드라마 < 피고인 >에 나오는 한 장면입니다. 사람을 죽인 극중 피의자는 심지어 대중 앞에서 헛것이 보이는 연기도 했지요.

This is a scene from the Korean drama “Defendant” (2017). In the scene, the person who has been accused of murder pretends to hallucinate in front of a crowd.

심신미약에 의한 감형. 작가의 상상력이 가미되어 좀 더 극적으로 차용되긴 했겠지만 그것이 단지 드라마 속에서만 있는 일은 아니라는 공유된 기억들로 인해서 사람들은 더 감정이입이 됐는지도 모르겠습니다. 아마도 모두의 머릿속엔 실제 있었던 몇 가지 사건들이 겹쳐서 떠올랐을 것입니다.

The accused eventually received a reduced sentence because he was “a feeble-minded person.” The scene, which was written in a dramatic fashion, is not an event confined to the fictional world. Instead, the scene draws more empathy from the audience because of the collective recollections of the public. Perhaps, a few cases similar to the scene may overlap in our minds.

강남역 살인사건 (2016년) 무기징역 구형
- "피해망상 등 정신 질환이 있었다." 징역 30년 선고

Gangnam Station murder (2016). Prosecutors asked for a life sentence.
- “Claimed to have a psychological disorder like paranoia.” Sentenced to 30 years in prison.


조두순 사건 (2008년) 무기징역 구형
- "알코올 의존증으로 술에 취해 있었다." 징역 12년선고

The Cho Doo-soon case (2008). Prosecutors asked for a life sentence.
- “Was drunk at the time because of alcohol dependency.” Sentenced to 12 years in prison.


심신미약을 주장했어도 인정되지 않은 사례들이 대다수라는 건 모르는 바가 아니지만…

I understand that there have been many criminal cases where the court rejected to rule a reduced sentence because of a “mentally weak” claim.

강서구 PC방 살인사건. 하나의 사건에 이토록 많은 사람들이 마음을 가라앉히지 못하는 것은 왜인가… 그는 '우울증'을 앓고 있었다는데… 그렇다면 심신미약자는 사람을 죽여도 책임이 덜해지는가… 어찌 보면 이 단순하고도 절실한 의구심과 냉정해야 할 법적 책임주의와의 충돌은 지금까지 그래왔듯, 앞으로도 계속될 것입니다.

The Gangseo District PC bang (internet cafe) murder. Why do so many people feel unease with this one case? The murderer is supposedly suffering from depression. If so, does one’s criminal responsibility for murder decrease if they have a psychological disorder? This simplistic yet earnest suspicion has, and always will, be in conflict with the criminal responsibility rule.

The criminal responsibility rule: A term in criminal law where a perpetrator is only found responsible if they are capable of taking responsibility and if there is a conviction.

그리고 시민들의 법 감정에 따라 양형의 기준이 바뀌는 것이 진보인가 후퇴인가… 혹은 그것이 근본적인 해결책인가에 대한 고민도 계속되겠지요. 다만 만취한 운전자의 차량에 치인 청년의 사건에서도 그랬고 강서구 PC방 살인사건에 대해서도 그렇듯이 이른바 심신 미약에 대한 시민의 기준은 시대에 따라 변하고 있는 중입니다.

Is revising the criminal responsibility rule due to public criticism progress or a retreat? Additional worries about how revising the law would not serve as fundamental solution has continuously been brought to the public’s attention. Nonetheless, in both the cases where an adolescent died after being hit by a drunk driver and for the Gangseo PC bang murder, we can see a change in how the public determines if one is psychologically ill or not.

극중에 나오는 변호사의 권유 아닌 권유는 결국 이른바 심신미약이라는 것이 최후의 도피처로 악용될 수 있다는 점을 은연중에 말해주고 있지만… 평범하고도 선한 많은 이들에게 '나 역시 언제든 공격을 당할 수 있다'는 공포로부터 도피할 수 있는 세상은 어디인가…

Through the lawyer’s recommendation, the scene is subtly telling the audience that declaring psychological ineptness could be misused as a final resort for criminals. Then, where could kind hearted people escape to when they are overwhelmed with the fear that they could be attacked anywhere by anyone?
