총선 압승 이후 달라진 여권 인사들의 재판 태도

In Tuesday’s appeal trial for South Gyeongsang Gov. Kim Kyung-soo, who was convicted of having colluded to manipulate online public opinion in the so-called “Druking scandal,” one of his lawyers denounced special prosecutors for accusing him with no clear grounds. Observers of the trial said Governor Kim’s attorney reacted very aggressively. Kim’s attorney not only challenged the first court’s sentence of a two-year jail term for the governor but also rejected a Supreme Court ruling that found Druking, a power blogger, guilty.

김경수 경남도지사의 변호인은 댓글 조작 사건과 관련한 항소심 재판에서 “드루킹이 아주 영화를 찍고 있다”며 특검의 공소사실을 힐난조로 비판했다. 재판 현장에 있었던 사람들은 “김 지사 측의 언행이 공격적이었다”고 전했다. 징역 2년의 실형을 선고했던 1심 재판부와 드루킹의 유죄를 확정했던 대법원의 판결까지 모두 부정했다.

이번 총선에서 여권이 압승을 거두면서 각종 비리 혐의로 기소된 친정부 인사들이 종전과는 다른 모습을 보이고 있다. 정치적 자신감 때문인지 일반 시민들의 언어 습관을 뛰어넘는 비아냥거리고 거친 말이 이어지고 있다.

Upon winning a seat in the general elections, the DP’s Choi Kang-wook, a former presidential secretary for civil servants discipline, warned that he will “let prosecutors feel a changed world!” In another court, Chung Kyung-sim, a professor of English literature and the wife of former Justice Minister Cho Kuk, lambasted prosecutors for their descriptions of her investments, saying, “Why can’t I make investments with imagination?”

조국 전 법무부 장관 딸에게 가짜 인턴근무기록서를 만들어 준 혐의로 기소된 최강욱 전 청와대 공직기강비서관은 국회의원에 당선되자마자 “세상이 바뀌었다는 것을 확실히 알도록 갚아주겠다”고 말했다. 조 전 장관 부인 정경심 전 교수는 법정에서 투자금 계산 내역이 공개되자 “상상의 나래도 못 펼치나”고 항변했다. 법리적 다툼을 하는 와중엔 “난 문학을 전공해 언어 감수성이 뛰어나다”고 엉뚱한 소리를 했다.

After Choi, the former presidential secretary, claimed that Korea’s voters had already made their judgments known, we worry about those defendants behaving as if they have been acquitted of all charges. More dumbfounding is former Ulsan police chief Hwang Un-ha, who was elected lawmaker while maintaining his position as a senior police officer. He was indicted for allegedly interfering in the Ulsan mayoral election after receiving instructions from the Blue House. He allegedly violated the principle of political neutrality and the Constitution. It is a black comedy for them to now be calling for a fairer society and the rule of law.

“시민들의 심판은 이미 이뤄졌다”는 최 전 비서관의 주장처럼 이들이 총선 승리가 사법적 면죄부를 받은 것으로 착각하는 건 아닌지 걱정스럽다. 사법적 심사의 대상을 정치적으로 아전인수식 해석을 하는 법조인 출신 예비 국회의원의 모습에 벌써부터 21대 국회를 걱정하는 목소리가 나온다.

경찰 공무원이란 신분을 유지한 채 국회의원에 당선된 황운하 전 울산경찰청장 사건은 더욱 기가 막히다. 청와대의 울산시장 선거 개입 의혹과 관련해 야당 후보에 대한 ‘청부 수사’를 한 혐의로 기소된 그의 당선은 공무원의 정치적 중립을 강조한 헌법정신에도 어긋난다. 기소된 후보를 공천하고, 공무원 신분으로 출마해 당선되고, 이후 선거법 위반 혐의까지 받는 인사가 공정한 사회와 법치주의를 외치는 것은 블랙 코미디다. 이러니 탈세와 편법 부동산 투자 등으로 43억원의 재산을 늘린 사실이 드러났는데도 비례대표 사퇴를 거부하는 예비 국회의원까지 나오는 것 아닌가.

All of them brand prosecutors investigating their alleged wrongdoings as “anti-reform forces” who are resisting prosecutorial reforms. No election victory can cover up a criminal act. Their rough words will certainly hurt the pride of people who voted for them in the election.

이들의 공통된 특징은 자신들의 범법행위를 수사하는 검찰을 ‘쿠데타 세력’ ‘반개혁 세력’으로 규정하고 검찰개혁의 논리를 이끌어낸다는 점이다. 여권이 이번 선거에서 승리했다는 이유로 자신들의 범죄행위까지 덮으려 해서는 안 될 것이다. 더욱이 정제되지 않은 거친 언어와 비아냥 거리는 태도는 코로나 사태를 계기로 높아지고 있는 국민들의 자긍심에 오점을 줄 수 있다.

The judiciary must do its best to avoid criticism that it bent over backwards for those new lawmakers by delaying trials to ensure their four-year terms as legislator. Justice delayed is justice denied. If courts attempt to do favors for them, that translates into a collapse of the separation of powers ? which nobody wants.

사법부도 재판을 지연하는 방법으로 피고인들을 석방시키거나 임기를 보장해 준다는 비판을 받지 않도록 노력해야 할 것이다. 지체된 정의 실현은 국가의 법체제에 큰 흠집을 내고, 삼권분립이 무너졌다는 의심을 초래할 수 있다. 이는 자유민주주의의 본질은 물론 현 정부를 위해서도 결코 바람직하지 않다.
