After 16 hours of questioning, one more round

The embattled superintendent of the Seoul Metropolitan Office of Education, Kwak No-hyun, came in yesterday for a second round of questioning by prosecutors over allegations that he bribed a former election rival to exit the race.

The latest round came after he was questioned for 16 hours on Monday.

Kwak made no comment as he returned to the Seoul Central District Prosecutors’ Office yesterday, ignoring reporters who asked about his innocence and whether the 200 million won ($186,167) he gave to Park Myong-gee was “clean.”

Nearby, Kwak’s supporters chanted “Kwak No-hyun is innocent,” while a group of his detractors demanded his resignation.

At Monday’s questioning, prosecutors said they asked Kwak about how liberal parties came to field a single candidate for the June 2010 superintendent election. Prosecutors wrapped up their interrogation around 8 p.m. because Kwak refused to answer questions after midnight. Instead, Kwak agreed to attend a second questioning yesterday.

Yet, Kwak ended up staying after prosecutors finished their first round of questioning, insisting on checking the prosecutors’ report of what he said. A former law professor, Kwak checked every word of the report until 3:30 a.m. before going home, his lawyer said yesterday.

“Kwak has fully explained what he knows about the negotiations over a single liberal candidate last year,” his lawyer, Kim Chil-jun, said. “Except that, other parts of the incident haven’t been questioned.”

Prosecutors said they would question Kwak about why he gave money to Park and how he raised the money. Park has told prosecutors that the money was in return for his withdrawal from last year’s superintendent race.

Kwak has insisted that he did not make any agreements about Park’s candidacy and that he gave the money to help Park repay heavy debts.

Kwak’s wife, who was also questioned by prosecutors, said that she and her elder sister had raised 100 million won and that Kwak had borrowed the rest from his close aide, prosecutors said.

檢, 郭 '위장 돈거래' 증거 확보

돈 주고받은 강경선-박교수 동생 명의 차용증 나와
심야까지 2차 조사…주변인물도 기소 검토

서울시교육감 후보단일화 뒷돈거래 의혹을 수사하는 서울중앙지검 공안1부(이진한 부장검사)는 곽노현 교육감이 박명기(구속) 서울교대 교수에게 돈을 전달하면서 다른 사람 간의 거래로 위장한 증거를 확보한 것으로 6일 알려졌다.

검찰은 지난 2~4월 곽 교육감이 박 교수에게 6차례에 걸쳐 2억원을 전달하는 과정에서 양측 사이에 돈을 직접 주고받은 곽 교육감의 측근 강경선 한국방송통신대 교수와 박 교수 동생 명의로 작성한 차용증 12장을 찾아낸 것으로 전해졌다.

이 차용증에는 돈을 빌려준 사람이 강 교수로, 돈을 빌린 사람이 박 교수의 동생으로 적시돼 있고, 돈을 건넬 때마다 양측이 한 장씩 보관하기로 해 총 12장이 작성된 것으로 알려졌다. 검찰은 곽 교육감이 2억원의 대가성을 숨기기 위해 이 같은 방식의 위장 거래를 한 것으로 보고 있다.

검찰은 지난달 26일 박 교수 형제 자택을 압수수색하면서 동생 박씨의 집에서 이 차용증을 발견한 것으로 전해졌다.

검찰은 또 곽 교육감이 박 교수에게 전달한 2억원의 대가성을 입증할 만한 중요한 증거 중 하나를 인멸하려 한 정황도 포착한 것으로 알려졌다.

이에 따라 검찰은 이르면 7일 중 곽 교육감에 대해 공직선거법 위반 혐의(후보자 매수 및 이해유도)로 사전구속영장을 청구하는 방안을 검토하고 있다. 곽 교육감에 대한 구속영장이 7일 청구되면 법원의 구속 전 피의자심문(영장실질심사)은 오는 9일께 열릴 것으로 예상된다.

검찰은 전날에 이어 이날 오후 곽 교육감을 서초동 서울검찰청사로 다시 소환해 양측 실무진이 이면합의한 사실을 인지한 시점과 올해 2~4월 6차례에 걸쳐 박 교수에게 건넨 2억원의 출처 등을 밤늦게까지 집중적으로 캐물었다.

검찰은 곽 교육감으로부터 1억원은 부인과 처형이 개인자금으로 마련했고, 나머지 1억원은 자신이 지인으로부터 돈을 빌려 직접 조달했다는 진술을 받아낸 것으로 알려졌다. 곽 교육감은 그러나 돈을 빌린 과정에 대해서는 함구한 것으로 전해졌다.

검찰은 2억원 중 일부에 교육감 판공비나 교육청 특수사업비, 선거비용 잔금 등 공금 성격의 돈이 섞여 있는지도 조사했지만 곽 교육감은 공금과는 전혀 무관한 돈이라는 진술을 고수한 것으로 알려졌다.

이와 관련, 서울중앙지검은 계좌추적 등을 통해 이 돈의 출처를 파악하기 위해 대검찰청으로부터 자금추적 전문 수사인력을 파견받았다.

한편, 검찰은 박 교수 측과 후보 사퇴에 따른 금전적 대가 지급을 위한 이면합의를 하고 박 교수에게 돈을 전달하는 데 관여한 곽 교육감 측 일부 인사에 대해서도 적극적인 공모사실이 인정되면 공직선거법상 후보매수죄의 공범으로 기소하는 방안을 검토 중이다.
