Kwak’s payment was bribe: Park

The Seoul Central District Prosecutors’ Office said yesterday that Park Myong-gee, a leading candidate in last year’s Seoul education superintendent election, confessed that he was paid 200 million won ($186,133) to withdraw from the race by Kwak No-hyun, who won the election.

But for months, Kwak didn’t pay Park the money he had promised, prosecutors said, leading to bitter squabbles.

On Sunday, Kwak admitted to giving Park the 200 million won, but claimed it had nothing to do with the election and that the prosecutors were targeting him for political reasons, namely because he won the referendum last week on the free school lunch program he started in December. Kwak said he also gave Park the money because he heard he was suicidal.

Park, a professor at Seoul National University of Education, withdrew his candidacy for education superintendent two weeks before the June 2, 2010, election, so that liberals could unite behind one candidate, which was Kwak. Kwak defeated six other candidates in the race.

According to the prosecution, Park confessed: “When liberal lawmakers were discussing uniting behind a single liberal candidate, Kwak promised me some money in exchange for withdrawing my candidacy.”

According to the prosecution, Park spent about 500 million won of his own money in the campaign. He demanded 700 million won from Kwak, prosecutors said, but a month before the election, both sides verbally agreed on 200 million won. They didn’t sign on a contract.

By last October, Kwak hadn’t paid the money to Park, prosecutors said, and the two men quarreled. Kang Kyung-seon, a law professor at Korea National Open University and an associate of Kwak, told Park that Kwak would pay the money soon, prosecutors said.

Last February, Kwak’s wife withdrew a large amount of money from her bank account, they said. From February to April, Kang delivered 200 million won in four or five installments to Park’s younger brother.

Prosecutors raided Park’s house Friday and found papers including transcripts of dialogues. Apparently, Park took notes on all the discussions about the money since last October.

Park also ordered an associate to meet with an associate of Kwak and the conversation was recorded, prosecutors said. In the conversation, there is mention of the 700 million won Kwak was supposed to give to Park in return for his leaving the race.

This week, prosecutors will question all suspects involved in the money transaction between Kwak and Park and look into their bank account records. Prosecutors will summon Kwak for questioning soon.

“There’s plenty of evidence and witnesses,” said Gong Sang-hun, senior prosecutor at the Seoul Central District Prosecutors’ Office.

The source of the 200 million won is still being investigated. Kwak reported to the tax agency in March that he had 200 million won in cash and his wife, a doctor surnamed Jeong, had 630 million won in cash.

Kwak told city councilors yesterday: “I’m really sorry to citizens and councilors for causing trouble due to my lack of virtue.”

He didn’t say whether he would resign his position.

If Kwak resigns this month, a by-election will take place on Oct. 26 to fill his position, the same day a new mayor will be elected to replace Oh Se-hoon, who resigned Friday after losing the referendum to scale back the free lunch program pushed into law by Kwak in December.

If he resigns after September, a by-election will be held next April.

Teachers and parents in Seoul reacted with outrage over the scandal.

“We can’t accept this legally or emotionally,” the Korean Federation of Teachers’ Association, an association of conservative teachers, said in a statement yesterday. “Kwak should live up to his responsibilities, as this case is having a great impact on the educational and social sectors.”

Dong Hun-chan, spokesman for the Korean Teachers and Education Workers’ Union, said yesterday, “We really regret this case. We’re concerned it will demean the value of universal welfare for students [which was strived for by Kwak].”

곽노현 서울시교육감이 지난해 교육감 선거 당시 후보였던 박명기 서울교대 교수에게 사퇴를 종용한 단서를 포착해 검찰이 수사 중이다. 서울중앙지검 공안1부(이진한 부장검사)는 박 교수의 측근 A씨에 대한 소환 조사에서 “곽 교육감이 지난해 5월 중순께 한 선거 관련 행사에 참석해 박 교수에게 직접 ‘(선거에 끝까지 출마한다면) 당신은 낙선할 것이고 진보 민주진영에서 매장당할 것’이라고 말하며 사퇴를 종용했다”는 진술을 확보한 것으로 29일 알려졌다.

