부자에게만 열리는 천국 '조세천국'
어느 틈에 국민 과일이 된 바나나. 2년 전 감귤을 제치고 판매 1위가 됐다는데, 앞날은 더 창창하다고 한다. 부드럽고 뇌졸중 예방에도 좋은 이른바 ‘고령화 과일’이라서란다. 그 바나나를 예로 들어 니컬러스색슨은 『보물섬』에서 ‘조세천국(Tax Heaven)이 왜 나쁜가’ 설명했다. 요약하면 이렇다.‘온두라스 바나나를 수입해 파는 영국 다국적 기업이 있다. 어떻게 세금을 빼먹나. 간단하다. 조세천국 룩셈부르크에 금융회사를 하나 차린다. 그러곤 온두라스 바나나 회사에 돈을 빌려준다. 연간 이자로 2000만 달러씩을 받는다. 온두라스 자회사는 이를 비용으로 처리한다. 번 게 없으니 온두라스 정부는 세금을 물릴 수 없다. 룩셈부르크 금융 자회사는 어떤가. 거의 세금 한 푼 안 내고 2000만 달러를 꿀꺽할 수 있다. 이게 조세천국의 마법이다. 가난한 나라가 바나나를 키워 애써 만든 부(富)가 쉽게 부자 나라로 넘어가는 것이다’.
조세천국은 우리에게도 씁쓸한 기억을 많이 남겼다. 외환위기 전후 한창 떴던 말레이시아의 라부안이 대표적이다. 1990년대 초•중반 금융가엔 ‘라부안에 펀드 하나 없으면 바보’ 소리가 나왔다. 1000만원이면 일주일 만에 회사 하나 뚝딱 차리지, 자본이득세 면제지, 가깝지, 그럴 만했다. 증권•종금사들은 너도나도 ‘종이회사(페이퍼컴퍼니)’를 만든 뒤 빚을 내 외화를 굴렸다. 이게 97년 외환위기를 일으키는 촉매가 됐다. 더 씁쓸한 기억도 있다. 뉴브리지캐피털은 2004년 제일은행을 되팔아 1조1500억원을 챙겼지만 국세청에 세금 한 푼 안 냈다. 라부안 종이회사를 제일은행의 1대주주로 내세운 덕분이다. 라부안은 또 ‘검은 머리 외국인’의 소굴이기도 했다. 주로 국내 대기업과 오너들이 애용했다. 비자금 마련, 주가 띄우기, 경영권 방어 등 다양한 용도로 썼다. 그러다 탈세•횡령으로 쇠고랑을 찬 이도 꽤 된다. 하도 라부안발(發) 말썽이 잦자 정부는 2007년 말레이시아와 협의해 국내에서도 세금을 매길 수 있도록 했다.
라부안 대신 요즘 뜨는 조세천국은 버진아일랜드다. 지난달부터 이어진 국제탐사보도언론인협회의 명단 공개 때문이다. 인구 2만5000명의 이 작은 섬엔 80만 개 넘는 회사가 등록돼 있다. 엊그제는 한국 기업인 세 명의 이름이 공개됐다. 앞으로 매달 공개될 예정이다 보니 자기 이름이 나올까 가슴 졸이는 이가 많다고 한다.
조세천국은 조세피난처(Tax haven)에서 유래돼 같은 의미로 쓰인다. 탈세자에겐 ‘조세피난처=천국’일 테니 그럴 만하다. 이 천국은 부자들에게만 입장권을 준다. 부자가 천국 가기는 낙타가 바늘구멍 통과하기보다 힘들다더니 그래서일까. 부자들이 그들만의 전용 천국, 조세천국을 만들어 낸 건.
