Intense debate on prosecutor law reform

The war of nerves between the prosecution and police intensified yesterday with a National Assembly committee scheduled today to finalize details to revise a law that would free police from the prosecution’s supervision in criminal investigations.

More than 150 junior prosecutors at the Seoul Central District Prosecutors’ Office convened yesterday at 3:30 p.m. for a closed-door meeting to discuss the reform measures opposed by prosecutors.

Sources told the JoongAng Ilbo that junior prosecutors who participated in the meeting agreed they are fully against revising the law because it would take away the prosecution’s rights to supervise the police’s criminal investigation.

While junior prosecutors planned to make an announcement regarding the results of the meeting, the meeting continued until late last night, making the press unable to add updates about the meeting.

The details of reform plan will be submitted to the National Assembly’s Legislation and Judiciary Committee today after senior-ranking prosecutors and police officials negotiated the middle ground over revising the law at 8 p.m. last night. The assembly’s committee members will review the plan and aims to finalize details by today.

While Prime Minister Kim Hwang-sik invited National Police Agency Commissioner Cho Hyun-oh and Justice Minister Lee Kwi-nam on Friday to narrow differences and suggested a compromise, neither side made a clear position on whether they support it.

Lee was quoted as saying by sources on Friday that “it won’t be easy to persuade the prosecution to accept the compromise.”

Among the suggestions proposed by Kim are revising a current law that allows prosecutors to supervise the police’s criminal investigation and allow police to start a probe without the prosecution’s approval.

The idea of adjusting the authority of investigation rights in criminal cases between the prosecution and police isn’t new. The two sides have battled over investigative rights for years.

Police originally pushed for expansion of their investigation rights more 10 years ago, but their attempt failed when they lost momentum and lost the public trust after prosecutors uncovered a series of corruption cases involving police officials.

The current law defines the prosecution as the main investigative body and supervisors of the police.

(서울=연합뉴스) 김화영 기자 = 국회 사법제도개혁특별위가 검찰과 경찰이 첨예하게 대립 중인 수사권 조정 문제를 결론짓기 위해 20일 오후 전체회의에서 최종 타결을 시도한다.

사개특위는 지난 3월 산하 `6인소위`의 합의안대로 검사의 수사지휘권을 인정하되 수사 현실을 반영, 경찰에 수사개시권을 부여하는 내용으로 형사소송법 개정안을 마련할 방침이나 두 기관이 세부 사항에서 반발하고 있어 난항이 예상된다.

양측이 이날 회의에서 접점을 못찾고 오는 22일 전체회의에서도 극적 돌파구를 마련하지 못한다면 수사권 조정을 위한 6월 입법은 사실상 무산될 것으로 보인다.

국무총리실이 전날에 이어 이날 오전에도 검ㆍ경의 의결절충을 위해 중재에 나설 계획이나 입장차가 커 합의안을 이날 중 사개특위로 넘길 수 있을 지 불투명하다.

총리실의 중재안이 또 불발될 경우, 사개특위는 현재 특위에 제출된 한나라당안과 민주당안 등 2개안을 절충해 결론을 내린다는 방침이어서 검ㆍ경이 이날 전체회의에서 불가피하게 재격돌할 것으로 보인다.

검찰은 `사법경찰관은 검사의 지휘를 받아 수사해야 한다`는 현행 형사소송법 196조1항을 건드리지 않고 경찰의 수사개시권만 196조의 다른 조항에 명문화하자는 입장이다.

그러나 경찰은 196조1항 가운데 `검사의 지휘를 받아..`라는 부분을 삭제하거나, 이 조항을 존치시키더라도 196조가 아닌 195조 등으로 옮기자는 주장이다. 검찰은 경찰이 독립적 수사권을 갖겠다는 의도라며 이에 반발하고 있다.

경찰은 또 수사개시권 뿐 아니라 진행권까지 갖는 게 현실에 부합한다는 논리를 펴고 있으나 검찰은 수용할 수 없다고 맞서고 있다.

전날 총리실에서는 경찰의 수사개시권을 인정하되 선거ㆍ공안 사건에서는 사건인지 시점부터 검찰의 지휘를 받도록 하는 중재안도 시도됐으나 양측이 이견을 좁히지 못한 것으로 알려졌다.

이날 사개특위 전체회의에 앞서 한나라당은 의원총회를 열고 검.경 수사권 조정문제에 대한 당의 입장을 정할 예정이다.

한편 2013년 3년 경력을 지닌 법조인을 판사로 임용하는 것을 시작으로 2022년부터는 10년 경력 이상의 법조인만 법관에 임명될 기회를 주는 법조일원화 방안은 여야간 이견이 없어 이날 사개특위 전체회의에서 통과될 것으로 예상된다.

여야간 합의된 ▲로클럭 제도 도입 ▲법관인사제도 개선 ▲법원 판결서ㆍ증거목록의 공개 ▲재정신청대상에 피의사실공표죄 고발사건 포함 ▲기소검사실명제 ▲수사목록작성 의무화 등도 이날 회의에서 처리될 것으로 보인다.