검찰은 이날 곽 교육감에게서 2억원을 받은 혐의(공직선거법 위반)로 박 교수를 구속했다. 또 곽 교육감의 자금 2억원을 박 교수 측에 전달한 강경선 방송통신대 교수를 공직선거법 위반 혐의로 체포했다. 강 교수의 경기도 과천시 자택과 사무실 등도 압수수색했다. 검찰은 박 교수 자택에서 문제의 돈이 후보 사퇴의 대가(代價)였고, 박 교수가 애초 7억원을 요구했다는 내용이 담긴 녹취록과 자료를 확보해 분석작업 중이다. 검찰은 조만간 곽 교육감도 소환 조사할 예정이다.

 검찰이 박 교수를 구속했지만 곽 교육감은 ‘2억원’의 출처에 대해 함구하고 있다. 전날 기자회견에선 “후보 단일화 뒷거래는 명백한 반칙인데 그런 위법은 없었다. 선의(善意)로 2억원을 전달했다”고 말했지만 이날도 자금 출처나 전달 방법에 대해서는 입을 다물었다.

이날 오전 9시16분 평소보다 30분 정도 늦게 출근한 곽 교육감은 기자들의 질문에 무대응으로 일관했다. 9시25분 기관장회의를 주재하면서 교육감 집무실 9층을 전면 통제했다. 공개행사인 11시10분 교장 임명장 수여식에서도 언론을 통제하고 객석의 기자를 내쫓았다.

 ‘2억원’에 대해 침묵하던 그는 오후 2시 서울시의회 임시회 본회의 개회식에 앞서 입을 열었다. 곽 교육감은 교육의원 등 7명의 의원들과 만나 “나는 죄가 없다. 판사·검사에게 가서 당당하게 이야기하겠다. 그게 만약 무서웠다면 내가 예전에 고시공부를 해서 판검사가 됐을 것이다”고 말했다고 한 참석자가 전했다. 이어 시정연설에서는 “시민과 시의원들께 심려를 끼쳐 드려 몹시 송구스럽다”고 했다. 기자들을 내쫓는 등 언론은 통제하면서 자신의 편인 민주당 의원이 대다수인 시의회에선 “떳떳함”을 주장하는 이중성을 보인 것이다.

 곽 교육감은 오후 3시30분 교육청으로 복귀해 집무실로 통하는 엘리베이터를 모두 통제하고 칩거했다. 검찰이 대가성으로 거액을 받았다는 박명기 교수의 진술을 확보했는데도 반박도 하지 않았다. 서울시 교육청 관계자는 “교육청이 큰 혼란에 빠졌는데 곽 교육감이 여론 추이만 살피고 있는 것 같다”고 말했다.

 곽 교육감의 거취는 ‘돈’이 변수가 될 수도 있다. 그는 지난해 선거에서 당선돼 35억2000여만원을 보전받았다. 공직선거법 265조에 따르면 선거 보전비용 반환에 대한 책임은 ‘검찰 기소 후 확정판결을 받은 자’까지만 포함된다. 중앙선관위 관계자는 “법 조문만 놓고 보면 검찰 기소 전까지만 사퇴하면 유죄를 받더라도 보전비를 환급하지 않아도 된다”고 말했다. 사퇴 시기가 빨라지면 35억2000여만원을 내놓지 않아도 된다는 뜻이다. 만약 검찰에 기소되고 유죄가 확정되면 선거 보전비를 모두 반납해야 해 재산 15억9000여만원(3월 기준)을 제하고도 20억원 가까운 빚더미에 오르게 된다.

 돈 거래 사실을 부인하다 이틀 만에 말을 바꾸는 등 곽 교육감의 위선이 드러나자 사퇴 요구 목소리가 높다. 한국교총과 공교육살리기학부모연합 등 교원 및 학부모단체는 일제히 곽 교육감의 사퇴를 주장했다. 이날 교육청 앞에서는 바른사회시민회의와 학교를사랑하는학부모모임 회원들이 곽 교육감의 즉각적인 사퇴를 촉구하며 농성을 벌였다.
