BMW needs to pay (KOR)

Another BMW 520d model caught fire on the road on Friday, bringing the number of BMWs bursting into flames in Korea to 32 this year alone. The government has issued a warning to car owners to refrain from driving the potential moving bomb before the official recall starts on Aug. 20. The German car company is no stranger to recalls. A fire-prone model was also recalled in October 2016. At the time, BMW Korea blamed a component in the exhaust gas recirculation (EGR) system.

If system malfunctions and recirculated gas emissions reenter the pipe without being cooled, it can melt a hole in the engine and cause a fire. If that is the problem, BMW cars with the same system may also catch on fire. But the mystery is that this phenomenon is only causing problems to cars in Korea. Others point to a software problem, but BMW remains mum.

Owners are not just fearful for their lives, but they have also suffered property losses. Ten owners have filed damage lawsuits against BMW Korea and five dealerships. BMW acts as if it has done enough by recalling 106,317 units of 42 models including the 520d.

The actions from the Ministry of Land, Infrastructure and Transport are also vexing the owners. The ministry merely advises owners to not drive the problematic cars because it will take 10 months to find out the exact cause. The talk is overly casual when there is a risk of being killed in a flaming car.

BMW has submitted documents to help with the investigation. The ministry said it would embark on investigation with outside experts. But since the technological aspect relies entirely on the materials submitted by BMW, whether authorities can pin down the cause remains uncertain.

Even after the cause is determined and punishment is levied, consumers won’t likely be fully compensated under domestic regulations. Volkswagen AG paid $14.7 billion in fines and damages to U.S. authorities and consumers for the diesel emissions scandal in 2015. But Audi Volkswagen Korea was merely fined 14.1 billion won ($12.5 million). It is no wonder foreign carmakers take Korean consumers lightly. The government must revise the recall system. It must toughen punitive actions to make manufacturers pay a price for putting human lives at risk.

BMW 차 불길과 함께 날아가는 '안전한 대한민국'
멀쩡히 달리던 BMW 자동차에서 잇따라 불이 나고 있다. 폭염으로 고통스런 여름을 보내는 국민은 이번에는 불타는 BMW 차를 보면서 공포를 느낀다. ‘안전한 대한민국’을 내건 이 정부에서 대한민국은 위험한 나라로 전락하고 있다. 지난 4일 전남 목포시 옥암동 인근 도로를 달리던 BMW 520d 승용차에서 불이 났다. 이로써 올해에만 주행 중 불이 났다고 신고된 BMW 차량은 32대로 늘었다.
BMW의 화재는 어제오늘의 일이 아니다. 2016년 10월에도 화재로 리콜했다. 올해 들어서 발생한 화재 원인을 BMW코리아는 “엔진에 장착한 배기가스 재순환장치(EGR) 결함 때문”이라고 주장한다. 엔진에 장착된 EGR 결함으로 냉각되지 않은 고온의 배기가스가 흡기다기관(吸氣多岐管)에 유입돼 관에 구멍이 뚫리면서 엔진 커버 등에 불이 붙었다는 설명이다.
EGR은 세계적으로 보편화한 장치다. 이게 문제라면 다른 나라에서 달리는 BMW 자동차에도 같은 사고가 나야 한다. 그런데 유독 한국에 판매된 차에서만 불이 계속 나는 건 이해할 수 없다. 일부에서는 소프트웨어 결함 의혹도 제기하는데 BMW는 입을 다물고 있다. 이번에 안전 진단을 받았다고 화재가 발생하지 않는다고 확신할 수 없는 이유다.
BMW 차주들은 생명의 위협에다 재산상의 손해까지 불가피해졌다. BMW 차주 10여 명은 최근 BMW코리아와 딜러사 5곳을 상대로 서울중앙지법에 손해배상청구 소송을 냈다. 그런데도 BMW는 지난달 26일 520d 등 42개 차종 10만 6317대의 리콜을 결정하고 할 일 다 했다는 듯한 모습을 보였다.
더 짜증 지수를 높이는 건 주무부처인 국토교통부의 대응이다. 자동차 화재 공포가 번지는데도 국토부는 “정확한 화재 원인을 규명하는 데 10개월이 걸린다”며 사용 자제 등만 권고했다. 여기저기서 차에 불이 나 운전자의 생명이 위협받는 상황에서 너무 안이한 자세다.
뒤늦게 BMW가 지난 4일 국토부에 엔진 화재와 관련한 기술분석 자료를 제출했지만, 국토부가 정확한 원인을 밝혀낼 수 있을지도 미지수다. 국토부는 학계 등 민간의 전문가까지 참가시켜 화재 원인을 분석하겠다고 밝혔다. 하지만 기술분석 등의 자료를 전적으로 BMW에 의존해야 하므로 정확한 원인을 밝혀낼 수 있을지 의문이다.
설령 원인을 밝혀내 제재를 한다 하더라도 국내법과 규정상 피해 소비자가 충분한 보상을 받기 힘들다. 2015년 배출가스를 조작한 ‘디젤 게이트’로 폭스바겐은 미국에서 소비자와 환경보호청 등에 벌금과 손해배상금으로 147억 달러(17조 4000억원)를 냈다. 반면 아우디폭스바겐코리아는 2015년 국내에서 141억원의 과징금만 냈을 뿐이다. 이러니 외국 제조업체가 한국 소비자를 우습게 보는 것이다. 이번 사고를 계기로 정부는 리콜 제도 개선안을 마련해야 한다. 국민의 생명을 위협하는 제작사의 잘못에 대해서는 징벌적 보상제를 도입해 악순환을 끊어야 한다.
