Top court recalibrates base salaries

대법원은 통상임금을 계산할 때 상여금과 교통비 등 여러 가지 정기 지급금을 포함할 것을 요구하며 회사를 상대로 3년 전에 소송을 제기한 근로자들 편을 들어 판결했다.
The ruling is expected to bring major new costs to companies, especially in retirement payments, overtime and payments for working on holidays, which are all established on base salaries. Around 180 similar suits are in Korean courts from other companies' unions and yesterday's decision is expected to serve as a precedent in those judgments.

이 판결로 회사들은 특히 퇴직금, 시간외 수당, 휴일 근무수당 등 통상임금을 근거로 계산되는 비용을 추가로 많이 지불해야 할 것으로 보인다. 한국 법원에는 다른 회사들의 노조들이 제기한 180여건의 비슷한 소송이 계류 중이고, 어제 판결은 이러한 소송들의 판례로 받아들여질 것으로 보인다.
According to the Supreme Court yesterday, payments that are given by companies to employees on a regular basis like bonuses, corporate payments into employees' four state insurance plans, and expenses for things like meals should be included in calculations of base salaries.
■ on a regular basis: 정기적으로
어제 대법원에 따르면, 상여금, 4대 보험 지급금, 식비 등 회사가 직원들에게 정기적으로 지불하는 지급금은 통상임금 계산에 포함돼야 한다.
"We confirm that any management-labor agreement is against the labor standards law if it excludes regular bonuses from the base salary as they are legally part of the base salary," the court said.
■ labor standards law: 근로기준법
대법원은 "법적으로 통상임금의 일부인 정기 상여금을 통상임금 계산에서 제외하는 어떠한 근로협약은 근로기준법 위반임을 확인한다."고 밝혔다.
The court also noted that payments included in base salaries must be given on a regular basis to employees. It excluded vacation allowances, for example, because they do not necessarily apply to all employees at all times.
■ vacation allowance: 휴가비
대법원은 또 통상임금에 포함된 지급금은 정기적으로 직원에게 지급되는 것이라고 명시했다. 예를 들면, 휴가비는 모든 직원들에게 항상 반드시 지급되지는 않기 때문에 통상임금에 포함되지 않는다.
