A litmus test for Assembly reform
The Assembly will cast votes tomorrow on whether to arrest independent lawmaker Park Joo-sun and Saenuri Party lawmaker Chung Doo-un for charges of vote rigging and taking bribes, respectively./ 국회는 각각 투표 부정과 뇌물수수 혐의를 받고 있는 무소속 박주선 의원과 새누리당 정두언 의원에 대한 체포 동의안에 대한 투표를 내일 할 예정이다/ The first “free vote” on the fate of their colleagues in the new Assembly will be a litmus test for legislative reform./ 새 국회에서 자신들의 동료의 운명에 관한 첫 번째 “자유 투표”는 입법부의 개혁을 위한 시금석이 될 것이다/Both the ruling and opposition camps have vied for relinquishing their privileges as lawmakers - including a drastic cut of their post-retirement pension and toughening the role of the Special Committee on Ethics./ 여야는 은퇴 후 연금을 대폭 삭감하고 특별 윤리위원회의 역할을 강화하는 것을 포함한 의원의 특권을 포기하기 위해 앞을 다투고 있다/ Their reform agendas also include their cherished prerogative of immunity from arrest./ 그들의 개혁 아젠다는 또한 그들에게 소중한 불체포특권도 포함하고 있다/ The ruling Saenuri Party has vowed to give it up and the main opposition Democratic United Party pledged to hold a public hearing on the issue./ 여당인 새누리당은 그것을 포기하기로 공약을 했고 주요 야당인 통합 민주당은 그 문제에 관한 공청회를 열기로 약속했다/
Starting with the 17th-century British Parliament, lawmakers’ privilege of exemption from apprehension was aimed at protecting representative politics from unnecessary interruptions through the process of seeking their approval on arrest during parliamentary sessions./ 17세기 영국 의회에서 시작한 의원의 불체포특권은 의회 회기 중의 구속은 의회의 동의를 얻도록 함으로써 불필요한 중단으로부터 대의 정치를 보호하기 위한 것이었다/ In the past, it could shield anti-government legislators from arrest by an authoritarian regime./ 과거에는 권위주의적인 체제에 의한 체포로부터 반정부 의원을 보호하는 방패역할을 했다/ As such worries have now almost disappeared, the legislature should comply with the judiciary’s request if it is based on solid evidence./ 그러나 그러한 우려는 이제 거의 사라졌고 입법부는 만약 견실한 증거를 바탕으로 할 경우 사법부의 요청에 응해야만 한다/
In fact, the prerogative has often been abused to protect colleagues regardless of wrongdoing./ 실은 불체포특권은 불법적인 행위와 상관없이 동료들을 보호하기 위해 종종 남용되어 왔다/ Thus, only nine out of 45 requests for consent on arrests were approved due to parties’ stratagems or emotional ties, damaging public trust./ 따라서 체포동의안 45건 중에 단지 9건만이 가결되었는데, 정당의 전략 또는 감정적 유대 때문이며 공공의 신뢰를 해칠 것이라고 생각하기 때문이었다/
Representative Park was sentenced to two years in prison in the first trial on charges of rigging the mobile vote ahead of the April election./ 박 의원은 지난 4월 총선에서 모바일 투표 부정을 저지른 혐의로 1심에서 징역 2년을 선고 받았다/ Some lawmakers assert the court’s arrest request should be shelved as he appealed to a higher court./ 일부 의원은 박 의원이 고등법원에 항소를 했기 때문에 법원의 체포동의는 유보해야 한다고 주장하고 있다/ But the first trial’s sentence should be implemented as it says and the lawmakers must cooperate to restore the judicial system./ 그러나 1심의 판결은 1심대로 효력이 집행되어야 하며 의원들도 사법체계의 회복을 위해서 협조해야 한다/
Representative Chung is under suspicion of having been on the scene when Lee Sang-deuk, elder brother of President Lee Myung-bak, took bribes of 300 million won ($263,100) from a CEO of an embattled savings bank and loaded the money bag into his car trunk./ 정 의원은 이명박 대통령의 형인 이상득 의원이 궁지에 몰린 저축은행 CEO로부터 3억 원의 뇌물을 받을 때 현장에 있었고 그 돈을 그의 자동차 트렁크에 실은 혐의를 받고 있다/ He also faces charges of taking 100 million won in bribes from the same CEO./ 그는 또한 같은 CEO로부터 1억 원의 뇌물을 받은 혐의를 받고 있다/ Representatives must treat the judiciary’s request to arrest their peers like an arrest on ordinary citizens./ 국회의원들은 사법부의 그들의 동료에 대한 체포동의안을 일반 시민에 관한 체포와 마찬가지로 처리해야 한다/ The same standards should also be applied to DUP floor leader Park Jie-won who’s under investigation for savings bank corruption./ 동일한 기준은 또한 저축은행 부패와 관련하여 조사를 받고 있는 민주통합당 원내대표 박지원 의원에게도 적용되어야 한다/
