Korean Air pilot is suspected of supporting North

A Korean Air pilot is under investigation on suspicions of engaging in pro-North Korea activities in violation of the National Security Law, the Seoul Central District Prosecutors’ Office said yesterday.

Prosecutors said they raided the home of the pilot, surnamed Kim, 45, and seized his computer hard drive and several documents that praised Kim Jong-il, the leader of North Korea.

The pilot has been barred from leaving the country, and prosecutors have asked Korean Air to prohibit Kim from piloting in case he attempts to fly to the North.

The case stemmed from prosecutors’ investigation into members of a pro-Pyongyang Web site, called Cyber Command for National Defense, of which Kim was a member.

On the Web site, which authorities shut down last year, Kim was a consistent supporter of North Korea, praising the regime in several posts, prosecutors said.

“We determined that Kim’s activities were way beyond a curiosity,” a prosecutor said. “Kim has continuously posted and propagandized pro-Pyongyang messages for a long time, so we told Korean Air to prohibit Kim’s entire operations as a pilot because we judged that there was a possibility of him flying planes to North Korea.”

Prosecutors said that Kim could be charged for praising and promoting pro-Pyongyang ideology, acts that are banned by the National Security Law.

Prosecutors also raided the office of Cyber Command for National Defense last week and seized data from the Web site’s server, identifying 10 main suspects from secure data.

The Web site had 6,500 members, and more than 600 of them were considered to be core members. Among the membership roster, prosecutors said, were several South Korean soldiers and military officers as well as officials from several large companies based in Seoul.

Cyber Command for National Defense was started by a 43-year-old man surnamed Hwang on the portal site Naver. Charged with violating the National Security Law, Hwang praised Kim Jong-il at his trial in September, saying, “Kim Jong-il and Kim Il Sung are the leader and father of our people and the heroes of our race.”

The Web site’s members opened another site on Daum in July called Temporary Cyber Command for National Defense after the original site was closed down.

Prosecutors said they planned on cracking down on pro-North Korea activities that violate the National Security Law amid growing concern that such activities have increased in the last decade.

Analysts said the initiative reflects Prosecutor General Han Sang-dae’s stated goal of stopping pro-Pyongyang influences.

서울중앙지검 공안1부는 18일 종북(從北) 사이트인 ‘사이버민족방위사령부’에 가입해 활동한 혐의로 현직 대한항공 조종사 김모(45)씨의 거주지를 압수수색해 개인용 컴퓨터 하드디스크와 북한체제 찬양 내용을 담은 문서 등을 확보했다. 검찰은 김씨를 출국금지시키고, 대한항공 측에 “김씨가 항공기 운항을 하지 못하도록 조치하라”고 통보한 것으로 알려졌다.

검찰 관계자는 “한국항공대 출신인 김씨가 호기심 차원을 넘어 지속적으로 북한체제를 옹호하고 선전하는 글을 올렸다”며 “항공기를 북한으로 몰고 가는 등 돌발행동을 할 수 있다고 판단해 김씨에 대한 조치를 요청했다”고 말했다.

검찰은 김씨에 대해 국가보안법상 찬양·고무 규정을 적용하기로 했다. 앞서 검찰은 지난주 ‘사이버민족방위사령부’의 서버에 대한 압수수색영장을 법원으로부터 발부받아 서버에 보관돼 있는 자료를 확보했다. 검찰은 자료 분석과 함께 북한 체제 찬양 글을 지속적으로 올린 10여 명을 대상으로 수사를 진행 중이다. 검찰은 사이트 회원 6500여 명 가운데 600명가량이 핵심 회원인 것으로 보고 있다. 핵심 회원 중에는 육군3사관학교 출신 현직 장교와 대기업 직원 등도 포함돼 있는 것으로 전해졌다.

‘사이버민족방위사령부’는 지난 6월 국가보안법 위반 혐의로 기소돼 재판을 받던 도중 “김정일 장군 만세”를 외쳐 논란을 빚은 황모(43)씨가 포털사이트 네이버 카페에 개설했다. 현재 이 카페는 수사기관 요청으로 접속이 차단돼 있으나, 지난 7월 포털사이트 다음에 ‘임시사이버민족방위사령부’라는 이름으로 다시 개설돼 운영 중이다.

검찰은 지난 10년 동안 국가보안법상 찬양·고무 규정이 사실상 사문화돼 자발적인 종북 세력이 증가했다고 판단, 앞으로 이 혐의를 적극 적용할 방침이다. 취임 당시 ‘종북 좌파와의 전쟁’을 선포한 한상대 검찰총장이 공안사건에 대해 본격적인 드라이브를 걸고 있는 것이다.

검찰은 10·26 재·보궐 선거가 끝나는 대로 국가정보원·경찰·방송통신위원회 등과 함께 종북 사이트에서 이뤄지고 있는 북한 찬양행위를 집중 단속하기로 했다.

◆국가보안법 찬양·고무=국가보안법 제7조 제1항은 반국가단체나 그 구성원 또는 그 지령을 받은 자의 활동을 찬양·고무·선전 또는 이에 동조하거나 국가 변란을 선전·선동한 경우 7년 이하 징역에 처하도록 하고 있다. 그간 처벌 대상이 모호하다는 비판이 제기됐으나 헌법재판소는 1999년과 2004년 합헌 결정을 했다.
