Court says contempt is wrong and growing worse

The Constitutional Court yesterday unanimously struck down a petition challenging the constitutionality of the criminal offense of contempt, ruling that modern Korea needs the legal grounds to punish the crime more than ever.

The petition was filed in 2009 after a Busan resident was accused of contempt against a police officer. On Nov. 19, 2008, the 43-year-old man was arrested on charges of insulting a police officer with swear words under the influence of alcohol. A month later, he faced a summary indictment for contempt of the police officer but the suspect asked for a formal trial at the Busan District Court in February 2009.

After the court ruled that he should pay a 1 million won ($940) fine for insulting the police officer, the suspect filed a petition with the Constitutional Court. He argued that Article 311 of the criminal code, which says a person guilty of contempt could be punished with up to one year in prison or a fine of up to 2 million won, ambiguously defined the offense. He also argued that the article is in violation of the constitutional principle of proportionality. The petition, however, was unanimously turned down by the court’s nine justices.

“A person with healthy common sense and a reasonable sense of law is capable of predicting what is the prohibited act,” the Constitutional Court said in a ruling, rejecting the petitioner’s argument about the clause’s ambiguity. The court also ruled against his argument that the article infringed upon the principle of proportionality.

“In a modern society, an act of contempt can easily be spread due to the development of media and information communication technology,” the court said. “The damages caused by contempt are growing severer and it is also harder to recover from it. Therefore, criminally punishing the offense, when a complaint was filed by a victim, is not an excessive use of legislative power.”

In Korea, there have been an increasing number of cases of celebrities and ordinary people maligned on the Internet.

 2008년 11월 부산 해운대구 반송지구대 앞. 술에 취한 방모(43)씨는 지구대 소속 경찰관에게 욕설을 퍼붓다 현행범으로 붙잡혔고, 이후 약식기소됐다. 방씨의 죄명은 모욕혐의. 법원은 방씨에게 “택시기사와 행인 등 불특정 사람들이 듣고 있는 가운데 공연히 피해자를 모욕했다”며 벌금 100만원형을 선고했다. 억울함을 느낀 방씨는 헌법재판소에 헌법소원을 냈다. ‘공연히 사람을 모욕한 자는 1년 이하의 징역이나 금고 또는 200만원 이하의 벌금에 처한다(형법 제311조)’는 표현에서 ‘공연성’과 ‘모욕’의 개념이 모호하다는 것이었다. 방씨는 또 욕설 등의 행위에까지 형벌을 내리는 것은 지나치다고 주장했다.

 그러나 헌법재판소는 7일 재판관 전원 일치 의견으로 방씨의 위헌소원을 기각했다고 밝혔다. 헌재는 결정문에서 ‘공연성’과 ‘모욕’은 “사회통념과 건전한 상식에 따라 구체적·개별적으로 정해질 수 있다”며 법원의 법 조항 해석 권한을 인정했다. 이어 “건전한 상식과 통상적인 법감정을 가진 일반인이라면 금지되는 행위가 무엇인지를 예측하는 것이 어렵지 않다”며 모욕죄가 헌법상 과잉금지의 원칙에 어긋나지 않는다고 봤다.

 헌재는 오히려 모욕죄의 사회적 필요성이 점차 커지고 있다는 점을 강조했다. “현대사회에서 미디어와 정보통신(IT) 기술의 발달로 다른 사람에 대한 모욕적 행위가 쉽게 전파될 수 있다”는 것이다. 재판관들은 결정문에서 “모욕 행위가 초래할 수 있는 피해가 과거에 비해 극심하고 피해 회복 또한 쉽지 않다”고 밝혔다.

 헌법재판소 박준희 공보관은 “요즘은 통신수단이 발달해 휴대전화 하나만 있어도 여러 사람이 있는 곳에서 욕설을 하는 장면이 불특정 다수에게 급속도로 퍼질 수 있다”고 말했다. 이어 “이런 사회에서는 모욕 행위를 처벌함으로써 달성하는 공익이 크고, 모욕죄를 처벌하기 위한 법 조항은 과도한 국가 형법권 행사라고 보기 어렵다는 게 이번 헌재 결정의 취지”라고 설명했다.
