Spot checks are iffy
The National Police Agency has announced it will press ahead with spot checks of suspicious persons to prevent violent, random crimes and sexual offenses against children./ 경찰청은 폭력과 묻지마 범죄 그리고 아동에 대한 성범죄를 예방하기 위해 의심이 가는 사람에 대한 불심검문을 강행할 것이라고 밝혔다/ The move, if put into action, will lead to a resumption after two years of a widespread practice that was almost stopped after the National Human Rights Commission said it was infringing on people’s basic human rights./ 만약 불심검문을 하게 되면 국가인권위원회가 국민의 기본 인권을 제한할 수도 있다고 말한 이후 거의 시행하지 않았던 광범위한 관행을 2년 만에 재개하는 셈이 되는 것이다/ Law enforcement agencies should approach the issue carefully./ 법 집행 기관은 이 문제에 관해 조심스럽게 접근해야만 한다/In the past, police officers could stop and question someone on the street if he or she looked suspicious./ 과거에 경찰은 만약 의심스러워 보이면 길거리에서 의심이 가는 그 사람을 멈춰 세워 불심검문을 할 수 있었다/ Article 3 of the current police law says policemen can do so when there is reasonable grounds to suspect that the person is about to commit a crime or is aware of a criminal act that took place or is about to occur./ 현행 경찰법 제 3조에는 경찰은 범죄를 저지를 것 같은 사람이나 일어났던 범죄 또는 일어날 것 같은 범죄를 알고 있을 것 같은 사람에 대해 합당한 의심이 있을 때는 경찰은 불심검문을 할 수 있도록 하고 있다/
According to the law, police officers can ask that person to go to the police station but he or she can refuse to answer or comply with the request./ 법에 따르면 경찰은 경찰서로 임의 동행을 요청할 수도 있고 불심검문을 당한 사람은 대답을 거부하거나 동행요구를 거부할 수도 있다/ Such discretion is given to strike a balance between the need for protection and to avoid human rights infringement./ 그러한 재량을 둔 것은 보호를 위한 필요성과 인권 침해를 피하기 위한 것 사이에서 균형을 유지하기 위해서이다/ Criticisms of the practice were mostly based on an assessment that law enforcement officers resorted to power abuse without solid grounds for suspicion./ 불심검문이 비판을 받는 것은 대다수 법을 집행하는 사람들이 의심에 대한 확실한 근거도 없이 권력을 남용했기 때문이었다/
A written warning from the human rights commission in September 2010 didn’t find fault with the act of random questioning on its own./ 2010년 9월의 인권위원회 서면 경고는 불심검문 자체의 잘못을 지적한 것은 아니었다/ At the time, the commission recommended the head of a police station educate his subordinates about the regulation in detail in a written warning, which read: “An act to stop and question people on the street just because they are young does not meet the requirement.”/당시 인권위원회는 “요건을 충족하지 못하는 젊은 사람들이라는 이유만으로 길거리에서 불심검문을 하는 것”에 대해 서면으로 자세히 규정에 대해 경찰 수뇌부가 예하 직원들을 교육시킬 것을 권고했다/ After the National Police Agency announced it would switch from random to selective questioning, police officers on the front lines have voluntarily refrained from the practice./ 경찰청이 일제 검문에서 선별 검문으로 전환하겠다고 밝히자 일선 경찰은 불심검문을 자발적으로 자제해왔다/
We agree to the need for spot checks as a preemptive measure, and police officers must do their duty to ensure citizens’ safety./ 우리는 예방적이고 경찰이 시민의 안전을 보장하기 위한 그들의 의무를 다하기 위한 것으로써 불심검문의 필요성에 동의한다/ At the same time, however, they must not restrict citizens’ freedom of assembly by reviving the unfettered questioning of the past./ 그러나 동시에 과거의 마구잡이식 검문을 부활함으로써 시민의 집회의 자유를 제한해서는 안 된다/ If officers attempt to inspect suspects’ personal possessions for any other reason than finding a deadly weapon, it constitutes breaking the law./만약 경찰이 치명적인 무기를 찾기보다는 다른 이유로 의심스런 사람의 소지품을 검사하는 것은 법을 위반하는 것이다/ The police must devise effective guidelines and reinforce the rules with proper training./ 경찰은 효과적인 지침을 고안하고 적절한 교육을 통해 그 규칙을 강화해야 할 것이다/
