Addressing some basic needs

Sex crimes committed by senior citizens against the weak cannot be ignored anymore. In a small village in Tongyeong, South Gyeongsang, a woman with a mental disability has for many years been prey to sexual assaults by a group of residents in their 60s and 70s. In a small town in South Jeolla, as many as 10 men in the same age range were indicted for their persistent sexual violence against another mentally handicapped woman.

Sex crimes by senior citizens ring sharp alarm bells. According to police statistics, the number of sexual predators in their 60s soared to 809 last year from 481 in 2007, while the statistic for people in their 70s rose to 268 last year from 193 four years earlier. A drastic increase of sexual offenses in the sexagenarian group is particularly noticeable.

The alarming increase in sex crimes by older people - which owes something to better health conditions in an aging society - is a very serious issue as it often takes place in blind spots according to the report by the Supreme Prosecutors’ Office that says such predators target the socially weak, such as children and mentally handicapped women.

Public ignorance about old people’s sexual impulses also contributes to the situation. A recent survey on their sex lives by the Ministry of Health and Welfare shows that two-thirds of senior citizens are still sexually active, with 35.4 percent of them buying sex. Yet our society turns a blind eye to their sexual desires by dismissing them as an asexual group, which exacerbates their social isolation and intensifies their sexual drive.

Government agencies, including the Ministry of Gender Equality and Family, have not studied and analyzed what’s happening around them. Older people’s sex crimes can hardly be solved by strict punishment alone. The government must come up with a comprehensive set of policies that addresses senior citizens’ needs, but also protects vulnerable class of citizens.

급격히 증가하는 노인 성범죄에
성적 약자인 어린이·장애인 피해
‘노인의 성’ 등 고려한 대책 필요

이제 우리 사회가 노인들이 저지르는 성(性)범죄를 더 이상 방치해선 안 될 때가 됐다. 경남 통영의 한 마을에선 현재 60~70대 노인들이 같은 마을에 사는 지적장애 여성을 수년간 지속적으로 성폭행한 혐의로 조사를 받고 있다. 이런 유형의 사건은 지난해 전남 장흥에서도 일어나 동네 지적장애 여성을 성폭행한 10여 명의 60~70대 남성들이 줄줄이 기소되기도 했다. 부산에서도 70대 남성이 이웃집 시각장애 여성을 1년여 간 성폭행하다 뒤늦게 안 여성 부모의 신고로 덜미를 잡히기도 했다.
노인 성범죄는 최근 들어 드물게 일어나는 사건이 아니다. 경찰청에 따르면, 지난해 성폭력 가해자 중 60대(61~70세)가 809건, 71세 이상이 268건으로 집계됐다. 이는 2007년 481건(60대)과 193(71세 이상)에 비해 크게 늘어난 것이며, 특히 60대 성범죄 건수는 최근 3년간 더욱 가파르게 증가하고 있다. 이는 고령화사회로 접어들면서 신체적으로 건강하고 젊어진 노인 인구가 크게 늘어나는 데 따른 현상으로 분석된다.
그 중에서도 노인 성범죄는 우리 사회의 관심권 밖에서 일어난다는 데 심각성이 있다. 대검찰청 관계자는 “노인 성범죄는 어린이와 지적장애 여성 등 성적 약자를 대상으로 집요하고 지속적으로 자행되는 경우가 많은 게 가장 큰 문제”라고 지적했다. 이번 통영사건도 2004~2008년 4년여 간 표현능력이 떨어지는 지적장애 여성을 상대로 저질러졌다.
또 우리 사회의 ‘노인의 성’에 대한 전반적인 무지로 인해 노인의 성적 충동과 성 범죄의 잠재성을 제대로 인식하지 못하는 틈새에서 범죄가 일어나고 있다는 것이다. 올 초 보건복지부가 발표한 ‘노인의 성생활 실태조사’에 따르면, 노인의 3분의2가 성생활을 하고 있으며, 35.4%가 성매수를 하는 등 성적 욕구가 여전함을 보여준다. 그럼에도 우리 사회는 여전히 노인의 성문제를 외면하고 있어 노인들이 성적 소외에 내몰리고 있다. 이 밖에도 성범죄는 성적 욕구뿐 아니라 사회적 고립감 때문에 자행되는 경우가 많아 독거 노인의 증가와 함께 더욱 늘어날 소지가 있다는 점도 문제다.
이렇게 노인의 성범죄는 다른 연령대의 성범죄와는 다른 양상을 보인다. 하지만 여성가족부 등 성폭력을 다루는 기관들도 이에 대한 실태분석과 연구가 전무한 실정이다. 노인 성범죄는 단순히 ‘엄벌주의’만으로는 해결하기 어렵다. 노인의 성과 고립의 문제를 어떻게 풀 것인지 연구하는 한편, 남성 노인들이 밀집한 농촌 지역 등에 사는 성적 약자들의 보호 대책까지 아우르는 새로운 대책이 요구된다.
