3 ex-Air Force officers indicted for selling secrets

A former Air Force chief of staff and two other former officers were indicted for leaking confidential military information to Lockheed Martin, a U.S.-based aerospace and technology company, including the Korean military’s plans to purchase new weapons.

Seoul central district prosecutors said yesterday the three men worked for the same weapons company in Seoul and leaked confidential information from September 2004 to January 2010. The men were allegedly paid 2.5 billion won ($2.36 million) from Lockheed Martin in 2009 and 2010 alone.

The three indicted are Kim Sang-tae, 81, former Air Force chief of staff; Lee, 62, a reserve Air Force colonel; and Song, 60, a reserve senior master sergeant.

Kim was the president of the weapons company, Lee was vice president and Song was executive director.

Kim’s company was an authorized dealer of Lockheed Martin, one of the largest defense contractors in the world, and the confidential material was allegedly given to the American company during business meetings in Korea and Singapore, prosecutors said. Lockheed Martin and Kim’s company were allegedly in contact 12 times to exchange the information.

The alleged leaked information was of security levels two and three - level one is the highest - and included plans by the Korean military to buy joint air-to-surface standoff missiles, night vision equipment, cluster bomb units and medium-range GPS-guidance kits.

With this knowledge, Lockheed Martin later held presentations about their products at timely periods, prosecutors said, and was selected last year by the Defense Acquisition Program Administration as a preferred bidder for night vision equipment.

A Defense Security Command investigation in April this year into the former vice president of the weapons company, Chang Jin-hwa, 58, led authorities to expand their probe to include the three indicted men. The Defense Security Command is an investigative agency under the Ministry of National Defense. Chang, a former colonel, is now under arrest.

Prosecutors searched the offices of Kim’s company in April and with evidence seized, brought workers from Lockheed Martin to Korea for questioning.

The workers were not charged with criminal behavior because they testified they were unaware at the time that they were given confidential military information.

The three men said the information they gave Lockheed Martin was data collected from the Internet or other public areas, prosecutors said. However, because the information they leaked match military files, prosecutors plan to investigate how the data was obtained.

When contacted, Lockheed Martin’s public relations representative was unable to provide a reaction.

우리 공군의 무기구매계획 등 2, 3급 군사기밀을 미국 군수업체인 록히드마틴사에 넘기고 2년간 25억원을 받은 혐의로 공군참모총장 출신 예비역 대장 등 세 명이 재판에 넘겨졌다.

　서울중앙지검 공안1부(부장 이진한)는 공군의 전력증강 사업과 관련한 군사기밀을 록히드마틴사에 누설한 혐의(군사기밀보호법 위반)로 무기중개업체 S사 대표 김상태(81·전 공군참모총장)씨와 전 부사장 이모(62·예비역 공군대령)씨, 상무이사 송모(60·예비역 공군상사)씨를 불구속 기소했다고 3일 밝혔다. S사는 록히드마틴의 국내 무역대리점이다. 이 중 김씨는 공군사관학교 2기 출신으로 5공화국 때인 1982~84년 공참총장을 지내다 예편한 뒤 95년부터 S사를 차려 무기중개업을 해왔다.

　검찰에 따르면 공군사관학교 선후배인 김씨 등은 2003년부터 지난해 초까지 공군의 전력증강사업과 관련한 기밀을 12차례에 걸쳐 록히드마틴 측에 넘겨주는 대가로 2009년과 2010년 모두 25억원을 받은 혐의다.

　김씨 등이 넘긴 자료들은 ‘합동군사전략목표기획서(JSOP)’와 ‘국방중기계획’ 등 군 발전계획을 담은 2, 3급 군사기밀이었던 것으로 조사됐다. 이들은 특히 우리 군이 북한 내부의 전략 표적을 정밀 타격하기 위해 도입을 추진하던 ‘합동원거리공격탄(JASSM)’의 수량과 예산, 장착 전투기 배치 장소 등을 기록한 문서도 2003년부터 지속적으로 누설했다고 검찰은 말했다. 전투기에 탑재돼 주·야간 표적을 탐지·식별하는 야간표적식별장비나 다목적 정밀유도 확산탄, 중거리 GPS 유도키트의 도입 수량과 시기 등이 기재된 회의 자료도 넘어갔다는 것이다.

　검찰은 김씨 등이 공사 선후배 관계 등 공군 내부의 친분을 활용해 방위사업청 등에 근무하는 실무자로부터 무기 도입계획 관련 기밀을 수집한 것으로 파악했다. 이렇게 수집한 기밀을 회의자료 형식으로 만들어 록히드마틴 직원들과 마케팅 회의를 할 때 직접 전달하거나 e-메일로 보냈다고 한다. 수사 관계자는 “공군 내에 존재하는 일종의 ‘전관예우’라고 보면 될 것”이라고 말했다.

　록히드마틴사는 이런 기밀을 우리 공군을 상대로 한 마케팅에 활용한 것으로 보인다고 검찰은 설명했다. 실제로 록히드마틴사는 지난해 우리 공군이 야간표적식별장비 30대 구입을 추진할 당시 우선협상대상자로 선정되기도 했다.

　김씨 등은 검찰 조사에서 “해당 내용이 인터넷이나 방위사업청에 공개된 자료며 군사기밀이 아니다”라고 주장한 것으로 전해졌다. 또 “회의 자료를 만든 것은 맞지만 직접 건네거나 e-메일로 보낸 적은 없다”고 진술했다고 한다.

　검찰은 김씨 등 세 명에 대해 구속영장을 청구했으나 법원이 “도주 및 증거 인멸의 우려가 없다”는 이유로 기각했다. 검찰은 “국방대학원 도서관에서 세 차례에 걸쳐 2급 군사기밀을 유출하고 1억 4000만원을 받은 또 다른 김모씨는 구속됐는데, 이보다 더 중한 김씨 등의 영장이 기각된 것은 납득하기 어렵다”고 반발했다.
