New ‘no orders’ order for all soldiers

Rank-and-file soldiers in Korea will not be allowed to give orders to lower-ranking soldiers, including for simple errands, in an effort to cut down on barracks bullying that has led to suicides and a recent shooting rampage on a Marine base.

In the future, orders can only be given by a leader of a squad or a mission or a commissioned officer, according to the Ministry of National Defense yesterday.

“This will ban soldiers from sending subordinates on errands such as fetching a glass of water,” said a military official.

The ministry said it has crafted guidelines regarding the code of conduct within barracks at the order of Defense Minister Kim Kwan-jin, which it will distribute to the Army, Air Force, Navy and Marine Corps this week. It will be the first uniform set of guidelines for all branches of the military.

The guidelines were prepared in response to a July 4 fatal shooting spree by a Marine allegedly driven around the bend after being bullied by subordinate soldiers who were older than him. Four Marines were killed.

The guidelines say soldiers under the rank of staff sergeant do not represent part of the chain of command, and allow only higher officers the right to give orders.

Junior officers such as corporals or lance corporals appointed the head of a squad or a mission are exempt from the ban and can give orders to members of their squads, the ministry said.

Any kind of verbal or physical bullying is also banned under the guidelines.

“The guidelines are aimed to clarify the relationship of soldiers with each other and create an advanced military culture in which soldiers respect each other,” the ministry said in a statement.

“Taking this Marine [shooting] case as a lesson, we will work out measures to reform the military culture and enforce them so that not only the Marines but all troops can be reborn as the people’s troops that win the public’s trust,” it said.

The guidelines will eventually be made permanent.

앞으로는 분대장 및 조장을 제외한 사병들끼리 일체의 명령이나 지시를 하지 못하게 된다. 또 구타나 가혹행위, 집단 따돌림(왕따)을 하는 병사는 사안이 경미하더라도 처벌받게 된다. 김민석 국방부 대변인은 19일 “지난 4일 해병대 총기 사건으로 드러난 병영 내 구타·가혹행위 근절을 위해 병사들의 상호관계 기준을 명확히 설정한 ‘병영생활 행동강령’을 이번 주 중 전군에 하달한다”며 “‘지시’시한이 2년이기 때문에 향후 법적 구속력 강화를 위해 국방부 최고 행정규칙인 ‘훈령’으로 발전시킬 것”이라고 말했다. ‘행동강령’의 내용은 2003년 육군에서 마련해 시행 중인 병영 내 생활행동 강령과 대동소이하다.

　강령은 ▶지휘자(병 분대장 및 조장) 이외의 병사 간 상호관계는 명령복종 관계가 아니며 ▶병사의 계급은 상호 서열관계를 나타낸 것일 뿐 지휘자를 제외한 병사 상호 간에는 명령, 지시를 할 수 없다 ▶구타·가혹행위, 인격모독(폭언, 모욕) 및 집단 따돌림, 성 군기 위반행위는 어떠한 경우에도 금지한다고 규정했다. 국방부는 “병사들 사이에 명령 지시를 한 경우나 이를 묵인한 경우에도 엄중 문책한다”며 “구타·가혹 행위자에 대해서는 경미한 피해를 주더라도, 또 피해자와 합의를 하더라도 형사 처벌하기로 했다”고 밝혔다.

　집단 따돌림 등 인격적 모독과 고통을 가한 주모자, 적극 가담자도 처벌 대상이다. 강령 위반 사실을 알게 된 장병은 지휘관에게 신고할 의무가 있으며, 지휘관은 신고자의 신원을 철저히 보장하고 피해자에게는 필요한 보호조치를 하도록 규정했다. 국방부의 ‘행동강령’ 지시 조치에 대해 일각에선 군내 위계질서를 훼손해 전투력을 떨어뜨릴 수도 있다는 우려도 나온다. 김 대변인은 “선임병에게는 후임병을 지원·조언하는 책임이 있고, 후임병에게는 선임병을 존중하고 군대예절을 지켜야 하는 의무가 있다는 것을 전제로 한다”고 설명했다.
