Samsung Electronics and SK hynix will be able to maintain and upgrade their manufacturing facilities in China — albeit marginally — even after the implementation of Washington’s proposed rules aimed at preventing U.S. subsidies from being used in China, Korea’s Trade Ministry said Wednesday.

The U.S. Commerce Department announced Tuesday that it will limit recipients of Chips and Science Act funding from investing in the expansion of semiconductor manufacturing in the "foreign countries of concern" including China and Russia. But the limit was not an outright ban on investment in China since the department allows the recipient firms to expand production capacity by 5 percent for advanced chips and 10 percent for those made with relatively old manufacturing processes.

미국 상무부는 화요일 중국과 러시아 등 ‘해외 우려국’에 대한 반도체 생산시설 확장 투자를 막기 위해 반도체지원법 대상을 제한할 것이라고 밝혔다. 하지만 이 제한은 중국 투자에 대한 전면 금지는 아니었다. 이 지원법의 혜택을 받는 기업들에 대해 미국 상무부가 고성능 반도체의 경우 생산능력의 5% 확대, 상대적으로 노후한 생산 공정에 대해서는 10% 확대를 허용하기로 했기 때문이다.
 
 
 
“It seems possible for Korean companies to maintain or partially expand and upgrade technologies" used in semiconductor manufacturing at their production facilities in China, said the Ministry of Trade, Industry and Energy after it reviewed details of the so-called guardrails of the Chips and Science Act that passed last year.

“When upgrading the technologies, chip makers can increase the number of chips per wafer by upping density, which translates into a capacity expansion,” the ministry said in a statement released Wednesday.

The two chip makers said they are thoroughly reviewing the details of the proposed rules. "We have been in close discussions with the relevant government agencies of the U.S. and Korea, and plan to determine our next steps after reviewing the details of today's announcement," Samsung Electronics said in a statement.

삼성전자와 SK하이닉스는 법안의 세부규정을 꼼꼼히 살펴보고 있다고 말했다. 삼성전자는 “한국과 미국의 관련 정부 기관들과 긴밀히 대화해 왔으며 오늘 발표의 세부 사항을 살펴본 후 다음 행보를 결정할 계획”이라고 밝혔다.
 
 
 
A source in the semiconductor industry said that the decision helped the Korean chip makers avoid the worst-case scenario. “There had been concern that the two companies could be forced to shut down their chip plants in China because initial media reports said that the U.S. will impose a 10 year-ban on chip factories’ expansion in China,” the source said. Still, the companies face trouble keeping their facilities running and aligning them with the latest technologies as the U.S. has imposed a multitude of restrictions on top of the Chips and Science Act.

반도체 업계의 한 관계자는 이번 결정이 한국 반도체 제조업체들이 최악의 시나리오를 피하는데 도움이 됐다고 말했다. 이 관계자는 “미국이 중국 반도체 공장의 확장을 10년간 금지할 것이라는 초기 보도 때문에 삼성전자와 SK하이닉스가 중국 반도체 공장을 닫아야 할 수 있다는 우려가 있었다”고 말했다. 하지만 여전히 두 회사는 설비를 유지하고 최신 기술에 맞춰 설비를 조정하는데 어려움을 겪고 있다. 미국이 반도체법에 많은 제한을 부여하고 있기 때문이다.
 
 
 
Last October, the Commerce Department mandated companies to acquire approval from the U.S. government to supply their factories in China with technologies for the making of DRAM memory chips rated 18 nanometers or less and NAND flash memory chips with 128 layers or more. Samsung Electronics and SK hynix received one-year waivers for the October rule.

Meanwhile, a Korean legislative committee agreed to table a bill aimed at increasing tax incentives for semiconductor manufacturing facilities in Korea. Lawmakers will cast votes in a plenary session set for March 30. The amendment would give big corporations a tax credit of up to 15 percent for investments in semiconductor manufacturing, up from the previous 8 percent.For small and mid-sized enterprises, the percentage will be revised up to 25 percent from the current 16 percent.

한편, 한국 법안 소위(기획재정위원회)는 국내 반도체 설비에 투자할 경우 세금 혜택을 늘리는 법안을 상정하기로 합의했다. 국회의원들은 3월 30일 국회 본회의에서 투표할 예정이다. 개정안은 대기업에 대해서는 반도체 생산에 투자할 경우 현행 8%에서 15%로 세액공제율을 높인다는 내용이다. 중소기업에 대해서는 현행 16%에서 25%로 높아진다.
