Samho pirates go on trial this month

BUSAN - The Somali pirates charged with hijacking the Samho Jewerly freighter in January and shooting Capt. Seok Hae-gyun during the rescue operation six days later will stand trial in Busan District Court from May 23-27.

According to Busan District Court’s trial schedule released Tuesday, a nine-member jury will participate in a five-day-long trial, along with two English and two Somali interpreters. The jury will suggest a verdict and sentence, but the judge is not required to accept either.

Four of the five detained pirates will be tried at the trial. The fifth, Abdullah Hussein Mahamud, 20, has pleaded guilty to all charges and will be tried separately on June 1.

He will answer questions in court on May 24 along with the other four Somalis: Abdullah Ali, 23, Arai Mahomed, 23, Ali Abukad-Aeman, 21, and Brallat Aul, 18.

On the first day of the five-day trial, the court will appoint the nine jurors, allow the press to photograph the defendants (except for the underage Brallat Aul) and take statements from the defendants.

On the second day, the judge will question witnesses.

Testimony from the still recuperating Seok, which was taken in Ajou University Hospital on May 9, will be read to the court on the third day. Lee Guk-jong, the doctor who saved Seok’s life in Oman, will also testify that day.

Arai Mahomed, who is accused of attempted murder for allegedly shooting Seok during the rescue operation, will be tried on that charge on the fourth day.

The prosecutor and defense will give their summations on the fifth and final day of the trial. The jury will then retire to deliberate and give the judge their verdict and proposed sentences. The judge will announce the final verdict and sentence at around 5:30 p.m. on May 27.

Busan District Court said it will strengthen security for the trial, using about 100 policemen to surround the court, to prevent any terrorist attacks on behalf of the Somalis.

국내 첫 해적 재판에 경찰 1개 중대 출동

삼호주얼리호를 납치했다가 우리 군에 생포된 소말리아 해적들에 대한 재판이 다음 주 부산지법에서 5일간 열린다. 국내 사법 사상 처음 열리는 해적 재판이 어떻게 진행되는지에 대한 국내외의 관심이 커지고 있다.

　18일 부산지법이 밝힌 재판 계획에 따르면 해적 5명 가운데 국민참여재판을 거부한 압둘라 후세인 마하무드를 제외한 4명의 재판은 23일부터 27일까지 부산지법 대법정인 301호에서 열린다. 형사합의5부(김진석 부장판사) 심리로 국민참여재판을 받고, 선고까지 받게 된다.

마하무드는 24일 오후 증인신문에만 참여하고, 다음 달 1일 혼자 일반재판에서 선고받는다. 마하무드는 공소사실을 모두 인정하고 있어 국민참여재판에서 실익을 기대할 수 없다는 판단에서 일반재판을 신청했다.

　국민참여재판 첫날인 23일은 오전 9시30분부터 비공개로 배심원 선정작업이 이뤄진다. 배심원단은 5일간 모두 출석할 수 있는 부산시민 9명과 3명의 예비 배심원으로 구성했다.

재판부는 신속한 재판을 위해 에티오피아나 지부티 주재 한국대사관 직원 1명을 소말리아어 통역인으로 추가 선임해 통역인을 영어담당 2명과 소말리아어 담당 2명으로 늘렸다.

　오전 11시10분부터 열리는 공판에는 재판부와 배심원단, 검사가 먼저 법정에 들어서고, 이어 피고인 4명이 뒤를 따른다. 이 장면은 이례적으로 언론사에 촬영을 허용한다. 다만 만 19세가 안 돼 소년으로 분류되는 아울 브랄라트(18세11개월)의 얼굴은 노출되지 않도록 해야 한다.

이어 배심원의 선서와 재판장이 피고인을 확인하는 인정신문, 검사가 공소사실을 밝히는 모두 진술, 피고인들의 모두 진술 순으로 진행된다. 24일에는 삼호주얼리호 선원 4명에 대한 증인 신문과 마하무드의 증인신문이 이뤄진다.

　25일에는 피고인과 삼호주얼리호 석해균(58) 선장의 주치의인 이국종 아주대병원 교수에 대한 증인신문이 있고, 지난 9일 아주대병원에서 진행된 선 선장에 대한 증인신문 내용을 배심원단에게 알려주는 절차가 진행된다.

26일에는 증거조사와 증거에 대한 변호인 의견제시가 있은 후 석 선장에게 총을 난사해 살해하려 한 혐의를 받는 마호메드 아라이에 대한 신문이 예정돼 있다.

　마지막 날인 27일에는 검사와 변호인의 최종 변론과 피고인들의 최후진술이 이뤄지고, 배심원단의 비공개 평의를 거쳐 오후 5시30분쯤 선고될 예정이다.

　부산지법은 해적재판을 앞두고 보안을 강화한다. 국내외의 관심이 쏠려 있는 데다 오사마 빈 라덴이 사살된 후 보복 테러에 대한 우려가 있어 이슬람교도인 해적에 대한 재판을 진행해야 하기 때문이다.

　부산지법은 재판이 열리는 동안 청사 입구와 재판정인 301호 법정 앞에 별도의 검색대를 설치해 일반 방청객은 물론 취재진의 소지품도 철저히 검사할 계획이다. 일반 방청객 수도 45명으로 제한해 매일 오전과 오후 한 차례씩 선착순으로 방청권을 배부하고, 신분증을 맡기도록 했다. 방청권은 매일 색깔을 달리해 개인별 출입 여부를 일일이 확인할 방침이다.

　재판이 열리는 기간에 경찰 1개 중대 병력을 청사 주위에 배치해 만일의 사태에 대비하기로 했다. 이번 해적재판에는 알자지라 방송 등 국내외 언론이 취재신청을 한 상태다.
