Lawmakers sentenced for illegal donations

An opposition lawmaker was fined on Wednesday for receiving illegal political donations from a security guard association that sought favorable legislation.

The Seoul Northern District Court ordered Democratic Party Representative Choe Kyoo-sik to pay a 5 million won ($4,198) fine for receiving 50 million won from Cheongmok Club, the security guards’ association, in breach of the Political Fund Law.

He was also ordered to forfeit the sum he took from the trade association.

The latest court decision put the two-term lawmaker in danger of losing his parliamentary seat. A lawmaker loses his or her seat if fined 1 million won or more for breaching the Political Fund Law. Choe said he would appeal the decision.

The court also slapped Representative Kang Gi-jung, another DP lawmaker, with a fine of 900,000 won with restitution of 9.9 million won.

Representative Lee Myung-soo from the Liberty Forward Party and three ruling Grand National Party lawmakers - Representatives Kwon Kyung-seok, Yoo Jeong-hyeon and Cho Jin-hyung - were all given a suspended fine ranging from 1 million to 2 million won.

The six lawmakers, all members of the National Assembly’s Public Administration and Security Committee, were indicted in January after receiving illegal funds from the security guard association, which was lobbying for a bill aimed at raising their wages and delaying their retirement age.

In court testimony held last December, 51-year-old Cheongmok Club executive Kim Yeong-il said that he had given a 37.5-gram gold key worth about 2 million won and gift certificates to Choe. Representative Lee Myoung-soo of the LFP received about 1.5 million won through his aide.

The bill was approved last November at the National Assembly and went into effect in February.

서울북부지법 형사11부 강을환 부장판사는 5일 청목회 사건으로 기소된 국회의원 6명에게 유죄 판결을 내리면서 “법 개정을 대가로 돈을 받지는 않았더라도 이익단체의 돈을 공무원 업무 청탁과 관련해 받은 것 자체가 잘못됐다”고 밝혔다.

 이날 의원직 상실형에 해당하는 벌금 500만원을 선고받은 최규식 민주당 의원 등은 청원경찰 친목 단체인 청목회로부터 처우 개선을 위해 법을 개정해 달라는 청탁과 함께 불법 후원금을 받은 혐의로 기소됐다. 돈을 주고받은 뒤 법을 고치려 했다 해서 입법로비라는 비난도 있었다. 하지만 재판부는 “의원들이 청원경찰의 처우 개선이 필요하다는 것에 공감하고 이미 개정안 통과에 나선 상황에서 후원금이 들어왔다”고 판단했다. 이어 “의원들이 먼저 돈을 요구하지도 않았고 후원금을 정상적으로 회계 처리했으며 선거관리위원회에도 보고했다”고 설명했다. 따라서 “받은 후원금이 5000만원에 이르고 법 개정 과정에서 청목회 간부들과 밀접한 관계를 유지한 최규식 의원을 제외한 나머지 의원들에게 의원직 상실형을 선고하는 것은 가혹하다”고 밝혔다.

 자유선진당 이명수 의원과 한나라당 권경석·유정현·조진형 의원에게 선고유예 판결이 내려진 것도 이 때문이다. 선고유예 판결을 하려면 형벌이 징역 1년 이하여야 하고 자격정지 이상의 형을 받은 적이 없어야 한다. 하지만 민주당 강기정 의원은 1985년 국가보안법 위반으로 징역 7년에 자격정지 5년이 선고된 경력 등이 있어 선고유예 대상에서 제외됐다. 이에 대해 박지원 민주당 원내대표는 "야당은 (받은)액수가 적은데 벌금형을 선고하고 여당은 선고유예했다”며 "여당무죄 야당유죄의 전형”이라고 지적했다.
