A rare case of terra nullius

Korea and China are waging intense territorial disputes with Japan over Dokdo and the Diaoyu Islands, respectively. Dokdo is obviously and undoubtedly Korean territory, and Japan is making outrageous claims. But the territorial disputes are not about the actual utility of the land but about the divine sovereignty that no state can concede.

While many lands are disputed among different countries, only two territories on earth lie unclaimed: Marie Byrd Land in Antarctica and Bir Tawil, between Egypt and Sudan.

Marie Byrd Land is undesirable because it is so remote with an extremely cruel climate. But Bir Tawil is a rare case of terra nullius that neither Egypt nor Sudan wants. How can this be?

In 1899, Great Britain divided Egypt and Sudan on the 22nd parallel. But in 1902, Great Britain adjusted the border, which led to problems.

Bir Tawil lies below the 22nd parallel, but as it is pasture land for the Ababda tribe, it was assigned to Egypt. While the Hala’ib Triangle lies above the 22nd parallel, it is inhabited by the Sudanese Hala’ib tribe and belongs to Sudan.

Because the Hala’ib Triangle is above the 22nd parallel, Egypt claims the triangle based on an 1899 treaty. However, Sudan claims its territorial right based on a 1902 treaty. When two countries are involved in a territorial dispute, international law requires that no country has grounds to both own the land. Since Bir Tawil is only one-tenth in size of the Hala’ib Triangle, which is also strategically located on the Red Sea, both Sudan and Egypt gave up their claim to Bir Tawil, as neither were willing to cede their claim to the triangle.

There is no third country that can claim the area, and Sudan and Egypt argue that Tawil does not belong to them so that they can claim the Hala’ib Triangle. While Bir Tawil is administratively an Egyptian territory, Egypt’s official map does not include it. And an American man proclaimed a kingdom in this unclaimed land. Jeremiah Heaton of Virginia planted a homemade flag in Bir Tawil in June, declared the region as “The Kingdom of North Sudan” and requested official recognition from Egypt, Sudan and the African Union. He would like to grant the wish of his 7-year-old daughter, allowing her to become a real princess. He has not received any responses, as the Islamic countries are participating in Ramadan until the end of the month.

After all, if you look hard enough, there is always a niche.

독도, 센카쿠 열도(댜오위다오)를 둘러싸고 한중일이 첨예한 영유권분쟁을 벌이고 있다. 독도는 누가 뭐래도 우리 땅인데 일본이 억지를 부리는 것이지만, 이런 분쟁지역은 사실상 쓸모보다는 국가의 신성한 영토이기 때문에 하늘이 두 쪽이 나도 양보를 할 수 없는 것이다. 이렇게 국가 간의 분쟁에 휩싸인 영토는 많아도 아무도 영유권을 주장하지 않는 땅이 지구상에 두 군데나 있다. 남극대륙의 마리 버드 랜드(Marie Byrd Land)와 이집트와 수단 사이에 있는 2,060평방 Km쯤 되는 사막 비르 타윌(Bir Tawil)지역이다. 마리 버드 랜드는 남국대륙에 있는 얼음으로 뒤덮힌 지역이라 그렇다 쳐도, 비르 타윌 지역은 이집트와 수단이 서로 자기네 땅이 아니라고 우기는 정말 희귀한 지역, 즉 무주지(無主地-테라 눌리우스)다. 어떻게 이런 일이 생길 수 있었을까?
1899년 영국은 이집트와 수단을 북위 22도선으로 갈라놓았다. 그런데 1902년 영국은 다시 국경을 조정하였는데, 이때 문제가 생겼다. 즉 비르 타윌지역은 22도선 밑에 있지만 이집트 아스완 지역에 사는 아바브다족의 방목지이므로 이집트령으로 했고, 22도선 위의 할라입 삼각지는 수단계의 할라입 유목민의 거주지이므로 수단에 속하게 조정하게 된 것이다. 당연히 이집트는 할라입 삼각지가 22도선 위에 있으므로 1899년 경계선에 따라 자기 영토라고 주장한다. 그러나 수단은 1902년에 그어진 경계를 근거로 자신의 영유권을 주장한다. 국제법상, 영토분쟁을 벌이는 두 나라가 있을 경우, 한 나라가 두 곳을 모두 영유할 수 있는 근거가 없기 때문에 그 중 한 지역은 포기해야 한다. 그런데 비르 타윌은 홍해와 접해있는 할라입 삼각지보다 크기도 10분의 1에 불과하고 사막 지대여서 중요도도 훨씬 떨어지기 때문에 두 나라 모두 서로 자기 땅이 아니라고 주장한다. 그렇다고 제 3국이 영유권을 주장할 수도 없는 일이어서, 할라입 삼각지를 차지하기 위해 두 나라가 비르 타윌이 서로 자기 영토가 아니라고 우기는 희한한 일이 벌어진 것이다. 비르 타윌은 행정적으론 이집트 영유로 돼 있지만 이집트 정부의 공식 지도엔 영토로 표시돼 있지 않다.
이 땅에 새로운 왕국을 선포한 미국인이 있어 화제다. 제레미아 비튼이란 남성은 올 6월 비르 타윌에 사제(私製) 깃발을 꽂고 ‘북 수단 왕국’을 선포한 다음, 이집트와 수단 그리고 아프리카 연합에 인준을 요청하였다. 그의 일곱 살 난 딸의 소원이 공주가 되는 것이기에 그 꿈을 이루어 주려 한 것이라고 한다. 이달 말까지 라마단이라 아직 아무런 회신을 받지 못했다는데, 되든 안 되든 세상에는 항상 틈새란 있기 마련 아닌가.
