Save children from abuse

Sometimes, we wonder if our society has any mechanisms to prevent child abuse and provide adequate care. The recent assault case in Chilgok County, North Gyeongsang, exposed an embarrassingly cold and degrading side of our society. In August last year, a woman from the area beat her 8-year-old stepdaughter to death and made the victim’s 12-year-old sister take the blame. The girl, having witnessed her younger sister’s death, made a false confession out of fear that she, too, could die at the hands of her cruel stepmother.

But the sisters received no protection or help from law enforcement officers, community care centers or their school. The victim had reported her assault and abuse to the police for two years before she was killed. But her voice was ignored. Her teacher also informed a child protection group that there were signs of assault, but the group failed to keep watch over the abusive parents.

The investigation carried out by law enforcement officers was even more pitiful. Despite numerous reports of abuse and circumstantial evidence, police and prosecutors wrapped up the case entirely based on the older sister’s false confession. After juvenile care, the girl was returned to her abusive stepmother. It is common sense that abused children should be kept safe from their dangerous parents or caretakers.

The girl’s torture did not end after she was returned to her home. She was forced by her father to write letters to authorities to pardon her murderous stepmother. She was finally reprieved after her aunt saved her from her parents and persuaded her to tell the full story. The police and prosecutors have done nothing. Prosecutors charged the stepmother with assault instead of murder.

How many more innocent children have to be sacrificed before society pays attention to children who are in danger? A society is not reliable if it cannot protect small children. At this moment, there are many children living in terror from maltreatment and abuse similar to the girl who was beaten to death in Chilgok. Society should rush to strengthen its ability to protect and save children from abusive hands.

우리 사회엔 아동학대를 예방하는 사회적 기능도, 사후에 이를 다루는 시스템도 전혀 없었다. 경북 칠곡에서 벌어진 계모의 의붓딸 학대 치사 사건은 이런 우리 사회의 참담하고 부끄러운 현실을 적나라하게 드러냈다. 지난해 8월 계모가 8살 된 의붓딸을 밟아죽이고도 이 범행을 12살 난 피해자의 언니에게 뒤집어 씌우고 거짓 자백을 시켰다. 동생이 죽어가는 장면을 본 어린이는 자신도 죽을지 모른다는 공포에서 거짓 자백을 했다. 이들 자매의 아빠와 계모의 학대는 잔혹하기 짝이 없었다.
그러나 이를 다룬 경찰·검찰·아동보호기관·학교 등 아동을 보호해야 할 사회기관들은 모두 무기력했다. 해당 어린이는 2년 전부터 경찰에 부모의 학대 사실을 신고했으나 사건 접수도 하지 않았고, 학대 사실을 인지한 담임교사는 아동보호기관에 알렸으나 부모를 제재하지 못했고, 아동보호기관이 모니터링을 하는 동안에도 학대는 계속됐다.
동생의 죽음 이후 검·경의 조사과정은 더욱 한심하기 짝이 없다. 이미 아동학대 사실을 이렇게 여러 단계에서 확인할 수 있었는데도 아이의 증언을 토대로 아이를 주범으로 단정하고 사건을 수사했으며, 심지어 아이를 학대부모였던 아빠 곁으로 돌려보냈다. 학대 아동은 일단 학대의 주체와 격리해야 한다는 기본도 모르는 처사였다. 이 과정에서 아이는 아빠의 강요로 계모의 선처를 호소하는 편지를 써야 하는 등 2차 학대를 당했다. 아이들의 고모가 발벗고 나서 아이를 부모로부터 격리하고 새로운 진술을 받아내기까지 검·경은 한 일이 없다. 그리고 검찰은 지난 울산 아동학대 사건 당시 계모에게 살인죄를 적용한 것과 달리 상해치사죄를 적용했다.
이 같은 아동학대에 대한 사회적 무관심과 몰이해로 도대체 우리 사회에선 얼마나 많은 아동이 학대의 희생자가 되어야 하는가. 어린이를 지키지 못하는 사회는 그 자체로 병든 사회다. 지금도 칠곡 어린이처럼 아무런 도움도 받지 못한 채 학대 속에서 신음하는 어린이가 곳곳에 있을 것이다. 아동을 보호하는 사회적 기능을 하루 빨리 정비해야 한다.
