Defining the prime minister’s role

Since direct presidential elections were introduced in 1987, candidates have promised to mitigate centralized executive power. Moon Jae-in, the candidate of the main opposition Democratic United Party, vowed that if he becomes president, he would exercise power strictly within the constitutional and legal jurisdiction and enhance the role of the prime minister to even out executive authority and obligation. Ahn Dae-hee, head of the Saenuri Party’s special committee on political reforms, said the ruling party is working on a proposal to similarly redefine the prime minister’s role and authority. In addition, the two major parties have floated the idea of formally empowering the head of the cabinet.

In the past, promises to enhance the role of the prime minister failed to go beyond the campaign trail. Candidates’ pledges to share executive power went out the window once they were seated in the presidential office.

Moon may have a political motive behind his power-sharing proposal - to draw formidable liberal rival Ahn Cheol-soo into his camp. Moon may have been emboldened by his rising approval rating and is hoping for a graceful concession from Ahn. In return for the software mogul-turned-professor stepping aside and the myriad young voters who would then move to Moon, the DUP candidate is assuring Ahn a share of authority and influence. What ruling party candidate Park Geun-hye fears most is a political marriage between Moon and Ahn. It is why Park’s camp campaigned hard to block a coalition and has not given up courting Ahn.

But marriages of convenience in the political world often go badly. In the 1997 presidential election, dissident candidate Kim Dae-jung joined hands with political adversary Kim Jong-pil with the promise of power sharing. But in less than two years, the coalition fell apart, sending politics and the government into disarray. President Roh Moo-hyun strengthened the role of Prime Minister Lee Hae-chan, but the latter remained legally at the mercy of the president. He had greater say as head of the cabinet only because the president, not the law, allowed it.

If they are serious about enhancing the role of the prime minister, the legislature must revise the law. The law should specify as a constitutional right the prime minister’s authority regarding cabinet appointments by placing the central appointment committee that reviews and recommends appointments of senior officials under the prime minister’s office.



‘안철수 끌어들이기’ 정치공학 아닌가 새누리·민주당 진정성 보이고 싶으면 ‘여당대표가 총리 겸임’ 제도화도 방법      1987년 민주화 이래 대선에 나선 주요 후보들은 자신이 집권하면 이른바 ‘제왕적 대통령의 권한’을 축소하겠다는 공약을 내세웠다. 문재인 민주당 후보는 그제 후보수락연설에서 “대통령이 되면 오로지 헌법과 법률이 정한 권한만을 행사하겠다. 책임총리제를 통해 제왕적 대통령의 권력을 분산하겠다”고 강조했다. 새누리당에선 어제 정치쇄신특위의 안대희 위원장이 “제왕적 대통령의 권한을 분산하기 위해 헌법상 총리의 권한을 보장하는 방안을 검토하고 있다”고 밝혔다. 대선을 90여일 앞둔 시기에 제1,2당이 앞서거니 뒤서거니 책임총리제를 제시한 것이다.
   적어도 지금까지 책임총리제는 대선을 앞둔 선심성 공약에 불과했다. 집권 전 권력을 나누겠다는 후보들의 약속은 막상 대통령이 되고 나면 휴지조각처럼 찢겨졌다. 권력은 둘로 쪼개지지 않는다는 권력의 내재적 속성 때문이기도 하고, 눈앞의 집권에 눈 먼 후보들이 책임총리제의 조건을 진지하게 생각하지 않은 채 성급히 제안했기 때문이다.
   문재인 후보의 책임총리제는 다분히 안철수 교수를 야권후보 단일화의 프레임 속으로 끌어들이려는 정치공학적 의도를 담고 있다. 지지율 상승과 민주당 간판의 이점을 가진 문 후보는 안 교수의 통큰 양보를 기대하고 있는데, 양보의 대가로 실질적 권한과 영향력이 보장된 총리 자리를 안 교수를 위해 준비하겠다는 제안을 한 셈이다. 문 후보와 안 교수의 후보단일화는 박근혜 후보가 가장 피하고 싶은 시나리오다. 그러기에 박 후보 측은 야권후보 단일화 프레임을 무력화하고, 이를 위해 안 교수를 위한 자리를 끝까지 남겨두고 싶은 것이다.
   문제는 정치공학적 의도를 갖고 접근한 책임총리제는 언제나 실패했다는 점이다. 1997년 대선 때 김대중 국민회의 후보는 충청권 표를 얻기 위해 김종필 자민련 총재와 내각제·공동정부·책임총리 협약을 맺어 집권에 성공했으나 2년도 안 지나 맹약(盟約)은 깨지고, 정치권과 정부는 극심한 혼란에 빠져들었다. 2004~2006년 노무현 대통령 시대의 이해찬 국무총리를 책임총리라고 주장하는 사람들도 있지만 총리직 삭탈권이 전적으로 대통령에게 속해 있은데다 장관에 대해 제청·해임권을 행사했다기 보다 그저 상당한 재량권을 누린 정도여서 책임총리라는 말은 성립되지 않는다.
   결국 책임총리제가 성립하려면 대통령의 선한 의도에 기대선 안 되고 총리의 권한과 책임을 보장하는 법·제도적 시스템이 작동해야 한다. 예를 들어 새누리당이나 민주당의 당헌당규나 대선공약에 ‘대통령이 속한 정당의 대표가 국무총리를 겸한다’ 같은 내용을 규정하는 것이다. 실현되기만 하면 한국의 정치문화를 획기적으로 바꾸는 계기가 될 것이다. 아울러 ‘총리의 임면, 권한과 책임에 관한 법률’을 제정할 수 도 있다. 고위공무원 인사를 검증하는 중앙인사위를 총리 산하로 두는 등 헌법 상 총리에게 보장된 고유한 권한을 법률로 구체화하는 것인데 책임총리제의 중대한 진전이 될 수 있다.
