찰에 따르면 박씨는 지난 3일 오후 9시40분쯤 강동구의 한 술집에서 A씨와 함께 술을 마신 뒤 만취한 A씨를 한 모텔로 데려가 강제로 성관계를 맺은 혐의를 받고 있다.

경찰 조사 결과 박씨는 정신을 잃고 쓰러진 A씨를 모텔 방에 둔 채 귀가한 것으로 조사됐다. 모텔 종업원 권씨는 A씨 혼자 남아 있는 방에 몰래 들어가 A씨를 성폭행한 혐의다.

 이튿날 성폭행 사실을 알게 된 A씨는 송파경찰서에 수사를 의뢰했고, 병원 검진 결과 A씨의 몸에서 두 사람의 DNA가 검출됐다.

경찰은 병원의 DNA 분석자료와 세 사람의 진술, 모텔 CCTV 자료 등을 토대로 수사를 벌였다. 검찰은 범죄 사실을 자백한 권씨에 대한 구속영장을 먼저 청구했고 법원은 8일 영장을 발부했다.

 경찰은 박씨에 대해서도 9일 구속영장을 신청했고 검찰은 이를 검토한 뒤 같은 날 법원에 영장을 청구했다. 그러나 법원은 11일 박씨를 불러 영장실질심사를 한 뒤 “도주 및 증거 인멸의 우려가 없다”는 이유로 영장을 기각했다.

 이날 영장을 심사한 윤 판사는 “두 사람의 구속 여부 판단은 질적으로 다르다”고 말한 것으로 전해졌다. “모텔 종업원은 손님에 대한 일종의 보호의무가 있기 때문에 더 비난받을 여지가 있다”는 것이다.

법원 관계자는 “피의자가 자백을 하고 있다는 점, 피해자와 합의하기 위해 최선을 다하겠다고 다짐하고 있는 점을 고려한 결정으로 보인다”고 말했다. 그는 이어 “두 사람이 음주 후 함께 여관에 가게 된 경위와 여관에 머물렀던 시간, 피해자가 입은 상해의 정도 등에 비추어 볼 때 법리적으로 강간치상에 해당하는지 여부를 검토할 필요가 있다”고 전했다.

 경찰은 당초 박씨에 대한 구속영장에서 “피의자가 피해자에게 위해를 가하거나 증거를 인멸할 우려가 있다”는 의견을 제시한 것으로 알려졌다.

이에 대해 법원은 “피의자가 이미 직위해제된 상태여서 지위를 이용해 위해를 가할 우려가 없다”는 입장을 밝혔다. 권익위는 이날 서기관급 간부로 일하는 박씨가 이달 초 직위해제됐으며 수사 결과에 따라 중앙징계위원회에 중징계를 요청할 방침이라고 밝혔다.

 검찰은 “경찰에서 사건을 송치받은 뒤 추가 조사를 벌일 계획”이라는 입장이다. 검찰 관계자는 “술에 취한 A씨를 모텔로 데려간 뒤 혼자 귀가함으로써 위험한 상황에 놓이게 했던 박씨를 불구속한다는 것은 이해하기 어렵다”고 말했다.
