United we stand, divided we fall (KOR)

For the last 10 days, judges across the country have been divided on the question of pressing criminal charges against former Supreme Court Chief Justice Yang Sung-tae for allegedly influencing the very court that deliberated on charges of power abuse against former President Park Geun-hye.

Judges debated on the issue by court and rank. Younger judges argued for criminal actions against Yang and other officials involved in the allegations, while more senior-level members disagreed. Senior benches issued a statement opposing criminal action against those officials. An advisory committee to the Supreme Court — comprised of experts from various fields — also showed mixed responses to the idea of filing criminal charges against Yang and others.

An internal investigation team last month said it found suspicious documents in computers of the National Court Administration that is used to conduct administrative work for the Supreme Court. Those documents raised questions on Yang’s judicial neutrality. Yet the team said the evidence was not enough to file charges against Yang or the others involved.

Current Chief Justice Kim Myeong-su, however, said he would decide on whether to take actions against his predecessor or not after hearing opinions from the bench, even though an internal investigation team had already recommended against taking action against Yang. Kim ended up stoking and exposing division in the court by ignoring a recommendation from the investigation team that he himself had appointed.

Last Friday, Chief Justice Kim said the matter should be dealt among the judges, indicating a retreat from his earlier position of pressing charges against Yang and others. Given the division within the judiciary, a consensus will not likely be achieved easily. When opinions are polarized, it is best to stick to the basics. Kim must respect the judgment made by the investigation team. If the prosecution or the legislature launch separate probes, the court could comply within the context of upholding the integrity of the judiciary. Prosecutors inevitably may have to launch an investigation due to the number of charges on the affair. We hope Chief Justice Kim will try to restore the integrity and unity of the court.

월요일 열린 전국법관대표회의로 ‘재판 거래’ 의혹이 불거진 뒤 10여 일간 이어져 온 판사회의가 일단락됐다. 그동안 법관들이 법원별, 직급별로 개최한 릴레이 회의 결과는 두 갈래로 나뉘었다. 소장 판사들이 모인 곳에서는 양승태 대법원장 시절의 법원행정처 간부들을 검찰에 고발해야 한다는 의견이 주류를 이뤘다. 반면 중견·고참 판사들의 회의에서는 신중론이 우세를 보였다. 전국 법원장들(35명)은 고발이 적절치 않다고 한목소리를 냈다. 각계 전문가들로 구성된 대법원 자문기구인 사법발전위원회에서도 의견이 갈렸다.
지난달 25일 대법원 특별조사단의 ‘사법행정권 남용 의혹’ 조사 결과 발표 뒤 법원이 이처럼 둘로 쪼개진 듯한 모습까지 드러내게 된 것은 김명수 대법원장의 이해하기 힘든 태도 때문이었다. 그는 재판 거래가 실제로 이뤄졌음을 입증하는 자료가 없어 관련자 형사 조치는 바람직하지 않다는 조사단의 결론을 수용하지 않고 판사들의 의견을 들어 보겠다고 했다. 자신이 직접 일을 맡긴 조사단의 판단을 무시하며 사법 불신 확산과 법원 내분을 자초하는 길로 걸어간 것이다.
김 대법원장은 지난 8일 “법원 내부에서 해결하는 것을 가장 중요하게 생각한다”고 말했다. 어제는 “우리(판사들) 모두 같은 마음이라고 생각한다”고 했다. ‘고발 불사’ 입장에서 한발 물러나면서 내분 봉합의 필요성을 제기한 것으로 해석된다. 이미 법조계 등의 여론도 극단으로 갈려 모두를 만족시킬 해법은 찾기 어렵게 됐다. 이런 때일수록 원칙을 지키는 것이 중요하다. 김 대법원장은 조사단의 결론을 받아들이면 된다. 그 뒤 검찰이 수사에 착수하거나 국회가 국정조사에 나서면 사법부 독립성이 훼손되지 않는 범위 내에서 성실히 협조하면 된다. 검찰에 고발장이 쌓여 있어 어차피 없던 일로 끝낼 수는 없는 상황이다. 김 대법원장이 속히 수습의 길로 들어서기를 바란다.
