Trial of ethnic Korean drags on in U.S. court

It was a year ago that Korean-American Stephen Kim, who had been a senior adviser to the U.S. State Department on arms control compliance, was indicted by the U.S. government in August on charges of disclosing classified national defense information.

His supporters, however, are steadfast in their belief that Kim is being wrongly prosecuted and remain committed to helping him.

In a recent interview with the JoongAng Ilbo, Kim, 43, said the espionage charges that he is fighting have been draining him and his family financially and psychologically.

Kim is suspected of having leaked classified information to a Fox News reporter regarding North Korea’s nuclear program in 2009 while working for the State Department.

The government claims the information dealt with the military capabilities of a foreign nation that could be used “to the injury of the U.S.”

Kim said the whole ordeal has been crushing. “The legal process is protracting without progress,” Kim said as he left a courtroom in Washington on Tuesday. “My life and the career that I have built have stopped too.”

Kim went to court that day for his fifth court appearance since the indictment.

The court has yet to start the main legal proceedings because prosecutors haven’t submitted necessary documents, his defense team says. Prosecutors say it takes time to submit the documents because the documents contain classified information and need approval from many different intelligence agencies for court submission.

Abbe Lowell, the main lawyer for Kim, said the case is likely to take a long time to resolve.

And until the case is settled, Kim said, “I can’t go beyond 25 miles out of Washington, can’t travel and can’t go meet people close to me,” Kim said.

Kim said his family in Korea has nearly gone bankrupt to help pay his legal expenses - he said his parents in Korea sold out their house - and he is only making ends meet by living with the help of acquaintances.

According to those with knowledge of the case, Kim may have to pay around $1.5 million to the lawyers until the case is closed. His acquaintances have set up a Web site in an effort to raise defense funds for Kim.

Kim declined to predict the result of the court process. But, those with knowledge said criticism is growing that the Obama administration is using an excessive application of the law against him.

Kim’s attorneys have said Kim’s First Amendment rights, which guarantee freedom of speech, are being violated by the prosecution process.

And, according to one news report, Kim’s lawyers have faulted the U.S. government with criminalizing normal conversation exchanges “that happen hundreds of times a day in Washington.”

 19일 오전(현지시간) 워싱턴DC 법원을 나서며 스티븐 김(44·한국명 김진우·사진)은 허탈하게 말했다. 미국 내 손꼽히는 북핵 문제 전문가인 그는 정보 누설과 관련한 간첩죄 혐의로 재판을 받고 있다. 19일 공판은 지난해 8월 기소 이후 다섯 번째였다. 그러나 유·무죄를 다투는 본안 심리에는 착수조차 하지 못했다. 검찰 측이 “이 사건 자료에 공개해선 안 될 기밀 정보가 포함돼 있어 중앙정보국(CIA) 등 16개 미 정보기관의 사전 허가를 받는 데 시간이 걸린다”며 아직까지 법정에 자료 제출을 하지 않고 있기 때문이다.

김씨 측 애비 로웰 변호사는 재판 뒤 “검찰이 판사가 이 소송을 판단하는 데 필요한 자료조차 제공하기를 거부하고 있다”며 “이 때문에 오랜 시간이 걸릴 것 같다”고 말했다.

 - 지금 상태는.

 “재판이 끝날 때까지 워싱턴DC에서 25마일 밖으로 나갈 수 없어 여행도 할 수 없고, 가까운 사람들과의 모임에도 참석할 수가 없다. 정신적으로든, 경제적으로든 감당하기 어려운 상황이다.”

 - 경제적인 상황은 어떤가.

 “(재판 비용 마련을 위해) 한국에 계신 부모님이 집을 처분하는 등 온 가족이 사실상 파산했다. 지인들의 도움으로 근근이 버티고 있다.”

 (※이번 소송의 변호사 비용은 종결될 때까지 약 150만 달러(약 16억원)가 소요될 것으로 전해졌다. 스티븐 김을 후원하는 지인들은 지난해 연말 인터넷 웹사이트(www.stephenkim.org)를 개설해 기소의 부당성과 소송 비용을 모금하는 캠페인을 벌이고 있다.)

 - 재판 전망은.

 “재판이 진행 중인 상황에서 조심스럽다. 언급할 수 없다.”

 (※그러나 최근 들어 김씨에 대한 간첩죄 적용이 오바마 행정부의 무리한 법 적용이라는 비판이 커지고 있다. 미 연방법원은 지난 15일 국가안보국(NSA) 고위 간부 출신 토머스 드레이크에 대한 재판에서 허가범위를 넘어선 정부 컴퓨터 사용 혐의를 적용해 보호관찰 1년의 가벼운 형량을 선고했다. 당초 검찰은 드레이크에 대해 기밀누설 혐의로 간첩죄를 적용했다가 재판 과정에서 철회했다. 재판부는 이를 두고 “각종 수사로 드레이크를 수년 동안 괴롭혔으며, 적절하지 않은 행위였다”고 검찰을 비판했다. 김씨 사례는 드레이크의 경우보다도 훨씬 경미하다는 게 미국 내 평가다.)

◆스티븐 김 사건=2009년 6월 11일 폭스TV뉴스 제임스 로젠 기자는 “북한이 유엔 안보리의 대북제재 결의 이후 추가 핵실험 등으로 대응할 것이며, 이는 CIA가 취득한 정보”라고 보도했다. 이미 북한은 같은 해 5월 2차 핵실험을 했고, 또 성명을 통해 추가 실험을 공언한 상태여서 그의 발언은 기밀 누설과는 거리가 먼 것이었다. 그러나 당시 정보 관리에 민감했던 오바마 행정부는 수사에 착수했고, 스티븐 김을 정보 제공자로 지목해 2010년 8월 간첩죄로 기소했다.
