학교급식 파업으로 도시락 구입할 때 반찬 따지면 위법이라고?

지난주 경기도와 충북•전북도에서 학교 비정규직 근로자들이 이틀간 ‘경고 파업’을 벌였다. 경기도교육청에 따르면 노조 측은 호봉제 전환, 상여금 100%, 정액급식비•명절휴가비 등 신설, 공무원과 동일한 제수당 지급 등 363개 항목을 요구하고 있다. 경기도내 파업 참여 근로자 750여 명 중 560여 명이 조리사•영양사•조리실무사 등 학교급식 관계자였다고 한다. 급식이 중단된 학교에선 빵•우유로 대체하거나 부모들이 도시락을 싸 들고 찾아오는 소동이 빚어졌다. 교내 매점도 북새통이었다.

 있을 수 있는 쟁의려니 했다. 그런데 경기도의 초등학교 선생님 몇 분과 대화하다 황당한 말을 들었다. 도교육청이내려보낸 파업대응 매뉴얼 얘기다. 매뉴얼엔 부당노동행위 사례가 예시돼 있단다. ‘파업으로 인해 자녀가 점심을 굶고 있으며, 이는 학교에서 근무하는 조합원들의 파행적 행태 탓’이라고 노조와 조합원을 비판하는 가정통신문을 보내는 행위는 안 된다고 했다. 이해가 된다. ‘급식이 중단됐을 경우 영양사•조리사 등 대체인력을 일용직으로 고용한 경우’와 ‘위탁급식 업체와 계약을 통해 학생들에게 점심을 제공한 경우’도 부당노동행위로 제시돼 있었다. 그러나 배식에 종사하는 조합원들이 낮 12~1시를 휴게시간으로 쓰겠다고, 즉 점심 급식을 일부러 기피하려 할 때 학교장이 오후수업을 이유로 거부해도 부당노동행위로 본 대목은 법에 어두운 나로선 선뜻 납득되지 않았다.

 교육청은 ‘내일 파업 하느냐고 노조 측에 물어보는 행위’도 위법 소지가 크다고 지침을 내렸다. 그렇다면 학교는 다음 날 도시락을 싸올지 빵을 사 먹을지 학부모들에게 미리 알릴 수도 없다는 말일까. 게다가 업체에 단체로 도시락을 주문하더라도 다 만들어진 완성품을 구입해야지, 어떤 반찬을 넣거나 빼달라고 요구해도 안 된다고 했다.

 경기도교육청 담당자에게 확인해보니, 모두가 법적 검토를 거친 내용이라고 했다. 설명을 듣고 보니 과연 ‘노동조합 및 노동관계조정법’ 등 관련법에 따른 조치였다. 그래도 황당하다는 느낌을 지우기 어렵다. 아이들과 학부모의 권리는 어디로 갔는가 하는 의문 때문이다.

노동자가 권리를 찾는 건 당연하지만 다른 권리와 상충되면 어떡해야 할까. 헌법 33조의 노동3권이 중요하다면, 바로 앞 31조의 교육받을 권리는 어디서 찾느냐는 말이다. 이러려고 법을 개정하고 헌법재판소 판단까지 구해가며 학교급식을 위탁에서 전면 직영으로 전환한 건가. “아이들에게 밥 한 끼 먹이자는데 웬 반대냐”며 보편적 무상급식을 관철시킨 이들도 대답 좀 해주면 좋겠다. 다 우리가 낸 세금이 들어가는 일이라서다.

ⓐ switch to annual salary positions → regular salary positions 같이 나열되고 있는 말들이 혜택들로 되어 있으므로 전환을 뜻하는 switch를 없애고 대신 regular라는 표현을 삽입한 것임
ⓑ 100 percent bonus → full bonuses 자연스러운 영어 표현으로
ⓒ fixed meal allowance, vacation bonus → a fixed meal allowance, a vacation bonus 특정한 하나의 사례에는 부정관사 a 사용
ⓓ same allowance → the same allowances same은 지칭하는 것이 명확하므로 늘 the와 함께 쓰임
ⓔ participated → who participated participated를 동사로 본다면 뒤에 included가 동사가 로 쓰이고 있으므로 모순이 생기고 과거분사로 보아도 수동의 뜻이 되므로 어색함, 관계사절로 전환
ⓕ staffs → staff 집합적으로 쓰는 명사로 참모진이나 직원단을 뜻함
ⓖ the meal service → meal services the는 특정한 것을 지칭할 때 사용하는데 여기서는 일반적인 급식을 뜻하므로 the를 생략함, 여러 가지가 있을 수 있는 경우 이므로 s 첨가
ⓗ breads → bread 빵은 기본적으로 세지 않는 명사임
