FTC fines 12 insurance companies for rate fixing

Korea’s antitrust agency slapped 12 life insurance companies with hefty fines for illegally fixing interest rates for years.

The Fair Trade Commission announced yesterday that it imposed a total of 365.3 billion won ($316 million) in fines on 12 life insurers for colluding to fix interest rates that affect premiums on their products, including whole-life, pension and education policies.

The insurers were engaged in illegal rate fixing, which took place between 2001 and 2006, in order to retain clients and remain competitive by lowering interest rates on their products.

The companies include Samsung Life Insurance, Kyobo Life Insurance and Korea Life Insurance, the country’s top three life insurers that together control 51.4 percent of the insurance premium market. Other major companies include Mirae Asset Life Insurance, Shinhan Life Insurance, Tong Yang Life Insurance and KDB Life Insurance.

Samsung Life received the largest fine, 157.8 billion won, followed by Kyobo Life with 134.2 billion won and Korea Life with 48.6 billion won. The others received fines ranging from 1.1 billion won to 6.6 billion won, according to the FTC.

The FTC accused them of meeting with each other to negotiate desirable interest rates that would help each maintain market share and overall profitability. The expected interest rate is a key factor in determining insurance premiums. A 1 percentage point difference can make up to 36 percent of the amount of the premiums.

The companies had communicated through “diversified negotiation channels,” both official and nonofficial, including personal phone calls, according to the commission.

Six insurers, including Samsung Life, Kyobo Life and Korea Life, initially started colluding and then invited others to join them.

The watchdog wants to root out a long-held practice of companies fixing rates to prevent falls in their profitability, the FTC said.

The life insurers had official channels to confer about the authorities’ financial rules and systems and also unofficial ones to discuss ways to sell their products and retain clients, the FTC analyzed.

In response to the FTC’s accusation, an industry official said, “The meetings are simply for promoting friendship among working-level officials in the same industry and for observing trends. It is an exaggeration to call them collusion.”

Samsung Life, the country’s largest insurer, made no comment and neither admitted nor denied the practice.

“We will announce our official stance once the commission delivers us a document stating the formal fine,” said a company official.

공정거래위원회는 보험 상품의 이율을 담합한 16개 생명보험사들에 3653억원의 과징금을 부과했다고 14일 밝혔다. 보험 가입자들에게 지급하기 위한 적립금을 쌓는 기준으로 삼는 이율을 5년간 서로 짜고 낮게 유지했다는 것이다.

 생명보험사별 과징금은 삼성생명 1578억원을 비롯해 ▶교보 1342억원 ▶대한 486억원 ▶알리안츠 66억원 ▶흥국생명 43억원 ▶신한 33억원 ▶동양 24억원 ▶AIA 23억원 ▶미래에셋 21억원 ▶ING 17억원 ▶메트라이프 11억원 ▶KDB 9억원 등이다. 나머지 동부·우리아비바·녹십자·푸르덴셜생명 등 4개 사에는 시정명령만 내려졌다.

 공정위에 따르면 이들 업체는 2001~2006년 개인보험상품(종신·연금·교육 보험 등)의 예정이율과 공시이율을 서로 합의해 결정했다.

 김순종 공정위 카르텔조사국장은 “2000년 4월 보험가격이 자유화돼 자율적으로 이율을 정할 수 있었지만 생명보험사는 경쟁을 통해 수익이 줄어드는 것을 막기 위해 장기간 담합을 해온 것”이라고 말했다.

 3653억원의 과징금은 보험사에 부과된 것으로는 역대 최대다. 그러나 삼성·교보·대한생명 등 대형사는 ‘담합 자진신고자 감면제도’(리니언시)에 따라 부과된 과징금의 상당액을 감면받을 것으로 알려져 실제 생명보험사들에 부과되는 과징금은 1000억원대에 그칠 것이란 추정이 나온다. 업계에 따르면 가장 먼저 자진신고한 교보생명은 과징금 전액을 면제받고, 삼성생명과 대한생명도 자진신고와 조사에 적극적으로 협력해 상당액을 감면받을 전망이다. 이 때문에 담합을 주도한 대형사는 빠지고 ‘종범’인 중소형 보험사들이 집중적으로 제재를 받는 사태가 벌어져 논란이 일고 있다. 앞으로 보험가입자가 공정위의 결정을 근거로 생보사를 상대로 직접 손해배상 소송을 제기할 가능성도 있어 또 다른 후폭풍이 불 수 있다.

 보험사가 이처럼 경쟁을 피한 것은 이율이 보험 가격에 미치는 영향이 그만큼 크기 때문이란 게 공정위의 해석이다. 확정금리형 상품의 경우 보험료는 크게 보험금이 지급될 확률을 통해 계산한 금액에서 보험사가 부담해야 할 이자(예정이율로 계산)를 뺀 금액으로 결정된다. 자연히 예정이율이 높을수록 보험 가입자가 내야 할 보험료는 낮아진다. 공정위에 따르면 이 이율이 1%포인트만 바뀌어도 보험료는 8~36% 차이가 나타난다.

 생보사들은 억울하다는 입장이다. 한 업계 관계자는 “업계의 과당 경쟁으로 재무건전성이 악화될 것을 우려한 금융당국이 ‘표준 이율’을 제시해 왔는데, 이를 따라간 것을 담합으로 모는 것은 무리한 처사”라고 말했다.
