Pirate appeals ruling of attempted murder

The Somali pirate who was sentenced last week to life in prison for shooting the Korean captain of the hijacked Samho Jewelry in January is challenging the court decision, his lawyers said yesterday. The lawyers for Arai Mahomed, 23, said they filed the appeal on Tuesday.

“The charge that Arai shot captain Seok lacks evidence and we can’t agree with the ruling that he used the sailors as human shields,” said Kwon Hyeok-geun, one of the lawyers.

The lawyers said they also lodged an appeal over the sentencing of Brallat Aul to 15 years in prison.

The Busan District Court last Friday sentenced Mahomed to life in prison for attempting to kill Seok Hae-kyun as well as all other counts, including using the ship’s crew as human shields.

Aul and two other pirates, Abdullah Ali and Ali Abukad-Aeman were found guilty of the seven counts, except attempted murder, and were given 15 years, 13 years and 13 years, respectively.

The four pirates were arrested on Jan. 21 during the Korean Navy’s rescue of the 21-member Busan-based ship and were brought to Korea to stand trial.

Prosecutors said they would appeal the rulings that acquitted the three other pirates on the count of attempted murder. They said they were also considering appealing the Mahomed ruling. They sought the death penalty for Mahomed and life sentences for the other three.

Meanwhile, the fifth pirate, Abdullah Hussein Mahamud, who had pled guilty to all charges, was sentenced yesterday to 15 years.

해적 아라이 등 항소…법정공방 2라운드 예고

검찰도 2일 항소방침…아라이에 대해서는 고민

삼호주얼리호 석해균 선장에게 총격을 가한 혐의 등으로 무기징역을 선고받은 소말리아 해적 마호메드 아라이(23)와 징역 15년을 선고받은 아울 브랄랫(18)이 지난 31일 항소장을 제출했다고 담당 변호인이 1일 밝혔다.

이들 외에도 각각 징역 13년을 선고받은 압디하드 아만 알리(21)와 압둘라 알리(23)도 항소할 것으로 알려졌다.

검찰도 브랄랫과 2명의 알리에 대해 항소하기로 한 가운데 2일까지 아라이에 대해서도 항소할지 결정할 방침이어서 법정공방 2라운드를 예고했다.

아라이를 변호한 권혁근 변호사는 "아라이가 석 선장에게 총격을 가했다는 혐의는 증거가 불충분한데도 유죄판결이 났고, 선원들을 `인간방패`로 내세웠다는 판결에도 동의할 수 없어 아라이를 접견한 뒤 항소장을 제출했다"고 말했다.

부산지검 관계자는 "아라이를 제외한 나머지 해적 3명은 석 선장을 살해하려 한 혐의의 공동정범으로 처벌받아야 하는데도 1심에서 무죄판결을 받았기 때문에 상급심의 판단을 받아야 한다"면서 "공소사실이 모두 인정된 아라이에 대해서는 항소여부를 고민하고 있다"고 밝혔다.

한편 국민참여재판을 거부한 압둘라 후세인 마하무드는 1일 부산지법 형사합의5부(김진석 부장판사)의 심리로 일반 재판을 받은 뒤 오후 선고까지 받을 예정이다.
