Sambu may have bribed Kazakhstan authorities

Sambu Construction is under investigation by prosecutors on suspicion of bribing high-ranking government officials in Kazakhstan to win a lawsuit filed by a major shareholder of a former subcontractor, CNP.

The Seoul Central District Prosecutors’ Office confirmed on Monday that Sambu was suspected of giving more than 3 billion won ($2.64 million) to several legal authorities in Kazakhstan to gain an edge in a lawsuit filed in 2008 by CNP’s second-largest shareholder, surnamed Shin.

Shin claimed that Sambu had acquired CNP illegally by purchasing the stake of CNP’s biggest shareholder, surnamed Park, at a discount. The lawsuit also alleged that Sambu and Park plotted the transactions to take over CNP. Sambu had a $1.2 billion construction project in Almaty, Kazakhstan, at the time, with CNP as one of its subcontractors.

Prosecutors said they secured expenditure records stating that about 3 billion won was given to Kazakhstani prosecutors, judges, police officials and politicians in return for helping Sambu win the case. Of the more than 3 billion won, prosecutors said, 1.3 billion won was given to high-ranking judges and prosecutors, 140 million won to police officials and about 2 billion won to several politicians.

The records were found after prosecutors raided Sambu’s headquarters in Jung District, central Seoul, on Oct. 6 for another investigation into allegations of embezzlement.

Sambu is suspected of engaging in bribery after its construction project encountered financial difficulties, prosecutors said.

Some high-ranking Korean government officials are also believed to be involved in the case because the expenditure records state that about 500 million won was handed out in return for introducing them to Kazakhstani politicians.

Prosecutors said they planned to summon Sambu officials for questioning soon in order to verify the records.

Prosecutors also said that they were considering taking legal action based on the OECD Convention on Combating Bribery of Foreign Public Officials in International Business Transactions, a legally binding standard, if the company’s expenditure records are verified.

Sambu Construction is Korea’s first licensed construction company, founded in 1948.

30억 누가 받았나… 카자흐에 삼부토건 불똥

알마티시 재개발 사업 관련, 고위 판검사·경찰 등에 로비 의혹

검찰은 삼부토건이 카자흐스탄 법조계 고위 인사 등에게 30여억원대 금품 로비를 했다는 내용이 담긴 문건을 확보하고 사실 확인에 나섰다.

카자흐스탄 정계 실력자도 로비 대상에 포함됐고, 이 과정에 국내 유력 인사가 관여했다는 정황도 나타나 주목된다.

　18일 검찰과 건설업계 등에 따르면 서울중앙지검 특수2부는 최근 삼부토건 압수수색 과정에서 이 회사 카자흐스탄 법인의 현지 사업 관련 지출 내역서를 확보했다. 검찰은 지난 6일 삼부토건 임직원이 수백억원대 횡령을 했다는 정황을 잡고 삼부토건 본사 등을 압수수색했다.

　삼부토건은 2006년부터 카자흐스탄에서 12억 달러 규모의 알마티시(市) 업무중심지구 내 복합주거단지 재개발사업 등을 진행해오고 있다. 그러나 삼부토건이 2008년 이 사업 시행사 CNP를 인수한 직후 CNP의 2대 주주 신모씨는 “삼부토건이 최대주주 박모씨와 짜고 CNP 지분을 헐값에 매입했다”며 법원에 소송을 제기했다. 또 경찰에 삼부토건 카자흐스탄 법인장 등을 고소하면서 사업 진행에 상당한 차질이 생긴 상태였다.

　검찰이 확보한 문건에는 삼부토건이 당시 제기된 각종 소송과 관련해 카자흐스탄 1, 2심 법원과 대법원의 최고위급 관계자, 담당 부장판사 등에게 모두 13억여원을 준 것으로 기재돼 있다. 카자흐스탄 경찰청과 알마티시 경찰청의 국장급 인사 등 간부들과 사건 담당 경찰관들에게도 1억4000여만원이 전달된 것으로 돼 있다. 또 이 사건 담당 검사는 1000여만원을 받은 것으로 명시돼 있다.

　문건에는 돈을 건넨 명목도 구체적으로 제시돼 있다. 판사들에게는 삼부토건 측이 소송에서 승소할 수 있도록 해주고, 소송 상대방의 배후세력이 가해올 수 있는 압력을 차단해 달라는 등의 명목으로 돈이 전달됐다. 경찰과 검찰에 대해서는 카자흐스탄 법인장 등 형사 고소된 삼부토건 관계자들에 대한 무혐의 처분과 초기 수사 과정에서의 편의 제공 등을 받기 위해 돈을 준 것으로 돼 있다. 특히 카자흐스탄 정계 실력자 등에게 20여억원을 줬으며, 이 과정에 관여한 한국 유력 인사에게도 5억원가량을 줬다는 내용이 포함돼 있다.

　검찰은 카자흐스탄의 정계 실력자와 선이 닿을 수 있는 정부 고위급 인사가 관여했을 가능성도 있다고 보고 조만간 삼부토건 관계자들을 불러 조사할 방침이다. 검찰은 이들을 상대로 카자흐스탄과 국내 고위 인사들에게 실제 금품이 전달됐는지를 추궁하는 한편 일부 자금이 다른 용도로 빼돌려졌을 가능성에 대해서도 조사하기로 했다.

　검찰은 문건 기재 내용이 사실로 확인될 경우 경제협력개발기구(OECD) 뇌물방지협약에 따라 사건 관련자들을 뇌물 등 혐의로 사법처리하는 방안을 검토 중인 것으로 알려졌다.

인천지검 특수부는 지난 5월 중국 국영 항공사의 한국지사장인 중국인 H씨와 그에게 돈을 건넨 국내 여행사 대표 등 3명을 기소한 바 있다.

◆OECD 뇌물방지협약=정식 명칭은 ‘국제 상거래에 있어서 외국 공무원에 대한 뇌물 제공 행위 방지를 위한 협약’이다. 1997년 제정됐으며 우리나라는 이 협약의 국내 이행 법률인 국제상거래뇌물방지법을 만들어 99년 2월부터 시행하고 있다. 이 법에 따라 사업상 부정한 이익을 얻기 위해 외국 공무원에게 뇌물을 제공하거나 제공을 약속한 경우 처벌을 받게 된다.
