Prosecutor is out for joining the DLP

About a month ago, a promising young prosecutor was investigated on suspicion of violating the “political neutrality” rule as a government officer.

The female prosecutor, Kang Yun-hee, 29, was asked to resign from her office because the Seoul Central Prosecutors’ Office found that Kang had joined the Democratic Labor Party (DLP) and had given them financial support for the last few years.

Government officers and civil servants in Korea are not allowed to belong to political parties. Besides Kang, many other government officers and civil servants have violated the law, but Kang was the only prosecutor among them.

Kang was born in Gwangju and was known as a quiet and diligent student who dreamed of becoming a lawyer. She graduated from the Yonsei University College of Law in Seoul and passed the bar exam in 2006.

In 2007, Kang entered the Judicial Research and Training Institute (JRTI), the final, necessary educational step for candidates to join the legal profession to become judges, prosecutors and lawyers.

During the first semester at the institute, Kang was not a good enough student to be assigned as a prosecutor because her academic grades weren’t high enough. The candidates get assigned by their earned scores, with the highest scoring group becoming judges, prosecutors and lawyers, following that order.

However, Kang gradually improved her grades every semester and was ultimately assigned as a prosecutor when she graduated from the institution. A professor at the institution who taught Kang remembered her as a “workhorse.”

“She studied so hard to become a prosecutor,” the professor said. “Many professors including myself thought becoming a prosecutor is the most appropriate opportunity for her because of her character. She was the type of student who lives up strongly to her resolution. Prosecutors need people with the kind of character that Kang possesses,” the professor said.

In February 2009, Kang was appointed to the criminal investigation department in the Ulsan Prosecutors’ Office and handled teenage crimes.

At the time, she worked hard with a strong sense of duty of leading criminal teenagers to get on the right track in their lives. In January, she was transferred to the Ansan office and was working there until she resigned.

One day, Kang got a call from the investigation team of Seoul office asking her about her membership in the Democratic Labor Party.

According to the office, she had paid from 5,000 won ($4.76) to 10,000 won to the Democratic Labor Party in support funds each month since college. Kang said she forgot about the payment because the money was an automatic withdrawal.

The Seoul office announced Thursday that they investigated 428 civil servants, including teachers and district government officers, on charges of joining a political party and donating money.

Among the 428 suspects, the prosecutors indicted 244 - 210 teachers and 34 public officers - without detention on Thursday. The rest of the 184 were not indicted after promising to quit the party. “We check out the criminal records when we assign new officers, but it is impossible to know whether the officers had joined any political parties unless they told us in advance,” a spokesman of the Ministry of Justice said. “We need to improve our appointment system.”

강윤희 검사 2년 만에 사표 쓴 사연
한 달여 전 한 여검사가 검찰 조사를 받았다. 교사와 공무원들이 민노당 당원으로 가입해 당비를 낸 사건과 관련해서다. 여검사는 “잘 몰랐다”고 했다. “반성하겠다”고도 했다. 왜 다른 공직자와 처리 기준이 다른지 억울해했다. 하지만 본인의 잘못으로 검사의 정치적 중립 의무를 위반한 이상 달리 도리가 없었다. 꿈에 그리던 검사가 된 지 불과 2년 만에 그는 지난 1일 사표를 내고 검찰을 떠나야 했다. 안산지청 검사 출신 강윤희(29) 변호사 얘기다.

　전도양양하던 젊은 여검사의 날개가 대학 시절 별생각 없이 해온 민노당 당원 가입 및 당비 납부로 인해 순식간에 꺾여 버렸다. 강 전 검사의 선배와 동료들은 안타까워했다.

　강 전 검사는 1982년 광주에서 태어났다. 어려서부터 조용한 성격에 말수가 적었다고 한다. 지방의 과학고를 졸업하자마자 연세대 법대로 진학한 뒤 법조인의 꿈을 키웠고 2006년 사법시험에 합격했다. 2007년 사법연수원(38기)에 입소하면서는 검사가 되기 위해 기를 쓰고 공부했다.

입소 당시에는 검사 임용을 장담할 정도의 성적이 아니었지만 학기가 바뀔 때마다 잇따라 석차를 높였고, 꿈에 그리던 검사로 임용됐다. 강 전 검사를 가르쳤던 사법연수원의 한 교수는 “그녀는 조용하고 얌전한 성격이었지만 심지가 곧고 정의감이 있어서 주변에서도 검사가 잘 어울린다는 평가가 많았다”며 “연수원 시절 하도 공부를 열심히 해 ‘저러다가 쓰러지는 것 아니냐’는 우려를 자아낼 정도였다”고 말했다.

　그는 2009년 2월 첫 근무지인 울산지검 형사2부에서 소년 범죄를 담당했다. 청소년들을 올바른 길로 인도하겠다는 사명감으로 열심히 일했다고 한다. 올해 초 수원지검 안산지청으로 옮긴 이후에는 공판 업무를 맡았다. 검찰의 수사가 법원의 유죄 판결로 결실을 볼 수 있도록 공소유지 업무를 담당했다. 선후배와 동료들은 “강단지고 일도 잘한다”고 평가했다. 지난해엔 결혼하고 가정도 일궜다.

　탄탄대로였던 강 전 검사의 인생은 서울중앙지검 공안2부의 조사를 받으면서 파열음이 났다. 수사 검사는 그에게 “교사와 공무원의 민주노동당 입당 사건을 수사 중인데 혹시 민노당에 입당했느냐”고 조심스레 질문했다. 사실이었다. 그는 대학 시절 민노당에 입당했고 월 5000~1만원씩의 당비도 납부했다. 과거 학생운동을 한 적은 없는 것으로 알려졌다. 다만 “그 나름대로 민노당을 대안 정치세력으로 본 것 같다”는 게 주변 사람들의 전언이다.

　문제는 그가 국가공무원이 된 이후에도 민노당을 탈당하지 않았다는 것이다. 공무원의 정치적 중립 의무를 정면으로 위반한 것이다. 강 전 검사는 “당비가 자동이체되도록 해 둔 것을 잊어버렸다”고 해명했다고 한다. “잘못을 뉘우치고 탈당하겠다”고 했지만 상황을 되돌릴 수는 없었다. 수사팀은 다른 공무원들의 경우 탈당 시 불기소 처분을 내렸지만 그에게는 더 엄격한 잣대를 들이댔다. 강 검사는 사직을 권유받았다. 검사가 좋았고 검사 일을 계속하고 싶었지만 다른 방법이 없었다.

강 검사는 지난 1일 사표를 내고 검찰을 떠났다. 본지는 강 전 검사와 인터뷰를 시도했지만 그는 검찰 내 지인을 통해 “좋은 내용이든, 나쁜 내용이든 (나에 대한) 내용이 기사화되는 걸 원치 않는다”고 밝힌 채 취재에 응하지 않았다. 법무부 관계자는 “검사 등 공무원 임용 시 범죄 전력은 조회하지만 정당 가입 여부는 본인이 밝히지 않는 이상 알 수 있는 방법이 없다”며 “앞으로 임용 시스템을 개선할 필요가 있다”고 말했다.
