Justice delayed is justice denied

Prosecutors embarked on an investigation into manufacturers of humidifier sterilizers after health authorities concluded in 2011 that they could have caused the deaths of dozens, or even hundreds, of people. It is up to the prosecution to come up with legally verifiable scientific evidence to prove the connection between the toxic agents used in the dehumidifiers and the lung diseases that caused hundreds to become ill or die.

The Seoul District Central Prosecution Office’s special investigation team on the case will start summoning manufacturers from next week. The probe will focus on determining whether the manufacturers knew of the hazardous effects of the sterilizing agents when they produced and marketed them and the thoroughness of their safety tests.

Since the special team was organized in January, it has interviewed over 200 victims and their families and seized materials and evidence from the workplaces of manufacturers and retailers. It also has been investigating the possibility that a study, carried out by a university on behalf of a manufacturer, Oxy Reckitt Benckiser, and used as evidence in ruling out a causal relationship between humidifier disinfectants and respiratory damages, could have been fabricated.

The official death toll from humidifier sterilizers is at 143. Three more died while government investigations were ongoing. Families are enraged to have lost loved ones as a result of naïve confidence in a product label meant to ensure the safety of sterilizers on the human body. Manufacturers have never once taken accountability and apologized. Law enforcement officials have picked up speed in the investigation only recently, even though the victims filed charges in 2012. Families and victims had to go through the ordeal of visiting one hospital after another to determine the cause of their illness.

Justice delayed is justice denied. The prosecution must make amends by doing all it can to scientifically prove and answer for these suspicions and allegations. Its existence would be in serious question if a law enforcement office cannot safeguard the people’s lives and safety.

2011년 가습기 살균제 사망 사건에 대한 검찰 수사가 제조업체 조사 단계로 들어섰다. 4년을 끌어온 수사가 실체적 진실을 제대로 밝힐 수 있을지 주목되는 상황이다. 관건은 사망과 살균제 사이의 인과관계를 뒷받침할 확실한 증거자료를 찾아낼 수 있느냐다.
서울중앙지검 가습기 살균제 특별수사팀은 내주부터 제조업체 관계자들을 소환 조사할 예정이라고 밝혔다. 수사의 초점은 업체들이 살균제 첨가 물질이 인체에 해롭다는 사실을 알면서도 살균제를 계속 제조·판매했는지와 제품 안전성 검사를 제대로 했는지에 맞춰지고 있다. 앞서 지난 1월 출범한 특별수사팀은 제조·유통업체 압수수색에 이어 피해자와 유족 등 200여명에 대한 전수 조사, 유해성 분석 등을 진행해왔다. 수사팀은 특히 제조사 의뢰로 수행된 대학 연구팀 실험 보고서가 조작돼 제출됐다는 의혹에 대해 집중 조사하고 있다. 현재로선 정황에 불과하지만 의혹이 사실로 확인될 경우 옥시 측 주장은 힘을 잃게 될 공산이 크다.
가습기 살균제와 관련해 숨진 사람은 임산부와 영·유아 등 143명에 이르는 것으로 공식 집계돼 있다. 그제 환경보건시민센터 발표에 따르면 정부의 1, 2차 조사를 받았던 이들 가운데 3명이 추가 사망했다고 한다. ‘인체에 안전하다’는 안내 문구만 믿고 살균제를 썼던 유족들은 “가족의 건강을 위해 사용했던 것인데…”라며 통한의 눈물을 삼키고 있다. 그럼에도 제조사 측은 “제품엔 문제가 없다”며 사과 한번 제대로 해본 적이 없다. 더욱 개탄스러운 것은 2012년 피해자들의 고소장 제출 후 검찰과 경찰에서 적극적인 자세를 보이지 않다가 이제야 본격적인 수사를 진행 중이란 사실이다. 그동안 피해자와 가족들의 원통함은 병원과 거리를 떠돌아야 했던 것 아닌가.
지체된 정의는 정의가 아니란 말이 공연히 있는 게 아니다. 검찰은 과학 수사 역량을 총동원해 지금까지 제기된 모든 의혹들을 낱낱이 규명해야 한다. 국민의 생명과 안전을 지키겠다는 약속이 지켜지지 않는다면 수사기관은 가장 중요한 존립 근거를 잃을 수밖에 없다.
