Thorough investigation is needed (KOR)

Rep. Sohn Hye-won, now an independent after leaving the ruling Democratic Party (DP), was indicted by the prosecution on charges of violating the Public Employees Corruption Prevention Act and the law requiring real estate transactions to be made using one’s actual name. She was accused of having used inside information to speculate on real estate investments in locations set for urban development, making some purchases under borrowed names. Prosecutors found some truth in the media reports from January that she had vehemently denied.

According to the prosecution’s findings, Sohn acquired a document on urban development plans from a Mokpo, South Jeolla city administration official and used a fund run by her husband and others to purchase real estate in the southern coastal city worth 1.4 billion won ($1.18 million). An old inn that was recognized as a local heritage spot was purchased under her niece’s name. Her aide also bought land and buildings under borrowed names and shared the development outline with his acquaintances.

Sohn denied any wrongdoing and promised to donate all her assets if she was found guilty for illicit real estate trading. The truth must be judged by the court. If the prosecution is right, Sohn and her aide have committed a serious crime. The nation would be totally corrupt if senior government officials abuse inside information for personal gain. The Anti-Corruption Act punishes violators with a maximum of seven years in prison or a fine of 70 million won. At the time Sohn made the purchases, the government’s clampdown on real estate speculation was at its peak. Sohn was then a heavyweight politician in the ruling party. She may have her excuses, but she inevitably aggravated public skepticism in public policies and elites.

The judiciary world believes there would be more to the charges behind Sohn. It took five months for the prosecution probe to come to a conclusion. The prosecution questioned Sohn just once and kept summoning her secretly to spare her humiliation to the press. The prosecution went light on Sohn by allowing her to prepare for trials without physical detention when it had always sought an arrest warrant for people related to investigations related to past government on lighter charges. The prosecution said it will also look into the suspicion that Sohn had pressured the Ministry of Patriots and Veterans Affairs to bestow her father with an honor of merit. The prosecution must dig further and thoroughly into the case.

검찰이 범죄로 판단한 손혜원의 부동산 거래
검찰이 손혜원 의원(무소속)이 국회의원 직무와 관련하여 얻은 도시계획 정보를 이용해 부동산 투기를 했으며, 그중 일부는 차명으로 거래했다고 판단했다. 이에 따라 부패방지법 위반과 부동산 실명 거래법 위반 혐의로 화요일 손 의원을 불구속 기소했다. 지난 1월 언론 보도로 제기된 불법 부동산 투기 의혹이 억측이 아니라 사실이라는 게 수사의 결론이다.
검찰 발표에 따르면 손 의원은 목포시청 관계자로부터 얻은 ‘도시재생 계획’을 입수한 뒤 남편이 이사장인 재단 등이 목포 구도심의 부동산(약 14억원 상당)을 매입하도록 했다. 그중 창성장이라는 숙박업소는 손 의원이 조카 명의로 위장해 매입했다고 수사팀은 판단했다. 검찰은 손 의원 보좌관도 차명으로 토지와 건물을 매입하고 목포시 개발 정보를 지인들에게 유출한 혐의로 함께 기소했다.
검찰 발표 내용이 확정된 사실은 아니다. “차명 거래를 했다면 전 재산을 기부하겠다”며 항변해 온 손 의원은 어제도 혐의를 강하게 부인했다. 재판을 통해 시시비비가 가려져야 할 일이다. 하지만 검찰의 판단이 맞는다면 손 의원과 보좌관의 행위는 중대한 범죄에 속한다. 고위 공직자가 직무상의 권한을 활용해 얻은 정보를 사적인 이득을 취하는 데 쓴다면 이 나라는 ‘부패 공화국’이 될 수밖에 없다. 부패방지법은 이런 경우 7년 이하의 징역형이나 7000만원 이하의 벌금형에 처하도록 한다. 뇌물 범죄 못지않게 엄격한 처벌이 필요하다는 게 이 법의 정신이다. 해당 건물과 땅이 거래될 때 정부는 ‘부동산 투기와의 전쟁’을 선언하고 각종 억제책을 내놓았다. 당시 손 의원은 여당인 더불어민주당의 핵심 의원이었다. 손 의원은 억울하다고 주장하지만, 그의 행위로 인해 집권층과 국가 정책에 대한 불신이 커진 것은 분명한 사실이다.
법조계에서는 검찰 수사가 미온적이라는 평가도 나온다. 수사 착수에서 발표까지 5개월이 걸렸고, 손 의원 소환조사는 이달 초에 단 한 차례만 실시됐다. 게다가 소환 사실을 언론에 알리지 않아 포토라인 통과 없이 비공개로 출석할 수 있도록 '배려'했다. 이른바 ‘적폐 수사’에서는 부패방지법 위반보다 형량이 가벼운 직권남용죄로도 빈번하게 구속영장을 청구해 온 검찰이 손 의원을 불구속 기소한 것은 ‘권력 실세’에 대한 봐주기 수사라는 지적도 제기된다. 검찰은 손 의원이 국가보훈처에 압력을 가해 부친을 국가유공자로 지정하도록 했다는 의혹에 대한 수사는 계속 진행하고 있다고 밝혔다. 엄정한 수사와 판결을 기대한다.
