Lawmaker convicted of insulting anchorwomen

A Seoul court yesterday convicted Representative Kang Yong-seok for insulting anchorwomen and falsely accusing a reporter over a story related to his lewd remarks, handing down a suspended prison term.

The Seoul Western District Court ruled yesterday against Kang for insulting anchor women by making sexually inappropriate remarks about them at a dinner with students. Judge Jegal Chang handed down a six-month prison term to Kang, but suspended it with a one year probation.

If the punishment is upheld at the higher courts, Kang will lose his lawmaker post. Kang’s lawyer said he will appeal the ruling.

“The defendant is an incumbent lawmaker and it should be taken into account that his remarks will have a greater impact,” Jegal said.

In an exclusive report last July, the JoongAng Ilbo reported that Kang made salacious remarks at a dinner with about 20 university students, about half of them female. The report said Kang told a female student who aspired to be a broadcasting anchor that she’d have to “go all the way” to succeed.

Denying that he had made such remarks, Kang filed a defamation suit against the newspaper and the reporter. The JoongAng Ilbo and the reporter countered the 41-year-old first-term lawmaker with a defamation suit.

Although the two sides dropped the suits last month, the prosecution still indicted Kang on charges of falsely accusing the reporter by claiming the article was a fabrication.

“When an individual is attacked about his remarks, he may defend himself by denying it, but what Kang did was beyond self-defense,” the judge said. “Kang made the false accusation that the reporter fabricated his remarks and that cannot be justified.”

The judge also said anchorwomen have to face the public frequently, and there is more than enough possibility that the public will be reminded of Kang’s remarks.

The judge said he had shown some leniency because the article stressed Kang’s lewd remarks too strongly, and that the lawmaker had faced harsher criticism than he would have otherwise.

Kang, who represents Mapo B District, was kicked out of the Grand National Party last September for a breach of ethics. The National Assembly’s special committee on ethics will vote on a proposal to expel Kang from the legislature on Monday. The disciplinary subcommittee of the ethics committee already voted that Kang should be punished with expulsion.

서울서부지법 형사3단독 제갈창 판사는 성희롱 발언으로 아나운서를 모욕하고 이 같은 사실을 보도한 기자를 오히려 고소한 혐의로 기소된 강용석(42·무소속) 의원에게 25일 징역 6월에 집행유예 1년을 선고했다. 금고형 이상의 범죄에 대해 공무원직을 박탈하는 국가공무원법에 따라 강 의원은 이 형이 확정되면 의원직을 잃게 된다. 또 변호사인 강 의원은 변호사법에 따라 집행유예 기간(1년)에 2년을 더해 총 3년간 변호사 자격이 정지될 수도 있다.

 제갈 판사는 “이 사건의 쟁점은 피고인 강용석이 중앙일보에 보도된 발언을 했는지 여부인데 피고인이 그 같은 발언을 한 것은 명백하다”고 밝혔다. 강 의원은 지난해 7월 국회의장배 토론대회를 마친 뒤 대학생들과의 저녁자리에서 ‘다 줄 생각을 해야 하는데 그래도 아나운서 할래? ○○여대 이상은 자존심 때문에 그렇게 못하더라’고 말하는 등 아나운서 직업군을 모욕한 혐의 등으로 불구속 기소됐다.

 제갈 판사는 “아나운서들은 방송을 통해 대중 앞에 서기 때문에 사회 일반인들이 피고인의 발언을 전해 듣고 아나운서를 (이상하게) 연상할 소지가 충분하다”고 덧붙였다. 강 의원이 여자 대학생들 앞에서 한 발언이 여성 아나운서들에 대한 사회적 평가에 영향을 미쳐 모욕죄에 해당한다는 것이다. 이번 판결은 개인이 아닌 특정 직업군을 지칭했더라도 집단에 대한 모욕죄를 적용할 수 있다고 인정한 첫 사례다.

 강 의원이 자신의 발언을 보도한 본지 기자를 고소한 것에 대해서는 “경위를 해명하거나 발언 사실을 부인할 수는 있지만 ‘기자가 허위보도를 했다’며 무고죄로 고소까지 한 것은 정당화될 수 없다”며 유죄로 판단했다. 강 의원은 지난해 ‘허위 기사를 써서 명예를 훼손했다’며 본지 기자를 검찰에 고소했다.


 이로써 강 의원은 성희롱 발언(모욕)과 사실을 보도한 기자를 오히려 고소한 혐의(무고) 모두에 대해 유죄를 선고받았다.

 한편 국회 윤리심사자문위원회는 지난달 강 의원에 대해 ‘의원직 제명’ 의견을 냈고, 국회 윤리특별위원회 징계심사소위원회는 지난 6일 이를 의결했다. 윤리특위는 30일 전체 회의를 열어 징계안을 처리할 예정이다.
