Telling the truth behind smoking
The National Health Insurance Service (NHIS) has filed a lawsuit on behalf of smokers against domestic and foreign tobacco companies for compensation over the health damages of smoking./ 국민건강보험공단이 흡연자를 대신하여 국내외 담배회사에게 흡연으로 인한 건강피해에 대한 보상을 요구하는 소송을 제기했다/ For smoking-related lawsuits lodged by individuals in Korea, all of the plaintiffs have lost without exception./ 한국에서 개인이 제기한 흡연관련 소송은 모두 예외없이 원고가 패소했다/ The Supreme Court not long ago sided with cigarette companies in a trial that dragged on for 15 years./ 얼마 전 대법원은 15년간 끌어 온 재판에서 담배회사의 손을 들어 주었다/ The latest suit attracts our attention, as it is the first suit by a state-run corporation against tobacco companies./ 최근의 소송은 담배회사를 상대로 국영기업이 처음으로 소송을 제기했다는 점에서 우리의 관심을 모으고 있다/The contentious issues are twofold./ 쟁점이 되고 있는 문제는 두 가지다/ One is smoking’s correlation with cancer./ 하나는 흡연의 암과의 관련성이다/ In a number of lawsuits filed by individuals, the lower and higher courts didn’t accept the causal relationship./ 개인이 제기한 소송에서는 1심법원과 2심법원은 일반적인 관련성을 인정하지 않았다/ The courts took the position that they can hardly conclude - solely based on general statistics - that smoking was the direct cause of the cancers./ 1심과 2심법원은 일반적인 통계를 바탕으로 해서는 흡연이 암의 직접적인 원인이라는 결론을 내릴 수 없다는 입장을 취했다/ The Supreme Court also said that despite a “partial causal relationship” between smoking and cancers of the lung and larynx, the evidence is not strong enough to overturn the judgments of lower courts./ 대법원은 흡연과 폐암 및 후두암과의 인과관계는 부분적으로 인정하지만 그렇다고 해서 그 증거가 하급심의 판단을 뒤집을 만큼 충분하지 않다는 결론을 내렸다/
As a result, the NHIS is trying to use Big Data it has so far accumulated to make the causal relationship apparent./ 결과적으로 국민건강보험공단은 인과관계를 분명하게 하기 위해 지금까지 축적해온 빅 데이타를 활용할 예정이다/ It also plans to first represent those patients suffering from small cell carcinoma and epithelial squamous cell cancer in the lungs and squamous cell carcinoma among larynx cancers - both groups with relatively stronger causal relationships than other types of cancers - in order to raise the probability of winning the suit./ 또한 국민건강보험공단은 승소확률을 높이기 위해 다른 유형의 암보다는 비교적 더 많은 인과관계를 가지고 있는 폐암 중 소세포암, 편평상피세포암과 후두암 중 편평세포암으로 고통을 받고 있는 환자만을 우선 소송을 대리할 계획이다/
The second issue of contention is whether tobacco companies have illegally concealed cigarettes’ hazardous effects on health./ 두 번 째 쟁점은 담배회사가 불법적으로 건강에 해로운 담배의 영향을 숨겼느냐 하는 것이다/ The courts in Korea judged that they couldn’t find evidence that tobacco companies committed wrongdoings - such as inserting illegitimate additives into cigarettes to raise the addictiveness of their products or covering up data that is disadvantageous./ 한국 법원은 담배회사가 제품의 중독성을 높이기 위해 담배에 불법 첨가물을 넣는다든지 불리한 자료를 숨기는 등과 같은 범법행위를 했다는 증거를 찾지 못했다고 판결했다/ In the United States or Canada, however, tobacco companies had to pay huge settlements./ 하지만 미국과 캐나다의 담배회사는 막대한 합의금을 지불해야만 했다/ The NHIS believes that individual plaintiffs could not prove the apparent health risks of cigarettes because KT&G, a state-run tobacco company, has not made its internal data public./ 국민건강보험공단은 국영 담배회사인 KT&G가 내부 자료를 공개하지 않기 때문에 개인적인 원고들은 담배의 분명한 건강 위해성을 증명하지 못할 것이라고 생각하고 있다/ That’s why the NHIS included Philip Morris International and the British American Tobacco Korea in the litigation./ 그래서 국민건강보험공단은 소송과정에서 필립모리스 인터내셔널과 브리티시아메리칸토바코 코리아를 소송에 포함했다/
Because a state-run company is filing a suit following the Supreme Court’s ruling on the tobacco trial, citizens are paying special attention to the outcome of the trial - not to mention the toxicity of the cigarettes./ 담배 재판에 관한 대법원 판결에 이어서 국영 기업이 소송을 제기하고 있어서 담배의 유독성은 말할 것도 없이 재판 결과에 국민은 특별한 관심을 보이고 있다/ It would be very difficult to forecast the results of the lawsuit./ 소송의 결과를 예상하기는 매우 어렵다/ We hope the court’s ruling will help clear all the questions over the causal relationship between smoking and cancer, as well as all the suspicions over tobacco companies’ illegal actions./ 우리는 법원의 판결을 통해 담배회사의 불법행위에 대한 모든 혐의뿐만 아니라 흡연과 암사이의 인과관계에 대한 모든 의문을 분명하게 밝힐 수 있기를 바란다/ If the court can hand down a clear judgment on the issue, it could be beneficial to the people regardless of the outcome./ 만약 법원이 이 문제에 관해 분명한 판결을 내릴 수 있다면 결과에 상관없이 국민들에게 유익할 것이다/
