Step away from the investigation (KOR)

Kang Ki-jung, senior presidential secretary for political affairs, demanded the prosecution investigate the leak of confidential information allegedly collected by prosecutors in the process of probing allegations against justice minister nominee Cho Kuk. His comment could serve as pressure against the prosecution’s ongoing investigations of Cho and therefore must be taken back. While meeting reporters over the weekend, Kang called upon Prosecutor General Yoon Seok-youl to investigate how unconfirmed information under investigation got into the hands of the media to find out whether it was leaked by the prosecution or whether some kind of design was behind the media report.

He was referring to a media report that claimed prosecutors have secured a document where Roh Hwan-jung, head of the Busan Medical Center, had written that he had played a part in arranging the presidential doctor for President Moon Jae-in, as seen in the files they had secured from Busan National University. Roh was the doctor suspected of having granted scholarship to the daughter of Cho while she attended the university’s medical school.

Kang’s senseless remarks could be perceived as pressure on the prosecution. As the prosecution’s investigations must abide by the law, the presidential office has no right to interfere in their investigations. A few days earlier, he even clicked “like” on a Facebook post that called for the prosecutor to be punished and take responsibility over the “leak” of information.

The ruling Democratic Party (DP) has been blunt in criticizing the intelligence leak. “How can this happen under Prosecutor General Yoon Seok-youl?” asked DP floor leader Lee In-young. Park Kwang-on, a senior member of the party, even argued that the affair should be looked into by a third party.

Because Kang is President Moon’s secretary, his remarks and behavior could be understood as the will of the president. While handing over a certificate of appointment to Yoon, Moon asked the new prosecution chief to be equally strict on the powers that be. The public may doubt the president’s sincerity behind the words if he does not restrain his secretary. The prosecutor and media outlet argued that the report was based on investigative reporting by the journalist, who secured the information from the computer of Roh after the prosecution’s raid. The public won’t tolerate the government’s attempts to water down the investigation on Cho through political influence.

청와대 수석까지 나서 검찰 수사 압박하나
강기정 청와대 정무수석이 조국 법무부 장관 후보자 수사와 관련,검찰이 피의사실을 공표한 것처럼 주장하며 이를 수사하라고 요구했다.법치 수호에 중대한 오점을 남긴 부적절한 발언으로,철회돼야 마땅하다.강 수석은 지난 주말 기자들과 만나 “검찰이 흘렸는지 취재기자가 어떤 목적과 의도를 갖고 기사를 작성했는지 알 바가 없는데,윤석열 총장이라면 이 사실을 반드시 수사해야 한다”고 말했다.검찰이 부산대를 압수수색하는 과정에서 노환중 부산의료원장이 “문재인 대통령의 주치의 선정에 깊은 일역(一役)을 했다”고 적은 문건을 확보했다는 언론 보도를 문제삼은 것이다. 노 원장은 조 후보자의 딸에게 장학금 특혜를 줬다는 의혹을 받고 있는 인물이다.
강 수석의 발언은 현재 진행중인 조 후보자 관련 수사에 압박을 가해 검찰을 길들이기 하려는 의도가 아니라면 나올 수 없는,법치를 정면으로 거스른 발언이다.검찰 수사가 법과 양심에 따라 독립적으로 이뤄져야 하는건 민주국가의 상식이다.청와대가 권력의 정점에 있다고 해서 수사에까지 감놔라 배놔라 간섭할 권한은 없다.강 수석은 며칠 전에도 검찰의 비밀 누설과 관련,'윤석열 총장을 처벌해 달라' 는 페이스북 글에 '좋아요' 를 눌러 논란이 됐다.그러더니 이번엔 아예 검찰을 공개압박하는 발언을 하고 나섰다.조 후보자에 대한 검찰 수사를 무력화하려는 정치적 의도가 깔린 것이란 의혹을 지울 수 없는 이유다.
검찰의 압수수색 이후 여권 내에서 “어떻게 윤석열 검찰총장 시대에도 이런 일이 반복될 수 있는가”(이인영 민주당 원내대표),"기밀 유출에 대해서는 검경이 아닌 다른 기관에서 조사해서 엄단하도록 법을 만들어야 한다“(박광온 최고위원)는 등의 발언이 끊이지 않고 있는 것도 볼썽사납다.
정무수석은 대통령의 비서다.비서가 전면에 나서 검찰 수사 운운하는 것도 어불성설이지만,자칫 대통령의 의중인 양 호도될 수도 있다.불과 40여일 전,문 대통령은 윤 총장에게 임명장을 수여하면서 “우리 윤 총장은 권력에 휘둘리지 않고,사람에게 충성하지 않는 자세로…살아있는 권력에 대해서도 똑같은 자세가 돼야 한다”고 당부하지 않았는가.대통령의 의중과 상반된 발언을 한 참모에 대해 아무런 제재를 하지 않는다면 국민들을 이것을 어떻게 받아들이겠는가.
검찰과 해당 언론사는 이미 “검찰과 관련 없는 독자적 취재”란 점을 분명히했다.검찰 압수수색 후 부산의료원장실 컴퓨터를 통해 해당 문건을 입수했다고 보도 경위를 밝혔다.그렇다면,청와대와 여권은 차분히 검찰 수사를 지켜보는게 순리다.만약 조 후보자에 대한 물타기 수사로 당장의 위기를 모면하고자 꼼수를 부린다면 더 큰 국민적 저항과 화(禍)를 자초하게 될 뿐이다.
