China may try South’s spies

China is getting hard-nosed about South Korean secret agents caught spying in areas near North Korea, probably on behalf of Pyongyang.

In October 2010, China arrested two South Koreans working for the National Intelligence Service for alleged information gathering, which it said their visas didn’t allow. They have been in custody ever since.

The information they were collecting is known to relate to high-ranking defectors from the North.

Their case has been handed over to a court in Shenyang, Liaoning Province, a source told the JoongAng Ilbo, and they could be sentenced to 10 years in prison or longer unless a compromise is negotiated, the source said.

And now China is demanding a written apology from the head of the NIS for the alleged illegal intelligence activities of the two NIS officials.

“Ahead of the judiciary proceeding, China’s security authorities are expressing an adamant stance that the NIS head should apologize in a written statement,” said the source, who is familiar with North Korea and China affairs. “That has bogged down negotiations to earn their release.”

The NIS has suggested the usual procedure in such cases: that an assistant-director-level NIS official visit China to express regret, after which China would deport them to Korea. China rejected that proposal.

“Holding a number of intelligence agents in custody for a long time and making such an excessive demand as a written apology from the intelligence agency of the country is out of the norm and not easy to accept,” said the source.

China arrested around 30 South Koreans for alleged information gathering in July 1997 but released them all by deporting them.

But in July 2009, China’s Ministry of Public Security indicted a South Korean major surnamed Jo of the Army Intelligence Unit for illegal intelligence activities, incarcerated him for over a year and deported him in September 2010.

According to diplomatic analysts, China’s tougher posture is in response to complaints from Pyongyang about the South’s increased intelligence activities in Chinese territory near the border with North Korea.

China sent Meng Jianzhu, its minister of public security, to Pyongyang in February, the first visit by China’s security chief to North Korea since Kim Jong-il became leader. North Korea’s official Korean Central News Agency said Kim said at the time that the cooperative relation on security issues between the countries would develop further.

A detention of the two South Koreans and stiff demands by China is meant to “tame the intelligence activities of the South,” the source said.

The source said the government has to strive for their release. “If the government does not act for them,” the source said, “who would be willing to volunteer to work for the country in the future?”

“원세훈 사과하라” … 중국의 오버

국정원 요원 2명 1년째 억류 … 한·중 정보기관 사이에 무슨 일이

중국 동북 3성 지역인 랴오닝(遼寧)성에서 정보 활동을 했다는 이유로 한국 정보기관 요원이 현지에서 체포된 사건(본지 7월 21일자 1면 보도)과 관련해 중국 당국이 원세훈 국가정보원장의 사과를 요구하고 있는 것으로 알려졌다.

대북 정보소식통은 19일 “중국 정보기관인 국가안전부(MMS)가 자신들이 억류 중인 국정원 직원 2명의 사법처리를 앞두고 국정원장이 서면으로 사과해야 한다는 강경한 입장을 나타내고 있다”며 “이 때문에 중국과의 석방 협의가 교착상태에 빠져 있다”고 말했다. 중국은 지난해 10월 체류 목적을 벗어나 정보활동을 했다는 이유로 국정원 직원 2명을 체포해 1년 동안 구금해놓고 있다.

　소식통은 “중국 측은 억류된 한국 정보요원에 대한 재판 절차를 곧 진행할 예정인 것으로 안다”며 “국정원장의 사과 등 한국 정부의 조치가 없을 경우 10년 이상의 중형이 불가피하다는 입장을 밝히고 있다”고 전했다. 정보 활동을 둘러싸고 정보요원 억류 등 불미스러운 사건이 발생했을 경우, 관련국의 정보 당국 차장급 인사가 상대국에 서면으로 유감을 표시하는 선에서 해결되는 게 국제사회의 일반적 관행이다.

　중국에 억류 중인 2명의 정보요원은 한국행을 원하는 중국 내 주요 탈북자의 실태 파악과 같은 활동을 해온 것으로 전해졌다. 중국 측이 체포와 장기 억류라는 전례 없이 강도 높은 대응에 나선 배경에는 북·중 공안기관 사이의 끈끈한 관계가 작용한 것으로 분석되고 있다. 북·중 국경지역에서 한국 정보요원들의 대북 정보활동이 강화되고 있다고 판단한 북한 국가안전보위부가 중국 측에 문제를 제기한 데 따른 기류 변화라는 얘기다. 중국은 김정일 체제 출범 이후 처음으로 지난 2월 멍젠주(孟建柱) 국무위원 겸 공안부장을 평양으로 파견했고, 김정일은 “무력 및 안전 부문 사이의 전통적인 친선협조 관계가 날로 발전할 것”이라며 기대를 나타낸 것으로 북한 관영 조선중앙통신이 보도한 바 있다. 중국 공안당국은 2년 전에도 랴오닝성 선양에 머물던 한국군 정보기관 소속 조모 소령을 체포해 3년형을 선고했다. 조 소령은 1년 넘게 복역한 뒤 지난해 9월 잡범들과 함께 범죄인 인도 형식으로 한국 측에 넘겨졌다.
